USCIS advices 7-10 days for a case to be adjudicated but it depends...
Does anyone know how long before the adjudicator takes a final decision? My wife's EAD case, after it was denied because of a USCIS error, is presently being reviewed by an adjudicator. So we were informed yesterday by Ombudsman's office. She has a job offer letter from a company where she has been asked to join on Monday.
Any insights will be greatly appreciated.

For me this is what I see democrats telling GOP.
You dare touch undocumented guys in any way we are going to screw high skilled immigrants.
Ok you want stricter border control ? We cannot say we are not acting on it in this election year. Here is what we are going to do. Will increase the H1B fee, that way we "fund" the initiative as conservatives want. In turn we will screw high skilled immigration so that our union guys will be happy.
What we don't care is more jobs being outsourced which will never return back to USA.

All- I am not a witness (like some of the other IV members like waldenpond) to the intense activity happening on the Hill and me speaking from 2600 miles away from there would make little sense but must I say that the strategy of the respsective parties on the hill changes every minute. At one time, you get the feel that your provision is in a bill or an amendment and the opposite party takes some steps to add their own agenda and the very next hour the whole scope of the effort for the party tabling the bill changes. IV has been very forthcoming in keeping the members tuned in with the progerss but please understand that this is a very very fluid situation which not in control of even the majority party on the floor. It might happen that our hopes get raised and then we see things slipping away.
Not sharing any information on amendments/bills till it is made available to public domain makes us all restless but at the same time , giving indicatication of what might be coming down the line while not being sure if it will materialize raises false hopes leading to disapponitment. There is no right or wrong apprach here but all this tells us of the situation we are facing on this day.

Those who know/have friends in Iowa, please urge your friends to call Rep. King. We need to mobilize Iowans to call Rep King for him to get an idea how many Iowans are affected by this. Des Moines comes in the 3rd district and even though it is not Rep. King's (5th) district, we should try get reach our friends in the Insurance Capital of the country. I have already passed this on to my friends in Des Moines. There are thousands of tech workers working there. Please send it to whoever you know there and urge them to call.

You do have to realize that this clause is only for people who have Advanced Degree in STEM and Worked for 3 years in the US in a related field before applying for GC. So if you have a Chemical Engineering Masters and work in Software that is not good. Similarly if you were working for only 2 years and 11 months before your labor was filed, then again it is no good. So I don't think that this clause will take that many people out of the queue.

Do you think the 3 years of relevant experience is required prior to your labor certification filing or prior to your adjustment of status (I-485) application filing?

As far as I understand it, it is a credit for your 2008 tax which is already paid in 2008
and not in 2009. But different from exemptions on a W-4, you don't have to return
this credit if you don't qualify next year. It is a real tax credit. In 2001 there
was not a credit but a change in the tax system and you could get an advance
rebate.
It's a free lunch if you measure it in Dollars you receive. In reality it is just
newly "printed" money. So the dollar will have less value (inflation) and a person
who doesn't get the "rebate" is cheated. The economy will collapse anyhow.
I am not sure if you are 100% correct or not. The language of the bill uses similar text to 2001 (as said on other websites) and the key word is advance refunds. Here is the relevant text if any one has some time to chew on. read the text in size 4. It tells me that it is going back to uncle sam. A double whammy if you owe taxes next year.
(f) Coordination With Advance Refunds of Credit-
`(1) IN GENERAL- The amount of credit which would (but for this paragraph) be allowable under this section shall be reduced (but not below zero) by the aggregate refunds and credits made or allowed to the taxpayer under subsection (g). Any failure to so reduce the credit shall be treated as arising out of a mathematical or clerical error and assessed according to section 6213(b)(1).
`(2) JOINT RETURNS- In the case of a refund or credit made or allowed under subsection (g) with respect to a joint return, half of such refund or credit shall be treated as having been made or allowed to each individual filing such return.
`(g) Advance Refunds and Credits-
`(1) IN GENERAL- Each individual who was an eligible individual for such individual's first taxable year beginning in 2007 shall be treated as having made a payment against the tax imposed by chapter 1 for such first taxable year in an amount equal to the advance refund amount for such taxable year.
`(2) ADVANCE REFUND AMOUNT- For purposes of paragraph (1), the advance refund amount is the amount that would have been allowed as a credit under this section for such first taxable year if this section (other than subsection (f) and this subsection) had applied to such taxable year.

- If you have not contacted yet, please contact your local lawmaker offices. If they are not in the co-sponsor list, go and meet them in person. Ask them to co-sponsor the 3 bills that are pending. If you want to write to them, you may do so too. But do not write annonymously.
- If you are from Texas, 21st District. Contact Congressman Lamar Smith. Check the campaign about this from IV homepage.
- Join your state chapters. Find out their action items and grow your chapter.
- Contribute to IV if you have not till now so that we can continue our effort.
If we need to do an admin fix campaign again, we have to first come up with a list of things we want. Then see if this is possible in current law. Get legal advice from a law expert. Prepare a document with why and how for administration. And then write letters. If people are interested in that, they can form team to research this and come up with a researched document and why how details. Once we have that, we can write to DOS/USCIS or President etc.
