The Republican Revolution that took Capitol Hill by storm 12 years ago—giving business unprecedented access to the corridors of power—suffered a stunning reversal on Nov. 7, amid an unpopular war, congressional scandals, and widespread unease about the state of the economy, despite generally positive economic numbers.
After a tumultuous political year filled with bitter personal attacks, Democrats accomplished what pundits said was all but impossible in January: They took back the House of Representatives, and with surprising ease. As of midnight EST, Democrats had taken 33 seats from the GOP—far more than the 15 seats they needed to take control of the House—with another 16 seats still in play. As of midnight, Republicans still were clinging to control of the Senate. Needing six GOP seats to retake the upper chamber, Democrats were leading in five races, with the Virginia race between Republican George Allen and Democrat Jim Webb too close to call.
Despite President Bush's insistence that the American economy was strong, and getting stronger, 52% of voters said the economy was weak, while just 47% said that the U.S. is in the midst of good economic times, NBC exit polls found. And voters who said the economy was the most important issue to them favored Democrats by 20 percentage points, according to CNN exit polls.

But many voters, recalling George W. Bush's similar pledge in 2000, are likely to wait for concrete action and not just Election Night promises.
Among the Democratic winners were a host of probusiness moderates, including Representatives-elect Brad Ellsworth of Indiana, a tough-talking sheriff; Heath Shuler of North Carolina, a businessman and former pro football player; Baron Hill of Indiana, a former moderate congressman who made a successful comeback; and Gabrielle Giffords of Arizona, a business executive with strong corporate support.

Democrats also have pledged to rein in the federal deficit and adopt a pay-as-you-go budgeting system, both goals of company reps. And companies are looking forward to Democrats keeping their promise to restore the R&D tax credit, which expired this year amid partisan gridlock on Capitol Hill.

But some business sectors—particularly energy, defense, pharmaceuticals, and insurance—are bracing for tough hearings by new committee chairmen. And small business seems destined to face the first increase in the federal minimum wage in nine years. On the tax front, small business groups now are unlikely to get their top priority: a permanent end to the estate tax. Dude I think you are thinking too much of it. USCIS is an organization that goes by a process. If they have a pending application, they have to process it. they decided in the summer of 2007 that they will hire additional contractors and process all the pending applications so that they reach their goal of 4 months processing times of 485.
Why will they waste their resources on your $325 dollars again dude? Is the amount that high that they will reopen the case at the time of finally alloting a visa number, and spend the money/resources on reviewing the case again?
Whatever be the PD, USCIS is all set for a month processing time of 485 by Sept 2009. All cases filed before Jun of this year should have been either pre-adjudicated or denied by that date.

Great Chance! I am not sure how much of time we will be given. I agree that communication skills are of tantamount importance to the substance that we plan on putting forth. How about folks who have done our presentation earlier? We need statistics/numbers and our presentation material bears that or, we could garner more. I do not believe in short-changing any of the objectives. Priority may change but all provisions are core. As a case study then, we let an individual to present himself. That way the whole presentation is broad-based and goes as planned.
Also, please factor in that this could well turn out to be an interactive session later. (Some may be out to shoot us ;) )With the amount of superlative material already flowing across the forum and the drive within us, we are definitely upto it! Please plan on carrying a slide that lists prominent immigrants who are success stories (Kalpana Chawla !).
Is there a way we could get to see how many of us folks hold an Advanced degree? Any IITians around for the show? Let's conference around and get to the nitty-gritty details, dress code, way of formal addressing, hand-outs et al., and run the rehearsal (s) by QGA.

Thought I'd offer an alternate view on the AC21 letters. I switched jobs after my I-485 had been pending 180 days, and my attorneys advised me to NOT send in an AC21 letter. They said, "Chances are, you will not get an RFE, and if you do, you can send in the AC21 letter at that time. If you do send in an AC21 letter, you will definitely get an RFE". These attorneys had always given me excellent advice in the past, so I have not submitted an AC21 letter.

Well, last year i was in a similar situation too ,actually worse than yours.My project ended in February '08.Then i went to India for 4 months. After i got back , my employer refused to pay for my health inssurance.I opted for COBRA and was paying 1200$ for my family , with my husband and child listed as dependants.I attended several interviews,while I was expecting my second child . Though its against the law, many were skeptical in employing me as a consultant during this time. I was very lucky to get a full time offer using my EAD, where my health coverage started after 60 days .All this time, without a project , i was paying through my nose for the health insurance using COBRA.
Ofcourse, i never bothered to inform my employer about my new employement.(Do i need to??)One fine day, i get an update on my H1 application , that the case has been reopened for review , and i get to know through my employer that he has CANCELLED my H1(got a 3 year extension based an approved I140).He did not give me chance to transfer it, inspite of me working rather slogging for 4 years , during which he shamelessly took the overtime money i earned as part of the billing.Though, i feel cheated,used etc etc.... but i did nothing. What could i have done?
All through my journey in this GC process, i have had bitter experiences with desi employers.Though i've been in this country for 10 long years, i am still sitting waiting for my GC with the PD of Dec '05!! The previous employer, said he was filing my GC under EB2 but actually used EB3. And he also was willing to 'sell me my labor' for 12k!!!!! when i requested for retaining the PD. I coulddo nothing..
I am not writing all this to vent my anger but to make you think that there could be other worse things happening to us.
Also can somebody educate me on the 'stimulus' ,please?(pardon my ignorance)

i am not sure why you think kavya wont excel in her life - she already has a great headstart with close to 40grand in winnings! i also dont know why you think she will end up working for a non-ivy league educated manager - & even then why its a bad thing to win a spelling bee..too many gaps or leaps in thoughts/logic?!
If you come across and experience families who make their kids to go through the labor (hell) then and then only you would understand what he is trying to say. The other way of experiencing is to watch the pattern and construct of these spelling bees carefully and apply your own thinking process. Once you do this you would almost agree what logiclife was trying to throw to us.Spelling Bee competition, though make a child well aware about the roots of the words (latin, Greek roots) and provide enough exposure to the kid to understand the English language in its essence, it does not teach a kid how to think, how to become creative and innovative.
Of course nobody can generalize that particular winninng kid will/may/won't/may not do good in life but more or less these are not the competitions through which parents with reasoning or thinking ability would let their children go. Yes there are some advantages but if you try to enlist then list of disadvantages would become lengthier..

Now out of that bunch many people prefer to go for permanent residency as permanent residency bring little bit stability in living and flexibility in employment and international travel. If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense.There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. And I do not know about other countries but in India it is not considered "illegal" and/or "unpatriotic" to go in other country(Except Pakistan and Bangladesh) for legal work so coming to USA for legal work whether on work visa or becoming a permanent resident in USA while maintaining Indian citizenship simultaneously is not unpatriotic or illegal. Simultaneously USA's legal system allows an Indian to remain as citizen of India while residing in USA permanently for legal work.
Now if somebody decides to become a US citizen, there is nothing wrong in that. I do not see anything wrong when rsharma states that "I have decided to become US citizen in future". But if he is mature and human enough then his fidelity at this moment should be towards India (Assuming he is a citizen of India currently) as he is a citizen of India at this moment. Showing this kind of behaviour perhaps may not be a outright unpatriotic in terms of "Indianness" but it certanily signals probable but strong disloyality towards India.
And I do not think that USA citizens are that naive that they consider the people "not mingled" if citizen of other country do not call USA president a "My president" while holding the citizenship of other country.
If calling US president a "My President" by non citizens would be the barometer of "mixing" / "mingling" then USA would not be today's USA. So please do not kid USA and us .

One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. And I do not know about other countries but in India it is not considered "illegal" and/or "unpatriotic" to go in other country(Except Pakistan and Bangladesh) for legal work so coming to USA for legal work whether on work visa or becoming a permanent resident in USA while maintaining Indian citizenship simultaneously is not unpatriotic or illegal. Simultaneously USA's legal system allows an Indian to remain as citizen of India while residing in USA permanently for legal work.
Now if somebody decides to become a US citizen, there is nothing wrong in that. I do not see anything wrong when rsharma states that "I have decided to become US citizen in future". But if he is mature and human enough then his fidelity at this moment should be towards India (Assuming he is a citizen of India currently) as he is a citizen of India at this moment. Showing this kind of behaviour perhaps may not be a outright unpatriotic in terms of "Indianness" but it certanily signals probable but strong disloyality towards India.
And I do not think that USA citizens are that naive that they consider the people "not mingled" if citizen of other country do not call USA president a "My president" while holding the citizenship of other country.
If calling US president a "My President" by non citizens would be the barometer of "mixing" / "mingling" then USA would not be today's USA. So please do not kid USA and us .

If your heart truly goes for "bharat maa" than why are you wasting your precious life serving American Corporations? your "bharat maa" is still 3rd world country and rift with many challanges that you could have worked upon to elivate it from. But you preffred to apply for GC and no where is it written that your getting GC would make "bharat maa" proud or rid her off her miseries.

Thirdly, if possible, let someone else (such as your husband) drive the "discrimination" lawsuit if you think it is fit...helps give you some line of defense against the problem.
Regarding insurance, the employer must offer you COBRA. Also, not all insurance companies consider (or are allowed to consider) pregnancy as a pre-existing condition.

So here come the thing. Thats why i asked in my original post is IV just for people who have applied for Green card ? I wanted to know if they could address these issues as well . Regarding inability to work and self esteem , just stay in home for few days and then feel how much you loose. Man , its 21st century and ability to work is basic right.
First of all, IV is a grass roots org. I guess I dont need to tell what grass roots is. That means every one has to be a foot soldier in an effort. I understand that your problem is not the same as majority of the members here have. Thanks to IV on the VB fiasco. IV is not a share holder company that will give you results every Q. If you want accountability, you can find how the money is being spent. I guess some one posted it here very recently. Its publicly available on the net.

I guess they think every one else does the work than themselves) to push for H4's ability to work.
Oh wait a sec! While I have no issues with it, there will be a severe backlash on adding new workers. Again this is not my view. what you will get to hear if you go on the hill. Such provisions can be pushed when the economy is better and on a bigger vehicle such as CIR. In these times, just try not to get hit by Grassley & Durbin who will impose restrictions on the SC company you are working for. Imagine that!

It results in a loss of self esteem when you have the opportunity to work, but you become a couch potato eating cheese curls and watching who wants to be a millionaire. You are encumbered by a stupid visa rule but not physically/legally encumbered to break out of it.
Obviously there are other things that are balancing or overpowering your spouse's inability to work, other wise you would be in Singapore or Canada or UKor where ever spouses are allowed to work.

I have been through this once. My company(a big one) lawyer said my position does not qualify for EB2. His main concern was salary was not enough. I got promoted to "Senior Software Engineer" and got into the required salary range. My labor and 140 were cleared. So my in my opinion salary range is also significant.
