Hi in case of emergency also one can go to nearest USCIS center and request for AP. I consider this as an emergency also. Request for an urgent AP and they can generate one in less than a week. I think then all of you can go and get wedding cert from India.

I still think...that by being here you can do the following:

    1. See if your marriage was registered. If yes then you can get cert from ADM there. If not then tell the ADM office to write on official letter head that both of you got married but marriage was not registered.
    2. Also in that case get affidavits from your parents and her parents mentioning the date, day, place of marriage. These will be 4 affidavits. They also should mention that they did not register the marriage at that time.
    3. See if you have photos. Get them scanned and take a colored print and get it notarized from magistrate there in India or here.

send all of these to USCIS and you should be done man. I dont think you need to go to India. But again check with lawyer also.

    Best Regards,

After listening to both the shows, this week as well as last week, I am wondering if it was worth the effort for IV to participate in Debo Kotun's show. Here is my personal comments about the participants and the shows.

Debo Kutan: He did a pathetic job in moderating the shows. He not only spent about 25 minutes talking about his future shows(prior to beginning of today's show), but also repeating the same information from last week and pretty much asking the same questions. He was more interested in talking about his immigration decades ago and how he got his GC in one day, blah blah blah...Also, he mentioned that he was going to get Sen Kennedy & Sen Brownback to participate in today's show..but that was probably some publicity talk to draw more listener's to his show.He repeatedly questioned us to go back to our countries and solve our own problems and as well as theirs rather than trying to understand the root cause of the current situation. He turned out to be very ignorant of the immigration woes and did not seem like he had done any research prior to conducting his shows.

Swadha: She did a good job of explaining her situation and the difficulties she was facing due to the retrogression despite her excellent credentials and qualifications. Thanks to Swadha for her efforts in explaining her current situation due to retrogression.

Carl Shusterman: As popular, qualified and expert he is in the field of immigration, he just turned out to be very ignorant of the ground reality. I was as surprised as Swadha, when he mentioned that people with advanced degrees can get their GC's in a year. Despite having 2 advanced degree's I am still waiting for more than 3 years to be able to apply for I-485. The people most affected by this retrogression are citizens of India and China, not someone from Monaco or Namibia. He was more interested in promoting his Immigration firm and his website. Wish he had been more vocal in explaining the broken immigration system, rather than gaining some publicity for his firm.

Stuart Anderson: He did an excellent job explaining his research studies and how the current immigration laws are affecting the economy and its long term impact, if the immigration system is not rectified soon. Thanks to Stuart for his expert comments and explaining our situation in a wonderful manner.

Rajeev Khanna: He did a good job in the last weeks show, explaining our situation and the broken immigration system. Unfortunately, due to Mr. Kutan's terrible job of moderating, he did not provide much opportunity for Rajeev to speak this week. Thanks to Rajeev for fighting for our cause.

Aman Kapoor: He did a commendable job last week, explaining about IV and its efforts. But due to lack of Mr. Kutans moderating skills, he did not get much time to talk today. Thanks to Aman for organizing and providing an opportunity for IV to discuss about the legal angle of immigration reforms and the difficulties faced by people like us.

Jay Pradhan: Due to technical difficulties, Mr. Kutan could not include him in last week's program, but he did provide him an opportunity this week and explain his case. Jay did an excellent work explaining his situation, current backlogs and also answering some of Mr. Kutan's questions in a very logical manner, like the way only he can do. I wish Mr. Kutan had given more opportunity for Jay to talk and explain the broken immigration system. Excellent job Jay. Hope you get more opportunities like these to discuss about our situation and shed more light to the general public.

Overall, it was some decent publicity for the problems faced by legal immigrant community, though I wonder if it was worth the efforts due to the pathetic job of Mr. Debo Kutan. Hope we can get to participate on more knowledgable/popular talk shows and showcase our problems.

The cynic in me believes that everyone thinks it is just a matter of time before it becomes current or there is significant movements in dates. This is dead wrong.

Very true. I was talking with a guy last week end and he is very much elder to me. During our conversation he told me that he is waiting for his PD to become current and my minds were blown away when he said "Presidential elections are coming up and people will get GC's" . He summed it up as Politicians doing favors during election period (like in India). O M G!

Consulare processing means, you have to go out of the country to your home country and over there you have an interview for an immigrant visa. If approved you come to the states with that visa and receive GC here. If denied, consular processing CANNOT be appealed. The decision is usually final. When you do I485, whcih is adjustment of status, you stay in the US and if gets denied you CAN appeal the decision. To be eligible for adjustment of status in the U.S. one must show he/she never violated non-immigrant status until the I485 was filed(since last entry).

If you file I140 while being on F1, that could be taken as "violation of non-immigrant" status. It is advisable to change to a dual intent visa before filing for I485. Such visas are H1 and L1.

I am not attorney so don't take my answers for granted.

I have been owning for 7 years now. I bought the first one in 2000 and sold it in 2005 - though most of 2001 and 2002 were in recession, I still made 200% of what I invested. But do not see house as an investment. For me i want a place when I retire. If it appreciates its good.

I have my mortgage with penfed.org. They have the best rate available. They are slow though - do not expect them to close within 30 days.

    Good luck.

Sorry guys ..posting in the wrong forumn so that maximum IV members can be aware of the development...

Another Indo-US deal moves forward: Indian workers can get Social Security money back
    Vikas Dhoot
Posted online: Tuesday, July 08, 2008 at 0037 hrs IST
    New Delhi, July 7
With Prime Minister Manmohan Singhs government finally moving forward on the Indo-US nuclear deal, the Bush administration is also demonstrating its keenness to resolve other crucial bilateral issues in Indias interest. A long-standing Indian demand for a social security pact that allows Indian workers stationed in the US to bring back their contributions to the US Social Security system on their return to India, is close to being met.
Over $1 billion of contributions to the US Social Security Fund are made annually by an estimated 80,000 detached workers from India working on consultancy and onsite assignments each one has to contribute at the rate of 15% of basic salary. However, when they return to India, these contributions are forfeited as the minimum period to qualify for pension benefits in the US is 10 years (the same is true of India as well).
After a series of meetings between Indian officials and the US Social Security Administration as well as a senior White House official in Washington last week, Indian workers annual donations to the US social security fund which currently has a $4.1 trillion deficit may finally come to an end.
We are close to sealing the pact. Indian workers who spend three years in the US would get a refund of their contributions to the US pension system. Moreover, the pension will also be portable once a worker completes the qualifying period of 10 years, the pension will be payable in either country, a senior government official said.
The US has such social security totalisation pacts with 22 countries, whereby workers who spend three years in the US hold on to their pension benefits as the 10-year qualifying period takes into account the time spent by workers in their original countrys pension system. India has recently signed such deals with Belgium and Germany.
If both US and India have bilaterals with a third country, the totalisation and portability principles will apply in those cases as well. So a worker could spend 4 years in India, 3 years in US and 3 years elsewhere, without losing retirement funds, the official added. Bilateral talks on the issue had intensified after Singh and Bush issued the joint statement on July 18, 2005 to move towards a new strategic relationship. Last December, the US Social Security Secretary visited New Delhi, but little progress was made. Under Section 233 of US social security laws, international agreements may only be arrived at with countries with a generally applicable social insurance or pension system.
Between December 2007 and now, India has made some progress on this front which it convinced the US administration about. The Unorganised Sector Workers Social Security Bill has been introduced in Parliament as well as reviewed by a standing committee. The Rashtriya Swasthya Bima Yojana has also been kicked off.
It has been an intractable wall we have been chipping away at for years, but this time, we feel they are convinced that there is a sound social security sytem in India, the official said. If India succeeds in formalizing the pact, it will be only the second Asian country after South Korea to do so. Once signed, the US President will have to report the deal to the Congress with a report on the estimated number of individuals affected and its effect on the Social Security funds flows.

I started the US immigration in 2006, PD-September 2006, by CP, EB3ROW. DS230 renewed 3 times since then... a couple of months ago I applied to Canadian PR, now I am waiting for my interview date. So I have two processes parallel - US GC & Canadian PR. My question is : How these two immigrations can jeopardise each other?
Logicaly I will attend the Canadian interview first, will they ask me about US immigration? should I tell the truth? Will they deny the PR because of the GC process?
Presume that I have successfuly done with canadians and have landed in Canada with my PR in 8-10 months from now, and suddenly, I,ve got an invitation to the GC interview... Does the fact that I have a Can. PR will kill my future GC and at the interview the will deny and cancell my case? Or The interview will be successful and I will have my GC, but somewere in the future there is a point where I should refuse one - GC or PR?
I should mention that the GC is the choise No1 , and PR is a plan "B"...
I believe that my situation is not unique, but now I am out side the US and in my country it is difficult to find a competent lawer. So I hope that somebody from this forum could answer my questions.
Appreciate all useful answers and ancillary information. :):)

    Hi Guys,

Could any of you let me know the impact of multiple job changes on AC21, with approved I-140 and after 180 days of I-485 receipt, and with similar job code and description. I changed first on January 25 and now it will be 3 months after the first change. I have following concerns and seek your opinions soon for the decision.

1- Will this quick change be a concern even though I will have same/similar job code as per O*NET and job description and there is no law against it?

2- Should I have, in addition to H1B transfer, another Labor certification started with new employer as a back up?

    Thanks guys in advance!

    Greetings all!
Being new to both digital photography with a DSLR and these forums it sure would be of value to have someone post their examples of their back focus issues as well as an explanation as to what it is. I'm strongly considering the Nikon D70 and would appreciate any feedback and examples of the photos people have taken with the D70.
    Thanks,

    Dain

Thanks for contacting IV with your SOS.
An IV core member is going to be helping you to fix this with USCIS. Let us know if you need help. He already tried contacting you yesterday.

As IV grows maybe this is a help IV can extend to all its donor members and help them if they get in such extreme distress situations. This is one of the ideas we are thinking for our members in the donor group.

Very good work by IV. I commend this effort in helping the people who are in such situations and hopefully this will lead to more people joining and willing to donate for the issues that affect us as a community

    - cheers
    kris
