Googler,
How is this possible, EB3 ROW also has a limit to how many they can use correct? They only can use what ever is beyond the 7 % used for India/China/Mexico/Phil (28% in total). Out of 1/3 of the 140K.
Am I right here ?
I think EB3 - ROW will stop or retro. next month or for sure in the next couple of months back to where they were. Lot of people here are saying that ROW will be current soon I am not sure where they are getting these facts.
Optimystic -- is your PD current?
The movement of EB-3 ROW will mop up most of the green cards left this year.

If your both I-140 has been approved then your new PD needs not to be current for interfiling. But make sure that your to-be-used I-140, PD must have captured.

You know what, you win I loose. Keep paying for your GC out of your pocket.
7.5K and counting. :pNobody wins. I would be glad if my company pays for it. Anyway it's good for me that I got this opportunity at least. And you are right, it's still counting. I'm renewing EAD every 9 months for 3 of us - 180 x 3 =540

I wanted to get an idea how many EB2 guys would be willing to visit DC to meet lawmakers to help out our EB3 brothers. Unquestionably all EB3 should be willing to visit. This is the chance to show that IV is indeed one.

I am EB-2 but I would come to help EB-3 brothers because I am sick of broken immigration system.

though I agree there is no grace period however practically USCIS has not been rigid about the dates. MOST of the employers do not inform USCIS about firing of H1b. During dot com bust, USCIS has 'unofficially' said that 15-20 days are good enough (again not as a policy decision but informally). It should be avoided, however it may not be always possible, and having few days gap should not be something on which you make life or death decision.

Employment Based Green Card - Q1: Is H4 only valid for children under 21. What happens to children who have been here for long on H4 status and turn 21?
Q2: If the answer to the first part of Q1 is YES, will the approved I140 (that included the dependent H4) be valid?
Q1: Yes
Q2: I-140 does not include any dependents. Without visa availability Child protection act does not work.

Hi,
My company is asking me to pay the extension fees for 3rd term with same company. I had approved 140. In USCIS receipt it says amount received: $320. Then why I am asked to pay $1820. Is the $1500 towards training is to be paid by employee or employer?

I don't think those 2 are related.
If the recession does hit,
will the visa bulletin of every month jump faster?
or will it slow down?
does anyone know?

What you are advising her/him to do is lie to USCIS that he/she is sick when she is not. This is on the same lines as doing what those guys behind bars did, brining people on H-1B from India to the US without actually having a job for them.
Again, its people like you that is giving genuine legal immigrants a bad name, and putting us all (including yourself) in the LONG immigration queue!
I see that you have written letters and participated in other campaigns. None of those will materialize if you're teaching others to missuse the H-1B system. How hard is it for you to understand that these are the kinds of loopholes because of which we are stuck with no visa numbers?
Get a letter from your employer saying they are granting you a personal unpaid vacation as per your request(which can be done using a pre-dated letter to them). Make sure you are getting your medical coverage from them(if you have it through them). Provide that and an explanation that you are taking personal time off due to health etc/stress. Hopefully that flies with the USCIS.
good luck

How long is it taking for renewing passport at San Francisco?
I submitted my passport renewal application by hand on 25th Feb, and got a pickup date of 17th Mar.
looks like SFO is bit slow in processing passport renewals.

If IV is successful with this 485 filing ability by 2/15 deadline thing... when does it become law and more importantly how soon can we file for 485 (before or after the CIR wars in Mach-September)?

Thank you very much for the response. My lawyer just responded back to DOL like around a week ago. It is very frustrated that I still dont hear anything from DOL so far. I wonder if I change my visa to F1 by attending the school full times such as attending college. Can I stay in US and wait until I got my green card approved? Is it possible to do so?

I totally agree, you should first have an RFE in hand and the decide if it is urgent or a simple one which one can handle.......... if URGENT then do search threads to see what solutions are stated, if none match your criteria then you are welcome to post on a new thread.
Without RFE in hand, you will only get unrelated answers, instead of giving you solace it will worry you more. Like people might suggest, your old employer may have revoked your petition or you might have done something wrong in filing for AC21 (IF you have done that)............... so let it just come and then decide.
Since this was your first RFE , do not worry. I believe all of us pass through this stage of RFE , now it may be at any stage. I too got mine on 140, but gotaway with it.
Relax you will be fine.

I am in a similar position and am going to wait till the end of the year for the AP. I am hoping to be able to go for the H1B stamping with the AP. So if there is any problem with the H1 I can atleast re-enter using the AP. Its a nice backup...
What if your AP does not come until July next year ? Are you planning to wait until then to travel ?

Even my spouse's GC which is approved on Aug 3rd which was sent back undelivered.
We called the 1 800 number and opened a SR.
But we didnt have any thing after that.
The case status went to initial review after that.
