I don't think the response is correct. Question 12 only applies to people with unreported taxable income. Question 9 is the more appropriate one. And as per this, all you need to file is the 'delinguent FBAR' along with explanation for late filing.
And IRS will NOT impose penalty for failure to file the FBARs.

I was working in India in a pretty good company but I was experiencing red tapism, nepotism and all the standard problems of a job culture of India. So why not to fight for it through a common plateform like this one !

Why is everyone so skeptical of this article? Although this one apparently does not help h1/eb issue, BUT, I believe everyone knows from deep in his/her heart that most of the article is true.
Everyone knows, nowsdays schools are producing graduate students according to funding rather than job opportunities. Majors like biology have this tendency most, and the job market for them is the worst. Majors like medicine/law effectively control the number of graduates to the number of job opportunities, and the job market for them is the best.
Everyone knows, postdocs are paid badly. Why? Because there is unlimited supply of H1/J1 for postdocs, so the employers/professors can hire for whatever price, and the cost for applying h1 is much lower than industry. Looking at industry, because of the H1 cap and min salary requirements (yes, although people call it "slave salary", it is still somehow decent, and J visa has no min salary limit, so bad for J postdocs...), the salary is not as severely as that in postdoc area.
Yes, if the salary condition for engineers are better, people surely will flock from law and financial to engineering. Actually, this IS what is happening in China, because engineers are paid better than lawyers/doctors/bank analysts, the best people go to engineering schools. Majors like financial analysis are for people who can't survive elsewhere. So, the shortage is because of the low pay, not because americans can't do engineering. Hey, don't you see, most of the American scientific/engineering feats, like Apollo, are done by americans, not H1 workers, right??
That is looking at the problem with tunnel vision.
No one said Americans are not smart. It is just that many are not choosing science and math and hence the shortage. You can't link the un-employment in bio-sciences post docs with other areas. That is short sighted STUPID. There is a legitimate scarcity in some areas. Just remember some IT consultants used to make 250 to 300 an hour (to the individual) not long ago.
There are H1 workers and there are H1 workers. I know quite a few H1s that make more than their American counterparts.
It may be true that some of them may be taken advantage of, but the solution is to fix what is broken (H1 and GC program so the beneficiary has flexibility).
So what is the solution that Mr Wadhwa proposes ?
Pay a VB programmer as much as you would pay to an investment banker so that Americans go to VB programming rather than becoming investment banker? Where did he get his degree ?

Thanks to IV, for the initiatives it took to get the number of pending I-485 cases by category / country through FOIA. This could also be one of the reasons, the data is now available in USCIS website for all. The data in USCIS website is as of 8/25/2009, Not sure, how current the data IV obtained is. Regardless the difference is so large in the data obtained, it make everyone ask more questions than find answers. Given that, some of spill over visas being utilized in Sept '09, the next update, not sure when it will be posted, might show a better picture to one or two categories / groups of people like EB2-India, which now consumes more visa than any other category for now due the change in interpretation of the rule, that governs the excess / spillover visa allocation. USCIS does obtains these statistics each month, to co-ordinate with DOS to get the VB published, Hope they make the data available, more frequently to all.

Guys got a question: Copy of status paperwork:
I was an F1 student from 97-99 and then H1 from 99-01.
I left the US for 2 yrs from 01-03 and came back in 03 with a new H1. Passport was renewed outside US in 03 and new visa attached to new passport.
I have the I-20 and old H1B approval and old passport/visa but not I94.
- Do I have to provide proof of status of my stay from 97-99/99-01 too? In that case I do not have old I94. I thought this was for the last 5 years only.
Also I read the form instructions and it mentions that checks are to be payable to: U.S. Department of Homeland Security

I posted this on another thread. It also has some suggestions for increasing the popularity of Immigration Voice.
BusinessWeek has published a lot of articles recently and tried to increase awareness about the struggles of the skilled immigrant community. With the publicity that Immigration Voice has received of late, anti-immigrant forces and curious people are going to visit this site more often.
I've joined this group for over a month and have a few suggestions to make to those who are prepared to listen. I personally think that there is too much noise on the forums. Some forums should be reserved exclusively to dispense useful and reliable information about GC/Visa processing issues.
Also, there have been too many instances of in-fighting and divisiveness among members along the lines of North India/South India, Hindi/Non-Hindi, Indians/Non-Indians, IITians/Non-IITians, etc. This paints a really nasty picture to those who are curious to learn more about this organization.
I think people need to stop treating this portal as a place to hang out 24/7. I've been guilty of it as well and hope to remedy the situation. It dispels the notion
that we are hard-working immigrants. There are other social networking groups like orkut and myspace that can be used for this purpose.
With the increased scrutiny that these news articles will bring, we need to put on our best behavior and project an image of unity, strength and intelligence in order to gain the respect of others who want to learn more about this organization.
We have a difficult path ahead of us after the dust of the AOS filing has settled (who knows how long that will take?). Long-term relief is only possible through legislation and this will be very hard to achieve due to the impending presidential elections and the politically charged climate in the wake of the CIR.
One of the suggestions that I have is to release videos of individual stories of our members who have been affected by the backlog, on youtube. We should talk about our journey - landing in the US as students/fresh grads to where we are now - what kind of technical work we do - what we like about the US - funny stories about culture differences - how we assimilated into this society - our ambitions and the barriers to achieving them.
We also need to request our American co-workers/managers/friends to speak up for us and increase awareness among other Americans who are being influenced by the rabble-rousing speeches by the likes of Lou Dobbs. The American people need to see that there is popular support for us from not only the leaders of the business community (who are perceived as greedy traitors by the American middle class) but also people who work with us and have studied with us - the people whose lives we are supposedly destroying.

Bachelors (3 years): Bachelor of Engineering in Mechanical engineering (BE)
Work Experience: 8 years.
Please help me out in deciding whether to file as EB2 or EB3 and what are the chances of approval, if job decsription on Labor says "Bachelor�s degree in an Engineering field or Computer Science field combined with 5 years progressive experience in the occupation will also be acceptable. Foreign equivalent degrees are acceptable."
My lawyer says:
