Disclaimer - This is only based on my knowledge gathered from different forums so take it as its worth.
Depending on the timing of your return, you will get 2 or 3 years of RNOR (Returning non ordinary resident or something?). The RNOR status makes your overseas income non-taxable in India. So you can withdraw your 401K in those 3 years and pay less or no tax in US and no tax in India (on 401K withdraw). You will still have to pay a 10% penalty. This will ofcourse only work if you have low balance in 401K.
So for example, if you have a $30K in your 401K, you can withdraw $10K every year for 3 years, pay a $1K in penalty and avoid US taxes (due to exemption limits) as well as Indian taxes (due to RNOR status). But if you have a large 401K balance like 100K or something, there is no way to avoid taxes.

I agree with your research on India's tax Status. But I believe for US tax purpose we wont be Resident Alien unless we pass Substantial Presence test (unless we have a GC). We will be considered as Non Resident Aliens. The standard deduction for NRA's is 3k not 10K. Above 3K we need to pay 30% flat rate tax. If you have 30K and if you withdraw 10K per year then your tax will be paying 2100$ tax and 1000$ withdrawl penalty per year. In summary your tax rate could be upto 40%.
One other strategy is withdraw everything the leaving year and pay tax and put it in some investment like stocks, mutual funds or some savings. The gains wont be taxed in US if you are NRA (There are some exceptions like real estate stocks etc.). It won't be taxed in India due to RNOR status. So you can avoid taxes on the gain.

The AILA article may not be sufficient to explain how exactly we've been hurt. I've added a few more lines in the end and emailed to some of these addresses:

Losses suffered by my family and tens of thousands of others:
1) Cost of medical exams and having to take vaccinations
2) Attorney fees
3) Cost of getting paperwork expedited from home countris
4) Cost of time off from work to prepare the applications
5) Postage/Fedex
6) People canceling their non-refundable tickets for summer travel so they could be in this country
7) People having to spend a lot of extra money to fly their families back.
8) People having to change their marriage plans and having to pay for cancellations of a lot of events.

I currently have the Canon Powershot S50 which i'm selling.
Looking into the minolta Dimage A2 and the Olympus C5060.
Looking to spend about 1300.
I mainly take indoor shots . and looking to print pics as big as 11 x 17
Got the epson 1270 printer .

Your choice of a D70 will give you great joy in your indoor photography for the next two years especially with the 18mm-70mm kit lens. You can tune the camera perfectly to give you the image you want. Moreover it is one of the fastest camera at this time for the price you are paying.
The 50mm f/1.8, 24mm f/2, 28mm f/2 or the 35mm f/1.4 lens will add to your advantage for great indoor pictures without flash.
As for people who want a SLR-like, the Minolta A2 has better features than the Olympus C-8080 in terms of zoom coverage, number of frames per second, long exposure and weight of the camera.
A2 has a 28-200mm zoom range as compared to 28-140 of the C-8080. You can go at 2.7 fps x 3 images @ fine mode, but the C-8080 can only cope with 1.6 fps x 5 images.
A2 has a maximum of 30 sec for long exposure while Olympus has only 15 seconds. The only advantage of the C-8080 is its marco focusing distance which is 5cm. The A2 can only go up to 13cm.
For those who want a lighter weight SLR-like camera and do not need the speed of the D70, the Minolta A2 can be a better choice. However both cameras have fast speed lenses with the maximum at f/2.8 only.
With the D70, you can even have the 85mm or the 50mm f/1.4 lenses for indoor photography using ISO 1600. Surprisingly the D70 has extremely low noise level even at ISO 1600, something that you cannot find in the other two SLRs.

I have seen a similar thing with our other campaign - "File 485 before PD is current". There are some forums spreading negative information about IV and this might be the reason.
Of course theoretically it is possible to have them participate in these without creating an ID (which is free). We have to verify in some way to avoid antis, maybe ID or bill or some other way.
We don't want to go to USCIS with 100s of members from numbersUSA or fishing site users.

You should read that RonGothers thread - he is strongly of the opinion that maintaining H1B status while AOS is pending is useless
Its not useless if you are in a ROW country/category that is always/usually current since your I-485 can be approved in a short period of time, without having to extend H-1. So you can save yourself the hassle of switching back and forth between H-1 and EAD.
It only becomes pointless when you are in a backlogged country like most of us are. By the time a decision is made on the I-485 you wouldve already extended your H-1 beyond 6 years, thus making it dependant on that EB petition.

Hi Everybody, I have a question to the people who already invoked AC21? Do we need the I-485 receipt to invoke AC21 or can we use I-797C(Biometrics notice) as proof of AOS pending? My employer and employer's attorney did not agree to give me the I-485 receipt. I filed FOIA but did not get anything yet. I could file EAD and AP online and send the biometrics notice as supporting doc, received EAD and AP is pending. Does anybody know if there is any other way to get the I-485 receipt or is it really needed for AC21?
I did not get the receipt notice, open SR and received a standard letter stating that duplicate receipt notice will not be issued. I spoke to one of the IOs and took info pass, the said "copy of FP receipt notice issued to finger print you for I-485 can be used as proof of I-485 filing". Additionally, the letter that I received from USCIS also serves as proof of filing :). You only need a proof of 485 filing to avail AC21, receipt notice is one of the way to prove and alternative proof can be used. I confirmed this with my company attorney, he was in a same page - my receipts were lost in transit.

Noone is forcing them to be ehre - you are saying. And I am saying: nobody should be forcing them out, either. They are ehre because they want to be here and because they want to discuss something with other people who are here - administrative problems or philosohpical issues.
'You should trust the organization in what they do' - you are saying. The organization should not be perceived as an abstract, 'know-it-all' deity that we, tiny humans have to blidnly follow. The organization is us collectively and we should not be following it, but leading it or at least taking it somewhere. Sometimes the road is straight and goes forward, sometimes there seem to be multiple roads that need exploring which may or may not coverge again. Sometimes the journey is not continuous and you need to stop, consult a map or a compass and realing yourself. There is nothing wrong with that. There should never be blind trust because that will sooner or later drive us all down the cliffs.
'If you have ideas talk to the core and discuss with them in person' - that is exactly what we are doing. Throwing around ideas and discussing them amongst ourselves. Sometimes the discussion is easy and disciplined and constructive and sometimes it is hard and confrontational and destructive. I think that if it is too confrontational or too destrcutive that indicates that not all is well within the group - I would refrain from calling it an organization just yet - and the ideas are not mature or ready yet and/or the group is not really cohesive and it is really not one group. Both of which are problems that need to be addressed and dealt with. By stifling discussion and censoring out ideas that you do not like, you are doing a disservice to the entire group because the group has to discover what is the cause of the destructive confrontation otherwise it cannot successfully function and fulfill its objectives.
For those who dont agree with what IV is doing, no one's forcing them to follow what IV does and certainly no ones forcing them to be here, but if you are here then you should at least trust the organization in what they do.
If you have ideas talk to the core and discuss with them in person or call them... i m sure they will be glad to take it up if the idea benefits everyone and not just me or you... breaking off driving folks in different direction is not the solution, it will snow ball into a big problem.
'You should trust the organization in what they do' - you are saying. The organization should not be perceived as an abstract, 'know-it-all' deity that we, tiny humans have to blidnly follow. The organization is us collectively and we should not be following it, but leading it or at least taking it somewhere. Sometimes the road is straight and goes forward, sometimes there seem to be multiple roads that need exploring which may or may not coverge again. Sometimes the journey is not continuous and you need to stop, consult a map or a compass and realing yourself. There is nothing wrong with that. There should never be blind trust because that will sooner or later drive us all down the cliffs.

Sometimes the discussion is easy and disciplined and constructive and sometimes it is hard and confrontational and destructive. I think that if it is too confrontational or too destrcutive that indicates that not all is well within the group - I would refrain from calling it an organization just yet - and the ideas are not mature or ready yet and/or the group is not really cohesive and it is really not one group. Both of which are problems that need to be addressed and dealt with. By stifling discussion and censoring out ideas that you do not like, you are doing a disservice to the entire group because the group has to discover what is the cause of the destructive confrontation otherwise it cannot successfully function and fulfill its objectives.
For those who dont agree with what IV is doing, no one's forcing them to follow what IV does and certainly no ones forcing them to be here, but if you are here then you should at least trust the organization in what they do.

about Berkleybee latest postings. I know this person from day1 and no-doubt, as mentioned by others, she was an important member of IV and great asset.
