Beauty of the lobby is that it will have both sides. If anti can make noise about more immigrants, business can lobby about resource availability. So it should find a balance.. It is the same infamous "death panels" argument that didn't win in Healthcare debate.

Best way to clear this mess is to "Eliminate per country quota in EB categories"
or
atleast remove the number of dependent applicants for numerical count from EB visas. Because it doesn't make any sense to count the kids also as highly qualified and experienced workers by counting them against country quota.
I completely understand the frustations of EB3 (i'm also one of them with PD of 2003). Also i believe that anyone can express any thoughts.
However, for the past 2 /3 years immigration topic has been a red hot issue for some and panic button for some other poiliticians in this country. Unfortunately no one wants to realize the ground realities and need to fix the current EB immigration system. Even Bill gates tried his leve best, so does some other intellectuals.
At this juncture, all i can suggest is to motivate fellow IVians to come forward and contribute so that we can lobby in a better way. Money in this country for sure can make many things, legally.Trust me things CAN be worked inside the beltway (i mean , capital hill) with powerful lobbying.
Look at the lobbying for nurses or lobbying for freddie mac or fannie mae.
I have a question for IV core group. Is there something IV is planning to do to help the EB3-I and C cause? Before you answer, please read the bullets below
1. I am not looking for answers/responses that cater towards why we are in EB3. I am not concerned about the past, I am looking forward towards the future.
2. I am aware of the campaigns (bills introduced, letters mailed and faxed, etc). I am aware because I participated in each of them financially as well as with my efforts/time.
3. Any campaign that bears fruition is going to distribute benefits in the order of EB1 -> EB2 ROW -> EB2 I -> EB3 ROW and then if some is still remaining then EB3 I & C.
To repeat myself, my question is whether IV plans to do anything specific for the EB3 India and China group (quite a few of whom have been staunch supporters of whatsoever IV has done till now). An example would be "press for recapture AND apply the recaptured visas in the reverse order starting from the severely retrogressed category of EB3 I and C". Is that or something similar, that IV can do for its loyal EB3 members?

Please review the response to RFE(if they let you to) before they send it out just so you can catch if there are things that don't seem right. But as I said before, if you can get Trustforte say that equality statement, you should be good. Don't loose sleep over it (I know it is easier said than done :) ).

I support the idea of rallying in BUSINESS SUITS. We're all an educated bunch of people and EVERY single one of us has a suit or we would not be having jobs today.
Let this rally seperate us from the illegals and be a TRUE "white collar"/"BLACK TIE" event. We are well respected LEGAL immigrants. Let us bring our white suits and ALL business gear with us. Even if that means we carry leather bags, so be it.
Let us come formally dressed with our business gear on.
We may not be able to make it coz we will be in the same boat as Singam, but I do support this idea.
Lets do a realty check. These rallies are more at the college/university level thinking. We need to act a little mature and professional.
My idea would be:
Who ever can work remotely, plan to work on that day in the lawns of Capitol Hill. Only arrangement needed is wifi access. Company logo attire with black ribbons/flags will make a bigger impact.
With no disrespect to illegals as people, our last rally was perceived as an illegal immigrant rally. If the congressman addressing our rally thinks we are illegals, there is no bigger joke than that. Let�s correct our image!!!
(I won't be able to participate, as we are expecting our first child around that time frame)

NumbersUSA and Matloff should be judged by their actions, not by their words. I have not seen anything positive from their work that would benefit us. When they lobby Senate/House to introduce H-1B/GC reform favorable to us, then they can be trusted on that issue alone and may be we can lend our organizational support. So far thier task has been to skuttle EB immigration reform.

Welcome Back UN ! what do you mean by 'investigations will start with greencards' ? People with GC's already Approved or with those with pending AOS ? Any reason you see why this is happening !!
Before, nebraska and texas only started doing I-140's; california was picking on decent size companies with greencards. They were starting to deny i-140's stating that company only has short duration jobs and they are not permanent. I saw one company with 35 straight denials that mentioned this as an issue. Thankfully; california stopped doing I-140's.
Put it this way; if H-1b's are being denied because a company doesn't have a "temporary" job then chances are decent that how can a company have a permanent job when it can't even satisfy uscis that they have a temporary job.

we'll see how the direction goes in the coming months.

We are close to 13,000 members. The total legal- EB community is estimated to be 500,000. Even if we consider 200,000 households, We havent even reached 10% of people affected. This large group 94% of people have no clue what is going on, and how their lives are going to be affected. Please talk to everyone now.

Yes, there is truth to this.
I personally know two guys. One is my co-worker and the other one is my room mate from University.
While their Visaa were not denied, they have been subject to something called "Administrative Processing", which can take anywhere from 2 to 6 months. No employer is going to wait for you for 6 months.

My approved I-140 is getting revoked becaude USCIS is saying they didn't verify ability to pay 2.5 yrs back and asked for more docs.
Neednot to say, I switched employers 2 yrs back and switched to EAD thinking everything should be safe.
This is the second time this year that my I-140 is being revoked. In feb,07 my i-140 and 485 was revoked because USCIS ignored AC21 and never asked me anything about AC21. I filed MTR and got it reopened in May.
In nov this another mess.
My case is at Vermont and it appears either the officer is retaliating or is ignorant.
I know this is unprecedented but i am broked down and fed up of fighting them. It has been a never ending journey for my family.
I have submitted all my the documents and don't know whats going to happen.
Any advice from the community will be helpful as I don't know what to do.
Another thing, i used VP office for clearing namecheck which was done on Nov2 and this I-140 revoked on Nov 8.
I am on my 3rd EAD.

Everyone must write their experiences and petition and let their politicians know. People must gather here and do something about it.
Believe me folks, if we keep avoiding just out of fear - we cannot achieve anything.
Stay bold - do something about it. IV is a wonderful platform for all of us to help ourselves. So lets make best use of it
That's true but also remember you should validate the gravity of the situation. There is no point in hassling with a POE officer when he can very well turn someone back. Asians and moreso Indians are passive and everyone takes advantage of this. WE SHOULD SPEAK UP..but thr' the right channel and at the right time. Track tht son of a gun and sue him for racist remarks!!!

I am applying for myself and spouse.I have prepared one check each of amount $745 = ($395+$180+$170) for myself and my wife for our I485 + I765 + I131 applications (ie 2 cheques of $745 each)
Is there any problem with? Do we need 3 seperate checks(6 in total) for each application I485 + I765 + I131?
Cheques are payable to USCIS. I read in another thread that it should be payble to department of homeland security. I am confused. Which is correct???
Please advice ASAP.
