Hi Kodak & other senior members,
Do we need to have seperate covering letters for primary application and spouse (dependent).
How do we seperate primary application documents from dependent documents? any color sperators or staple the docs?
which color seperator do your suggest?
Do we need to place check for each application 485, 131, 325 at the start of each or can we place all checks of a applicant in sigle location?
Where do we enter I140 recipt number in 485 applications, Is it that we need to provide a copy of 140 recipt as part of application docs and USCIS will manage accoridngly.

I am not a lawyer. However, I believe you should be fine if you send the receipt for the new H1 appl along with the 485 appl.
You can also consider filing your H1 in premium processing.

Can't we get an ATV from India on Advance Parole. I am assuming that they treat AP as a Visa to USA. Also, can someone confirm that I will NOT need an ATV when going from here to India. I know that under the requirements, they state that Indian passport holders do not need ATV if they are going to India, but did anyone have any experience of AP or transit visa being checked when going to India from USA.

The Congress is going on recess for 5 Weeks.. Madam Zoe Lofgren will have hands Full to Push for voting in the House before that. Also, House Speaker Pelosi has a wide latitude or power i can say to push this bill for voting . Shouldn't we call Speaker Pelosi too in this regard should the Bill gets 'Markep up' today??

hello guys
I was returing after 3 weeks vacation from india and i went for stamping at new delhi adn got 3 years h1b ( this is my first h1b ext ). At POE officer was rude and he told me that he knew that I am not working as what my docs says. I gave him all letters and all that still he was saying that where did i get computer traning ??? etc.. I told that I have MS in Com Scie from USA but still he was rude and even I had valid stamp for 3 years he gave me only 2 years of I 94. when I asked how to get that one more year he simply said exit and re enter OR talk to ACS ( may be he means USCIS )..
so it could be true taht people may be turned back at POE.

You are right -- I was thinking of filing again but separately. I just redid my calculation with that in mind and found that I will be actually not gaining anything, in fact losing. However, just to be precise I believe I can count my wife as a dependent since she has had no income and she can not be claimed dependent by anyone else. But yes my standard deduction comes down by a lot and that hurt me.
Mark Bartosik is working on getting SSA to give dependents SSN? If so, I wait for his response with much eagerness. Thank you, Mark.

You have valid points and I know people will oppose it. My ultimate goal was to create awarness in media/local people about how number of h1b from india is not directly proportional to numer of green card alloted to India (mostly EB3). And if we want to do a rally/campain to create awarness then I doubt there will be any media attention. But if we do a negative campain then there will be too much opposition and I was planning to use that opposition to gain media attention about the injustice of per country limit GC quota.
The real solution behind my thinking is to remove per country limit on GC.
Anyway, this is just an idea as I am not seeing any solution in near future for EB3 India...

House Republicans reject illegal-aliens amnesty bill

House Republicans yesterday officially rejected the Senate immigration bill that would grant citizenship rights to some 10 million illegal aliens now in the country.
"We agree that we cannot support the Senate amnesty bill," House Speaker J. Dennis Hastert said. "This Democrat immigration bill wouldn't secure the border. It would erase it."
Mr. Hastert met yesterday with other House leaders and the chairman of several committees to discuss how to proceed with the stalled immigration legislation and emerged saying new border security proposals will be offered next week.
The new initiatives will include more border patrol agents, new fencing and surveillance and stricter enforcement of current laws, which they hope will pass both the House and the Senate before November's elections.
"We will take many of these recommendations and move quickly to pass border security legislation in the next few weeks," Mr. Hastert said. "Congress cannot wait until next year to move on this issue. The American people expect us to tackle this problem and solve it."
Sen. Edward M. Kennedy, Massachusetts Democrat, criticized the decision to abandon "comprehensive immigration reform."
"After a summer of cynical immigration campaign events and years of cutting billions from border security funding, today's announcement has more to do with solving a political problem for Republicans than solving our illegal-immigration problem," he said.
"While we all support more resources for border security, it is abundantly clear that these stop-gap measures are designed to provide cover for their failure to produce comprehensive reform."
House Majority Leader John A. Boehner vowed to complete legislation.
"Republicans will take immediate action to put legislation on the president's desk that fulfills our promise to strengthen our border security by providing more border patrol agents, enhancing enforcement, building more fencing and increasing surveillance," he said.
"Republicans will vote on these reforms before adjournment and work to send them to the president's desk for his signature."

Company lawyer conveniently is on vacation till July 15th. And he was already a pain in the butt to deal with, screwed up our 140 already (I mean which lawyer screws it up, right!). I had to walk him through our case again and again. I mean I might as well do the AOS myself since he does nothing except do the G-28 and mail it out and I do the filling up of all forms and photocopies. Besides you should never piss off a pregnant woman!
My only concerns are receiving RFE which I will get one anyways for incomplete medical as I'm pregnant right now but that's expected. Other than that, I''m pretty confident that with help especially from competent individuals in this forum who've already been through the process can help me along the way, if I have any questions and I inturn will shed light on whatever (probably little) I know.
My other major concern is doing a CC case as I go under worldwide. My husband being the primary and all categories becoming current as of July, they might just ignore our CC request altogether and file us under India. Why bother you might ask! We might get EAD and AP if all goes well but might get stuck under the GC process if the dates retrogress further back than it was in June for India. However, I'm still going to take my chance of filing under CC and make a big enough statement on top of the application of CC and sent a separate copy requesting CC as well and ask the case to be reviewed by a Mailroom Supervisor from the get-go.
Any advice about what I can do differently or just about any advice will be appreciated. Sorry for the long post.
