Staying here or going back depends on an individual's priorities. If my priority is to lead a life of luxury then I should stay. One thing nobody can deny is that there are more material comforts in the US for now. (will this change in 10 yrs no one knows). But on the other hand if I cant spend festivals without family and I'm ready to take a hit on some luxuries then I should go back.
You have to weigh the options and see what suits you.

Assuming SA2238 passes... It will be the end of 'Contracting' for all practical purposes. A bonaza for outsourcing companies! Lots of projects and positions are going to get outsourced. Some projects may be moved off-site, as in big contracting companies doing actual work in their premises, some will go to India. some H1Bs may be lucky to be hired as "direct employees" by the clients, those who can will switch to EADs (which don't have such restrictions). For others, it'll be the end of the road.
so what does this mean now? I have little less than 3 yrs left on my H1b and I just started my GC process. Does that mean once I finish my 6 yrs, getting an extension will be a problem? Again I am assuming SA2238 will go through by that time....
Also, I have heard that in california H1b extension beyong 6 yrs is being rejected already stating that you cannot sub-contract on H1B

It is called lame duck because it does not consist of the newly elected representatives and as such the incumbents are expected to deal with unfinished business before the new congressional members step in. As you can see the incumbent members hold office only till end of the year i.e. before the new members step into Congress in January. How will lawmakers understand the existence of legal skilled immigrants, when barely 133 members out of 25,000 have shown the willingness to do a simple task like writing letters to the President? As far as lawmakers are concerned - we don't speak up so we don't count.

I filed my application with 864 and had no issues. It was approved last year in July along with my wife's app.
Do we need to fill form I-864 or form I -134 for affidavit of support? A friend of mine who filed with murthy this month is forwarding his set of documents. The documents he filled in includes 134 and not 864. I am looking at uscis website and I am trying to figure out what is the difference between the two. Does any one have more info on the difference between the two documents?
Which one should EB guys should be doing?

I am still debating in my mind where I want to settle so
I am very open to idea. Here's my take on your points:
2. Agree and Disagree. Security has nothing to do with the citizenship status. Crime rates are way lower in most US cities. This isn't about bad mouthing India. Its just the way it is. Stability ... very wide topic. If it is social stability it is obviously higher in India.
Well, not so in LA, NY , Chicago or for that matter even in SF downtown. If you want to invite trouble, you can find it in any corner of the world. I feel that crimes in US may be less in number but are far more violent than in India. Punishments far more stringent.Statistics show that USA ranked alongside Saudi, Iran, China in terms of judicial executions. To me that is a dubious distinction and an indicator of how tolerant the real society is. In a nutshell, the crime here is more violent and there are more gun and drug related violences. (Now I am not including kashmir or Bihar in my statistics. We all know whats the truth there)

I was thinking to complain while interview but when I got my passport and I 797 back I was so relaxed so forgot to note his name.. next thought was never go out of USA..
The officer who stamps your passport at POE is supposed to write doen his/her Badge number on the Entry Stamp that they place on your passport. Look it up.
That badge number should be good enough to make a complaint. Also, it is not difficult to track down who the officer was, if you remember the time and date of your arrival at the airport.
You can definitely complain about the officer, because it is his job to ony issue you an I-94 after verifying, to his/her staisfaction the credential and information presented by you. He is not supposed to comment on the labor market. I say get hold of good attorney and sue his (Offer) ass.

I am not trying to downplay the gravity of this issue, but I don't think May 21st 2007 will have any significance even if this irrational piece of badly written legislation even becomes law. First and foremost no law can retroactively treat those who have followed the law before the new one is enacted. In most cases those applied before a law is enacted are treated in accordance with the old law or some kind of transition procedure. It is foolish for anyone to assume that people will plan on to file things based on when a legislation is introduced in Senate. Imagine the law suits that can be filed simply saying I was not made aware this provision when I was filing this petition and I am entitled to the full refund of the filing fees along with the associated damages. USCIS will be bankrupt in no time. That's why most lawyers are confident that such an insane thing even if it becomes law will some how be handled without retroactively treating the existing applications. In my opinions all those who have things at stake such as I-140/I-485 concurrent fillings or changing jobs to restart the process should be ok and there will be ample warnings when the real train wreck in imminent. Until then let's support IV and bring down the curtain on this stinky mess called retrogression.
