They obtained authorization to file the lawsuit. They had it prepared to file and received good response from possible plaintiffs. It was possibility of good strong case by AILA that deterred USCIS to reverse the decision without a formal lawsuit. This is exactly what we need to further our cause. USCIS could care less about other petty tricks. They will only understand language of laws/court. For that we need congress to pass laws favoring us.
Our decision to send flowers was initiated around 2-3 July and the first of flowers were booked to be sent the same day.

We could take the suggestions of other IV members, may be sending a letter is not a bad idea with some extra postage stamps to help out the USPS since they also reduced some of their services due to funding issues. How about sending few $$ donations to the military fund any public fund to be used to spending.
We need to consolidate all these threads in to a single one and start working on it and quickly.

This is not new, I was advised the same by my attorneys. I have heard "internet rumors" of people successfully filing EB-2 for job descriptions such as senior software engineer and senior systems analyst, which are normally classified as job zone 4. However, I was advised by two different law firms that this is not possible. According to both attorneys I consulted, you must get a job zone 5 classification to file EB-2. Obviously i was wanting to know what the law states...and not a democratic answer. I dont always expect forums to quote the law correctly - use your judgement!
Thanks anyway for that answer. My situation is different beacuse with the I-140 PP going away for now...and my H1B expiring Feb 2008...I am left with approved I-140,Labor and retrogressed dates to be eligible for 3yr extension.
Now that if 140 is pending ...then I am left with EAD as the only option to continue manitaing my status.
Correct my intrepretation of law if wrong..

If we can manage to send at least 500-700 flowers to USCIS, that will create the kind of attention we want and it will bring the issue of retrogression again on the forefront in Washington DC.

I got a FP notice for next month. It is certainly not related to AP or EAD renewal, since I don't have any pending AP or EAD renewal. I got my EAD renewed last March and AP in May. So hoping that I got the FP notice since they started looking at my 485 application and something positive will be end result.

It DOES matter what your PD is. USCIS apparently does process FIFO according to your Receipt date - BUT ONLY IF YOUR PRIORITY DATE IS CURRENT will you get a visa number assigned (i.e. approval of said greencard).
From my understanding, this is correct but if you look at , http://www..com/usa-immigration-trackers/i485-tracker1/ USCIS is approving applications everyday. I am confused because according to the August visa bulletin, all categories are "unavailable" therefore, we shouldn't be seeing any approvals. Please enlighten me on this.

The pro immigration group wants these benefits given to illegals, Anti (any) immigration groups wants no immigration to begin with and want to curtail the current immigration options (H1B and GC for legals etc.) , therefore the compromise is that the pro illegal immigration group lets them cut the current LEGAL immigration channels and anti immigrants let the illegals get all these privileges.

I was debating the fact that we need to ask India government to device some sort of parity between Capital acceptance from U.S. firms. It takes us, who respresent Intellectual capital, 5 to 6 years to get some kind of permanent residency in U.S. and that too in a grudging manner. Why do U.S. MNCs demand immediate clearence of their projects and complain about delay etc. If you look at comparative delays, Indian system is still light years ahead of so called efficient American system. Its just that we need to look at things from a correct perspective. Monetary capital needs to be treated at par with Intellectual capital. Just a thought.

I agree, if you are past 180 days since you applied for 485 and if your 140 is approved, it shouldn't matter if your ex employer withdraws 140 now, though I doubt he would.
This is another example of a bad desi employer trying to screw an employee. these stories make me puke. the employer did not have a problem when you found a project, when you negotiated rates and when you worked with the same client for 3 years and now all of a sudden he is holding you accountable. totally unprofessional . sic.

This Tracker facility we have in IV is good. Kudos to the Admin team who implemented this thing.
These are my observations. I could be grossly mistaken. Pardon me if I am wrong.
There are approximately 26,000 people who have put in their priority dates and other such data in the tracker. When I compared similar cases, I got some 265 who were EB3 India with a priority date in 2002. That is approximately 1 %, give or take.
Here I have ignored EB3 India 2001 guys. But that number would be very less I believe.
1% of 400k is 4000 which is what USCIS issues GC for EB3 India in a year.
Does that mean I could get my GC this year.
Hope these numbers are right.
