I think if IV hire an immigration lawyer and answer immigration
question online, probably our organization would get 1000s of
members. I know we are doing it over the phone. But if
people has to come here and register in order to ask questions
we would get many many responses.
Just my thoughts.

I called all the congressmen/women. Three democracts said they are supporting the bill - Gutierrez, Davis and probably Jackson-lee (unsure about the last name). No of the republicans reps would tell me their current stand.
It barely took twenty minutes. I am unsure how much influence this would have but this is way better than not calling.

The data is correct since we are assuming that if USCIS is publishing on their website and making this information public (that they did not all these years) it should be correct.
As per the data you should get your Greencard this month.
However your visa bulletin date is 01JUN02 for EB3 ROW
So this means clearly that DOS is not advancing visa dates for you even though there are only 854 people ahead of you and you should be current.
This also means, you and others like you need to ask DOS an explanation why your visa dates are not moving for people like you based on this data. IV is already working on this discrepancy and if there are more people like you to support this effort we can do it much sooner.
Please ask others in the same situation to come on IV and join this effort so that we can now work on this discrepancy. We have already cleared the first hurdle of getting the data. Now let us use this data for our advocacy purposes.

Since IV is assuming USCIS 485 inventory data published on USCIS website is correct, what actions IV is planning to take against False FOIA information provided by USCIS?

If you stayed here for more than 5 years, you are American already.
So if you stayed in INDIA for first 23 years you were indian and then when you stay just 5 in America, you become American. Is that the logic?

I have already found out today, SS office refuse to issue non-work SSN to my children, they don't recognize that tax rebate is a benefit. Actually, the guy in SS office was very rude, he did not even allow me to state my reason, keep shouting "H4 can not get SSN"
Even if they don't accept this reason, they should give you a letter saying
that no SSN can be issued.
I also went to the SSA and although my reason was not listed, the officer promised
to check with the regional office. She also did know circumstances when
someone with H4-visa can get a SSN.
Before I apply, I will ask the IRS for a document showing the data of my
TAX return for 2007 (I cannot remember the form number for it now,
but it doesn't cost anything to get this information.)

Guess, we should collect money for flowers and then send it as one big order this would get their attention opposed to several small orders over a period of time that might go unnoticed.
Any one agress? If so, lets open a collection for it and pick a date.
===============================
Contributed $100 so far.
Registered last month.
I guess anything is fine.. those who want to send individually, can do as, and those who want to get organized and send one big truck, should do that. As long as they get the message and we get some media attention..
Grab all copies of "Munna Bhai......" , All Govt agencies are going to order it next week. we can recover some of our losses selling them at a premium :D

People, this sounds like more of steaming, rotten garbage that is spewed by the politicians, on the subject of immigration, on a regular basis.
If and when Immigration relief legislation in taken up by Washington DC in earnest, we will know about it from the people who bring it up for vote, not from these freelance websites and such.
Whole atmosphere in US is racially charged, and the developements in Arizona have only helped to make things worse. I hope, and I hope a thousand times that I am wrong, but I do not see any immigration relief legislation anytime during President Obama's current term.
Why not be positive and do whatever we can, to raise our voices also.
Nothing was talked about in the last few years and see something appear to happen now. Lets hope for the best and not just for someone to bring it up. Lets do something,.
Things can go very wrong sometimes, though.
Example:Its very possible the current processing dates for EB2 also to go back to 2003. We have seen things like that happen many times. So we must go with full efforts from our ends too.

Driver's License Rule Roils Michigan (http://www.washingtonpost.com/wp-dyn/content/article/2008/02/14/AR2008021400497.html) By TIM MARTIN | Associated Press, Feb 14
LANSING, Mich. -- When Michigan officials recently reinterpreted state law to stop nonresidents from getting driver's licenses, critics said it had an unintended consequence.
The crackdown _ intended to target illegal immigrants _ also affected legal immigrants who are not permanent residents, including employees from other countries temporarily working in Michigan.
Businesses and universities have complained, saying Michigan's reputation is suffering. The American Civil Liberties Union sued Wednesday on behalf of legal immigrants.
State officials say there are nearly 400,000 foreign businesspeople, students and their families in Michigan on visas, and some have already have been turned down in their quest to get licenses, which hurts their ability to find jobs.
"With this policy, the state is sending mixed messages to me and other registered nurses who are moving here from other countries to fill a nursing shortage plaguing Michigan," Catherine Gates, a Canadian citizen living in Muskegon, said in a statement released by the ACLU.
The Legislature has begun passing bills to clarify state law so that legal immigrants can get driver's licenses, but the House and Senate haven't yet agreed on final legislation.
Driver's licenses are among several hot-button issues surrounding the debate over illegal immigration. New York Gov. Eliot Spitzer last year proposed allowing illegal immigrants to get licenses, but withdrew the idea under heavy criticism.
The issue has also reached the presidential campaign. Sen. Barack Obama favors giving licenses to illegal immigrants. His opponent for the Democratic nomination, Hillary Rodham Clinton, once hedged on the idea but now opposes it.
The new policy in Michigan leaves Hawaii, Maine, Maryland, New Mexico, Utah, Washington and Oregon as the only states that do not require drivers to prove legal status to obtain a license.
That number may soon be getting even smaller. The Oregon Legislature on Wednesday passed a bill requiring the state motor vehicles agency to verify whether an applicant for a new or renewed license is a U.S. citizen or in the country legally.
Additionally, the bill requires immigrants to show they have a current visa to get a temporary license. It would be valid only as long as the visa is valid.
Oregon's bill now goes to Gov. Ted Kulongoski, who has said that the state, with its loose identification requirements, had become a magnet for trafficking in fake IDs.
The rule change in Michigan came after state Attorney General Mike Cox decided that granting licenses to illegal immigrants was inconsistent with federal law.
Secretary of State Terri Lynn Land interpreted Cox's opinion to mean legal immigrants who weren't permanent residents shouldn't get licenses, either. She said she supports giving legal immigrants driver's licenses, but that state law must be changed to do so.
The new policy applies only to first-time applicants and shouldn't affect immigrants who come back to renew their licenses. Many legal immigrants can continue driving in Michigan under terms of their valid licenses from their home countries.
The ACLU said its immediate goal is restoring driver's license privileges to legal immigrants. All the plaintiffs in their case are legal immigrants, the ACLU said.
But the organization's position is that driver's licenses should be available to all residents, including immigrants who live and work in the state and intend to remain. That could include some illegal immigrants.

Gurus,
If I deposit ~ 1000$ ( 49,000 Rs) everymonth in the NRO account at ICICI or HDFC. Total for the year would be 12K. Do I have to submit this form. From definition it seems that " If aggregate value of these accounts exceeds $ 10K at any time" means that total sum of accounts 1,2,3 should not exceed 10K at anytime inorder for someone to not file this.
Any input?
Thanks
This is what I think. You have to report only if you had a balance of more than $10,000 during anytime of year 2008. If you have more than 1 account then the aggregate of all the available balance should have been more than $10,000 at any point of the time in 2008.

You should be little more respectful when speaking about H4 issue. Your words are very offensive to me and people like me in this forum. The news does not say anything about non-working spouse in any place. It just implies ITIN = illegal immigrant
QUOTE - "A mini-brushfire broke out in the Capitol Wednesday as members realized that the decision to refund tax payments to ITIN holders meant illegal immigrants could possibly benefit."
"House Minority Leader John Boehner insisted illegal immigrants would not benefit because they generally don't use ITINs to file tax returns since the very use of ITINs indicates the return may have been filed by an illegal immigrant."
It is unfortunate that H4 is mixed up in this. Bottom-line is this - if an non-working american spouse should get the rebate, a legal H4 spouse should also get the check. I think we all agree to that.
yabadaba, give us one reason why you dont agree ? Because to me IRS treats an H1 and citizen exactly same way. Why should they treat their respective spouses differently ?

My question is do I need to submit old I-20 along with other documents for I-485
You know, I read the instructions and it says they want evidence of your admission to the US and current satus. To my mind, you H1 approval notice should be sufficient. But there have been posts on this board that suggest showing evidence of continued legal status.

I do hope other states will not take MI stance as a precedent.
Awareness about the existence of legal skilled immigrant applicants is the need of the hour.
Expect other states to follow suit if there is not an outcry from the legal immigrant community.
This brings a few questions in view of this new law:
-If you are pulled over for a minor traffic stop, and show your foreign driver license, how would the police officer know you are here legally? I suppose you will have to carry your passport at all times with your I-94 and valid visa stamp.
-However, if you do not have a valid visa stamp, but your H1B is still valid, how would the police officer know you are here legally? Maybe Michigan is training troopers on basic immigration rules and regulations.
-Regarding travel, would you be able to travel with your foreign passport even with an expired visa stamp without raising eyebrows?
-What about refugees and asylum seekers who have an EAD but have not obtained LPR yet? Would they be able to drive? There are refugees who faced hardship in their home country and I doubt they all have a driver's license when they come here.
Wouldn't this make it impossible to live in Michigan for ALL immigrants? Michigan will be driving undocumented immigrants away from their state, but won't they risk driving aways hundreds of students, workers and researchers on temporary visas?
This will surely bring comments from AILA.
