I wish it was wrong. But it seems to be happening, I heard from a friend who owns a company with 100+ consultants. One consultant form other company that he deals with regularly has been turned away in this manner. That guy was returning from indian trip, who had valid documents including client letters and project. The IO's response was that "We don't have shortage of people like you, we don't need you." His passport was stamped as deported. I really feel sorry for these guys. Sorry guys, it is true.

Why does the lawyer think it is over optimistic?
Does he mean there are more pending applications? If yes, how many and does he have separate data we do not know?
He said that category is rather low priority for USCIS, and therefore it is highly unlikely for it to be approved before 3 years, although it's entirely possible.
I'm hoping he's wrong.

Thank you all for your support ! Finally a place where someone actually understand what I am talking about :) Appreciate all your support.
If we and our parents have followed the law, then we should also be allowed to benefit from this act. What makes us different from illegal kids ? Sure, the illegal kids probably face a tougher climb but we also have to go through hardships. It is easy to say that the legal kids can simply get H1B etc but these people don't understand the pain of this GC process....Forget GC, who will give BS students with barely any experience H1B sponsorship ? And who will pay those hefty student loans ? Fresh graduates with barely any experience are not highly skilled professionals with tons of experience like most H1Bs coming from India are. My 21st birthday sucked !
The main problem is that we are not making a loud noise like how other illegal immigrants do. They have several publications/Lobyists/media/latino communities that fight for this cause. Thus, you see these bills getting introduced even in this economy. The bill will most likely pass this year with so much support from the congress members.
I know we don't have those big support groups but we can only try our best and hope to make it eaier for our future generation applicants at least.

Check out http://dreamact.info/forum these member have really took a lot of effort in repeatedly contacting these senators and have directly met with their representives ! Hopefully we can do the same and get them to at least notice this issue !!Please keep calling/emailing/faxing these senators.
In any case, the main sponsor of this bill is Sen. Richard Durbin and his contact number is 202-224-2152 Please tell him/his representive of this issue and don't get intimidated etc. Also call you local state senators from the link I posted in my first post.

What i see happening (If it happens which i seriously doubt) is that we might get a percentage of whole visa and that will just be enough to clear EB2 till 2010 as teh spillover rule will be followed. And after that happens all the EB3 will be told to try and port to better their situation or donate for another advocacy down the line in the future
This will help all categories to fix the current backlog and in future too.

I have been in this country almost 10 years. I graduated from a Top 5 school here and work for a consulting company because I choose to. I work on embedded processors and there are very few engineers out there who do what I do. Although I'll get my EAD soon I want the option to continue on H1-B. If this draconian measure passes and I have to go back. Fine. Not my loss. This country loses.

Its clear there are many who are frustrated. I feel there is a better way to convince people to contribute. I have been registered with this site for several years now. I hardly know much about this organization. sure there is a nice little bio on here of core members but what role do they play on a daily basis? is this organization a democracy where people get elected to posts every year or do the people running it pledge to run it forever? why is information hidden from non-donors? Where can i find site admins...do i have to search forum posts or is there some place that lists them? what are the goals for advocacy? who decides? is there a vote?
i can go on with a list of serious concerns about IV
once people are convinced of a well run organization and see where exactly their money or time will be spent then i am sure there will be many more contributions made.

I guess a couple people beat me by a few days. I came to the US on Aug 6, 1994. After three degrees, I started my labor cert process in November 2001. With the same employer through out this time (except for small stint after Hurricane Katrina).

Pappu, can IV get together with NASSCOM and contact Indian Foreign Ministry to push the US Government against this bill? Is this something in the scope of IV's advocacy?

No, because the first time that NCS gave him a claim confirmation was November 9, so, he told me that he needed to wait until December 9 to proceed through AILA. However, in addition to continue calling to National Customer Service, he sent form 7001 to Ombudsman, and a letter to the Texas Service Center.
