According to the report, there are 100K to 150K applications pending to be processed (guessing PD is current and hence includes dependents) and 500k to 750k applications expected if PD becomes current. If we assume 2.1 dependents on an average, this comes to 1M - 1.5M applications if PD is current. So is the total 1.1M - 1.65M? Does that sound right?

H1b humane-hear my story..it cannot be as inhuman as it can be..(i have written the story in one of the forums before also..)
My PD-Oct 2001..Eb3..My wife RIR-almost making it thru I140when all hell broke loose in our lives...my wife was pregnant and because of stupid gynaecologist..she ended up in hospital with complicated premature preganancy..guess what..as if it was not bad enough..her company got acquired just when she was admitted in hospital...imagine wondering about health insurance when she was kept to bed rest with no mobility allowed..we filed for insurance by mistake..which said that 20% in patient.....we were so shaken that even human resource did not advise us..guess what..baby was born..and it was surmised that baby will have long stay in hosiptal...2-3 months(eventually it was 4 months!)..somwhere around the first month..I realized that her insurance..will rip me off..I called right at the end of the first month..and tried several times to put my wife and baby on my insurance so that i don't end up paying 20%..it was lot of efforts until I found some desi in Blue cross insurance who put the whole family from the first initial month..when normally people get the policy for the following month at that time.
one down --and then another came..my wife was called to her office from hospital saying that..since there was lot of work in her office..she could come for some days..guess what..she went back..thinking..she could finish work and then take extended leave....guess what..she was laid off..and with baby in hospital..and lay off..plus a rush to change her status to H4 visa..imagine the workload.....finally got her status changed..to h4 visa..with GC and labor in trash...
I was so disgusted..that I started writing to Governor Shwarzenegger' office..who put me with Senator Diane Fienstein..and of course labor secretory Chao..after all the correspondings..all I got was my D number listed from Dallas..their sympathies...ALL I WROTE to them..Hey I want to change jobs because in those days I was commuting between LA to San Diego..where my baby was hospitalized...I wanted to be with my baby..and not work..but it was not possible..if I did..then I could get out of status...I even wrote to Department of Homeland security...and got no reply...they don't care..I ahve to be illegal to get sympathies..I guess!
Situation was bad..finally baby was out of hospital and I weathered all with help of Almighty...and now I am so disgusted with system..that I am moving to vancouver...
But I have another pleasant surprise..my boss wants me to work from vancouver and visit office once in a month...I don't know...whether it is possible...stay in vancouver and visit LA for 2 weeks and then go back and still maintain H1 status..
what do you say..after all the stress!

There is you and several other members who I have had a chance to speak to, are going through a tough time in life (both on personal and professional fronts) due to not having a greencard. Such experiences are my motivation to work as a volunteer and core member for IV and do something to solve problems faced by several thousands of people like me. IV is currently the only organization in USA working for the cause of legal high skilled immigrants. This IV forum has brought all of us together on one platform where we can share our views and pain. Members have come up with ideas and helped this community in any way they could. Some members decided to join this effort as core members and pledged more time and effort in order to bring relief to all of us. It is not an easy job. There is nobody else to work on the issues we face. You have yourself seen how the govt. and lawmakers responded to you and still did not do anything when you tried yourself as an individual. When we try to raise such issues collectively as IV, lawmakers do hear us. With greater membership numbers and resources we can certainly do much more to influence them and get the laws changed. Members pls. help us increase our membership and funding so that we can all collectively bring about a change and provide relief to everyone in our community. desibechara, If you have decided to move to Canada, good luck to you and your family. Do keep in touch with this forum. Hope we all members of IV can collectively work soon enough to get something done for ourselves to end our miseries.

Styrum: Why did you file an appeal on your first perm and why are you planning to file another appeal? Maybe I am not understanding something here. was your first LC denied? (on what ground?) why your second LC denied?? Please explain. it seems that we are on the same boat but my appeal have been there longer (now over 6 months)

(Moreover, it accuses you in claiming that the requirements are normal, even if you didn't claim that!) I am not preparing a second appeal. I revisited this thread today and saw several heartwrenching stories of some of our IV members. One way for IV to help you is through letting your situation be known to others via media. We have a few opportunities and if you are interested please send an email to himanshu at immigrationvoice.org. Do not PM me since my PM box gets filled very often.
It will not only help all of us generate awareness about our plight to american public, lawmakers too will be influenced by the magnitude of problems we face while waiting patiently in line for several years. I feel media is a great tool and we can use it very effectively when we all can get our message across in the world outside of this forum. Once we get IV members ready to volunteer for such interviews and to talk about their plight, IV will try its best to get their voices heard.
It will not only help all of us generate awareness about our plight to american public, lawmakers too will be influenced by the magnitude of problems we face while waiting patiently in line for several years. Gurus,
Need your valuable advice on this serious issue. Involved in shoplifting case, got arrested and plead guilty. Served the community service, and paid fine. Got the �Court Disposition Document� which states that I am all clear. My status is I-485 pending and have EAD, AP documents.
1. Is it safe to travel to India and come back on AP?
2. What are the possible chances that visa officer may not let me into the USA?
3. Do I need to carry any letters from my criminal attorney explaining the situation?
4. Any one in similar situation, please update me on this?
5. Please list of documents I need to carry during my travel

USCIS procedures suggest that for preadjudicated cases, they assign visas in order of PD, which should be the case now as focus appears to be on preadjudication. However, if there are no preadjudicated cases, as seemingly was the case last year, they have no way to do it in PD sequence. In that case, they pick files case by case in sequence of receive date (not the RD on your receipt, but the date when someone entered case data, which is close to ND) which works better for USCIS (but not for us) with wide open cut off dates.

But let's face reality for a moment - as several senior members routinely point out, inspite of our organization having several thousand "highly paid" members, the "donor" base is very limited. As Zen says in a truly Zen manner "we are where we are"...and we have to figure out where to go from here. Unquestionably, I am really thankful to our highly dedicated Core team for sacrificing their personal time and making all of the efforts that have led to substantial progress over the last few years for the immigration community. However,, that with a new government in place, we now have a truly unique window of opportunity to make some progress and the question before us is how do we maximize our potential to take advantage of this? The real beauty of my proposal is that we could leverage the enormous dedication of the core team and multiply it several fold, if we could build a strong donor base that provides us the funding required to engage effective lobbyists. Needless to say the more the funding, the stronger can be our lobbying.

It is a paradox that an organization founded on the net and is still subjecting itself to the constraints of "physical communication" via the local chapters. I thought they were taking a step in right direction with the creation of the "Donor Forum", however, for some reason, we still seem stuck in the previous mode of operation. We can find a middle ground here that would not compromise confidentiality or our goals - one alternative (certainly not the only one I am sure) is quite simply, email updates compiled by one person (for consistency and uniform direction) that go out a distribution group, where the "donors" on the distribution list, have been vetted by the local chapter coordinators. I know this takes work, but if the Core is looking for a person to pull together a Conference Call to compile this update and send it out, I would be glad to volunteer my services.
Still I've some open issues. If you look at the poll, there isnt a single person who voted NO. We should expect to see a healthy mix of Yes,No and Dont Care. But the way the poll has been put and partly the wording, partly the current IV environment, people are sceptical of putting their real thoughts publicly. This excercise is futile if you have minimal 'NO's --- hope you are getting my point here. The only thing you might end up with is x number of YES and hope to translate the YES into more dollar value for IV and there will be some YES who are already contributing monetarily.
You are correct dilbert_cal - not a single person has explicity voted "No". In reality though, everyone who has viewed this thread (1563 views when I last checked - even if you assume each person has checked this thread at least 10 times, that's about 156 individuals out of whom only about 35 have voted so far!) and not bothered to vote is essentially voting "No"! However, again as you point out, I am not really looking for the "No"s since these people have clearly decided they don't want to part with their money at this stage (not ascribing any reasons or motives here - just stating the facts). Instead, my focus is on coalescing a group around those who voted "Yes" since they, like me, agree that they would contribute more if they received more regular updates of what is going on. Our organization just needs a little more "organization" (pun, intended :p) to make it more effective! Again, just reality but that is also the usual natural evolution of most organizations that start out as pure grassroots organizations.
I really do believe there are substantial number of folks out there who can be engaged more effectively in this process and I invite the Core Leadership team to put more thought in figuring out how to achieve this - I hope you take my suggestion constructively!

I think Wah Wah is confused by the differences between 'retrogression' and 'backlog'. Of course, you are right that the PDs are not likely to go much further back (I think USCIS took a conservative approach after July - note they are still issuing visas to those with non-current PDs but are using the bulletin to limit incoming new filings). However, if 20 million applied in July the coming backlogs would be horrendous, even though priority dates would not necessarily need to go back further.
However, in a sense, if the backlog is perpetual, and let's say the PD never really moves forward by more than, for example, one month, in the next 10 years (I'm picking extremes to make my point) then the effective retrogression at that point would be greater than say todays.

Oh, I trust the attorneys to file it correctly, I was just wondering if there was any way of finding out if it was received and processed correctly. With the H1B, 140, 485, etc. you get a receipt notice, but I wasn't sure if that was the case with the G28, probably not.
The thought of the remote possibility of any correspondence from the USCIS going to the old attorney (for whatever reason), and not making it to me/new attorney in time to respond to it, is a little unnerving.

Oh, I trust the attorneys to file it correctly, I was just wondering if there was any way of finding out if it was received and processed correctly. With the H1B, 140, 485, etc. you get a receipt notice, but I wasn't sure if that was the case with the G28, probably not.

Unfortunately not that I know of. I even talked the supervisors.
I will be in the same boat if I don't see my 9th year H1B extension before end of next month. NJ DMV must have some interim provision for individuals like us.

we shouldnot judge others without understanding circumstances. Even if he has intentionally comitted crime, he is going to answer to God for this sooner for later.
