I agree. In my assessment efforts coming for the Employment Base applicants like us has minimal weight, if any. I would say that 98% of all lobbying effort and serious push for skilled immigration related bills come from the H1B sponsors, and that's what employers care about.
That said, I think it is not realistic expect that we ever see a bill separated from the H1B increases. There is simply no business case for it !
We have to accept the reality that H1B and EB Green Card are two side of one coin and cannot be separated. As such Business community is benefited by H1B only, eventhough they are pushing H1B/EB together. Business lobby is much much more powerful than 400K EB applicant. Why lawmakers will hear a very small community like us? Only business community can make pressure to lawmakers to prioritize H1B/EB issue through SKIL.
I strongly believe that the recent push by business community (200 + 900 industry, hospital, and University), Aila, and IV will make some results in coming weeks.
Deviding interests will kill the positive current push. If we are not convince for increasing H1B, How come we expect 300 million American should convince for increasing Green Card quota !!

Can anybody confirm the following
1. If 325 is required for 485 filing for infant baby ( parents already haved filed 485)
2. Is Affidavit of support needed for the baby? If so is it I-134 or 864?
3. Ours is employment based AOS so assuming baby will also qualify for same? or will it come under Family based?

1. 325 is not required for people below 14 and above 79 ( so 14-79 its required all other are exempted)

My approved I-140 is getting revoked becaude USCIS is saying they didn't verify ability to pay 2.5 yrs back and asked for more docs.
Neednot to say, I switched employers 2 yrs back and switched to EAD thinking everything should be safe.
This is the second time this year that my I-140 is being revoked. In feb,07 my i-140 and 485 was revoked because USCIS ignored AC21 and never asked me anything about AC21. I filed MTR and got it reopened in May.
In nov this another mess.
My case is at Vermont and it appears either the officer is retaliating or is ignorant.
I know this is unprecedented but i am broked down and fed up of fighting them. It has been a never ending journey for my family.
I have submitted all my the documents and don't know whats going to happen.
Any advice from the community will be helpful as I don't know what to do.
Another thing, i used VP office for clearing namecheck which was done on Nov2 and this I-140 revoked on Nov 8.
I am on my 3rd EAD.

You are correct !!! You need to report at any point in the year, if you had more than 10K in any foreign bank account, you must report / attach the additional form along with Tax filing.
Reporting the interest is another think and some banks (Citibank) does issue a 1099-INT for the NRE account interest earned.
What is the rationale for this reporting.
Do you report that you have 500K in your US account? or do you report that you got $X as interest from your bank deposits here in the US. If that is the case with US accounts, why would you be required to report whatever amount you have in other foreign accounts??
You have to remember that as and when you "wire" money out of the US the IRS already is informed. Now this money that you transfered was generated within the US and you have paid all taxes that are due here. Why then would you simply report that you have "saved" this much money here or anywhere. There is absolutely no logic for reporting the actual principle amount (deposit) unless it is generated outside the US.
Let us say you are a US citizen/resident and you earn money in India and maintain a FD there. Then it makes sense in reporting your "income" in India.
Simply reporting the money that you initially transfered from the US to another account is just the same as reporting your account total in citizens bank in Alaska after you transfered funds from BOA in Texas to it. Its basically the same money but held in a different insitution.

Guys,
few days back I received a letter from UH clearlake stating that "Unfortunately, you do not qualify for an MS in Computer Science, because you only have 3 1/2 years of credit instead of 4 years."
I have an engineering diploma 3 years (I did it after 12th) and Post diploma in computer Application (18 months) . In addition I did BCom from osmania university (Corrospondance - done in 1 year - but equivaent to 3 years BCom and recognize by Govt. of india ). I was under the impression that this education would be sufficient to get me the admission for MS. But I was wrong.
The university is not giving me any pre-requisites or anything , they are asking me to do BS instead of MS. Do you guys know of any university offering online MS which will accept my education ? Or anybody here had a similar problem ? Rock, Did you find out anything about universities which accept BCOM, would you mind sharing it?

I used my AP twice in the last 4 months. Once at Long Beach Port on 12/21/08, and once at SFO on 3/27/09. Both times I went into secondary inspection and took about 20-30 minutes mostly because of others waiting before me.
The officers were nice to me, they ask standard questions like location of my work, what I worked on and how long I was outside the country. I felt that if you have been here legally, have all your papers right it should be no problem.
I have heard of people being denied entry, i think they are rumors. Most DHS officers are polite and after seeing some of the crooks who end up in secondary inspection I can see why they can loose their calm.
