I emailed most of those email addresses you have posted with the subject:
DOS & USCIS practical joke on those attempting to immigrate legally - July 2007
Quoted the AILA article you posted.
Does anyone have the addresses for cnn? I don't have much faith in FOX news, MSNBC may be more sympathetic to our cause; Don't know about CNN but wouldn't hurt to mail them too.

If you meant the person who posted on the other site, then I disagree with your opinion. Using words like the one used above, regardless of whether hidden behind asterisks or not , is not the right thing to do.

We are talking two different things here. You are saying about AC-21. The OP is asking about retaining PD. The way you can retain your PD after I-140 approval is :-
You file a new labor with the new employer - once it is approved - you need to file a new I-140 application and attach the old approved application with it - this would ensure that your PD will become the PD from the old case.
Difference with AC21 is - in the case of AC21, you just switch jobs and your current GC process continues - you do not have to file a new labor,140 etc.
Dilbert_cal:
Does this mean that with AC-21, I can just switch jobs (provided it is similar), and that my PD etc remains the same and that I don't have to do my labor and I-140 again? My I-485 has been filed for more than a year now (my 140 is also approved), and while I would like to change my job, I don't want to do the whole thing again.
Your response will be HIGHLY appreciated, bcuz you seem to know this stuff well.

Has anyone sent I-120 application to USCIS to get their I-94 extended?
What would be the basis for them to give extneded or issue a new I-94.
Should i send the copy of my passport with the visa stamping in it?

I dont know how far this bill will get, given the facts that it has weaker workplace enforcement laws plus a direct path to citizens. This is exactly what the Republicans dont want.
I dont know much about the bills, but I agree with Nat23 because the post mentiones weaker enforcement laws. I have a feeling that this will not clear from Senate to be forwarded to the house.
Americans need touch reforms, president has mentioned no amnesty in his
unions speech

The track of L-1A is very tricky, there is lot of scrutiny/audit before they get their GC. So grass may look greener by looking at the example of one person, but there may be many other guys whose application was denied, which you may have not highlighted...

Ramba,
What if I am working as a contractor with a govt agency. The agency offers me a job but salary would be 10K less than my current salary, but with better benefits. However still new salary is more than what is required to pay for similar job at that place i.e. if a company is filling for a new H1B. (the prevailing wage at new location for that job classification at that position/level)
Now in this case, if the salary is 10K less than what is specified in my I-140, will I hear any music from CIS? This is not hypothetical, but real dilemma I am facing.
If both job (old and new) in same area, and new salary is "considerably" less than old salary, then it may be an issue. But it may be overcome, provided if you know the prevailing wage determination (not salary) of old job. Lets say if the PW for a level-3 engineer for your old job 50K at a particular county, and I-140 salary in your old job is 70K, and if you port to new job with new salary as 60K in same county, then it should not be an issue. Again, if USCIS does not buy this, you need to dispute. It needs extensive lawyering with DOL wage survey as a proof.

You do not have to be single unless you have already decided on marrying someone who is not in the country at this time.
my employment is terminated a month ago. I still need to file h1 transfer to the GC sponser. I am single
I am told that H1 can be transferred only with in 10 days-20 days or so. which means that it is already a month. so in case if I dont get the h1 or if I have an issue in the H1 transfer, is that the end of my being H1.
If I were to be on H1 again is it going to come under the cap along with those new H1 filers? I still have one and half years to complete 6 years.
I have a fall back to EAD though based an approved 140 and 180 days past 485.
But how do I get the spouse then???

Any number lesser than 800,000 is good for us.. doesnt mean all is well.. we have to continue in our efforts with IV and we could have a better breakthrough..
Anything less than 800,000 is good... even a few hundred thousand less :) There's still a lot of work and patience required but a good news is a good news nevertheless.

ur current I797 should be the latest one for 2010.....since u got ur VISA stamped based on that....why would the POE officer not look at that but look at a previous I797....
How can u get VISA stamped on passpoer for 2010 if u do not have a I797 until 2010..its confusing to me. OR am I missing something.
I got my stamping till 2010 based on my I-140. I did that to save another visit to embassy when I go out of country and its costing me dearly. The visa stamp clearly mentions the effective dates from both 797s. So the officer asked for both 797s and stamped the end date from the current one. As he sounded positive that I can update it at my local USCIS, I didn't persuade him much. Maybe I should've done that!!!

PTO is a new one for me. Paid Time Off??
You can work with the new employer while H1B is pending, for 240 days as far as I know. There is premium processing if H1B doesn't come on time.
3 days without pay is not a gap in employment if the employer-employee relationship is maintained. Don't worry too much. Even in normal circumstances, it takes a few days to relocate.
Yep. Paid Time Off (PTO) - This will allow me to get regular checks until PTO is exhausted.
Actually, my question is it LEGAL to work for the New employer (After filing H1B Transfer and getting the receipt) when on PTO (Paid Time Off) with current employer?

along with all the great work being done by IV, I have to admit, the one annoying thing that we have to contend with is the wild speculative rumors that spread like wildfire... can people please stop spreading these and just wait a few hours for the announcement....
rumour on what seems to be a rumour. What IV has said is still a rumour until an official statement comes out. Pls grow up fellas, if you think its sensationalism, well aren't we having a roller coster ride for past month now..
and yet i hate to remind ppl, this is what the forum is for. If IV, Oh Law or anyothe site puts such news..its sensational already. cmon cut the crap. speculate as you wish..but speculate intelligently..
