Hi Guys,
I need your help on this. My cousin is running this small IT company in india and he mentioned that when US client sends their money to India via Pay Pal or some secure money transfer , they are charging them 4 % of transfer amount.
He ask me that what could be the best way to avoid this fees , some of the option that we thought about,
1) If they (cousin's company) open an bank account in USA and utilize this to transfer the money to indian bank account - Would they still need to pay US tax as money is being deposited into the US account?
2) If I utlize my bank account - I think in this scenarion I have to pay the US tax for whatever money the client is depositing into my account in order to make this legal transfer
3)If US client utilize remit2india, ICICI to transfer money which I highly doubt

Ask him to double check if his clients are using credit cards to do the transfers. Using a bank account has 0 transfer fee for domestic transfers. Not sure if the same applies to international transfers but good to double check.

That's not true, as per my attorney. When you are on the 7th yr of your H1 the only reason for the you get the 3 year extention on the H1 based on your approved I140 after filing your 485, is so that you won't be out of status even if your 485 gets rejected. You can still stay is status in US and appeal your 485.
Sorry, forgot to mention the MTR. If your I-485 AND MTR is rejected, my point still stands.

Greatly appreciate you for sharing this link. Rons post is really an eye-opener for those who lose good opportunies in their career, just to maintain H1 status. "The applicant would no longer be eligible for H status beyond six year. Since the applicant remained in H status while waiting for his AOS adjudication, all of that time would count against the six year limit. The applicant would not be allowed to remain in the US in H status following the AOS denial because that would involve a post-six year stay" is a valid and logical point, which many of us would not have realizewd.

I don't think there is any problem in EAD approval if you go out of country after filing it. I left USA the very next day of filing I-485. Still out of USA (in Canada). I already got my EAD and am waiting for AP. My attorney also said that for filing EAD, AP, 485 I must be physically present in USA.
Just to be safe maintain your H-1B status in case there is any issue with AP (because of what murthy's firm told). I can update on my AP status as soon as I hear something.

Is it possible to file I-485 without I-693(Medical) ?
The reason I ask is that I cannot get a doctor's appointment in July. For some reason, if we are able to file in July, can I submit the 485 first and submit teh I-693 later.
Please advise
Medical reports are part of initial evidence and without them the case could be rejected. I think the new guidelines give the officers power to reject the case instead of asking for RFE if initial evidence is missing..

You have used EB2 substitution labor. For EB2 you should have Masters degree or min 5yrs of work experience. Talk with your Attorney and try to get atleast 5 years of work experience certificate from your previous employers and try to match up with the labor. Open an MTR and it may help you. When you open an MTR your case will be in pending status and you can get a H1B extension based on approved labor. After getting your H1B extesnion apply for PERM labor ASAP. Then you will not have any problem.

But USCIS cashed my checks i didn't know what went worng the total amount i paid is 325+70,170,180.

My online status is same as yours but I received FP notice and have given finger prints. My AP status online says that they have mailed me GC sometime back. If only online status were 100% correct. My lawyer says there are errors in online status so don't believe them 100%.

I am 19 yrs old and on H4 visa since Sept 2002. Will this act be of any help for students on H4 who will get be aging out shortly at 21 yrs.

My son and you are in the same boat. He came here 9 years ago went to middle/high school here. Now, he is in college and will turn 21. He will not get his greencard because he is here on H4 legally.

Thanks. My lawyer was worried to file I485 as derivative due to the fact my primary application is considered withdrawn. So he made a request in letter to adjudicate together instead of filing another 485. I guess i have to wait.

I am in bit of a situation and trying to sort my options. I got my EAD, last month. Also took care of finger printing and received AP documents also. I 485 was filed in July 07. My I-140 is not yet approved.I am accepted to school in france for one year business course, starting Jan and ending Dec 08. Max I can fly back few times from France to US, for few days (In case there is rule for not staying abroad for more than six months). Plea
I am planning to either
a) Submitmy resignation and leave US by end of Nov 07 OR
b) take Leave of Absence from my firm for 15 months.
Is there a way I can continue my GC processing, factoring that I will be out of states for whole of next year.
Your suggestions are sincerely appreciated

First of all you need to talk to your emplopyer before you take any decision.What if he revokes the I140.Then when you get back to US you have to start the GC process again.
Why dont you defer your business course for a yr.By that time you're I140 wld be most likely approved and then you wld have passed 180 days.That makes it easy for your GC to process.

I was thinking this is a good way for short term period until we know for sure what is going to happen to us as far as GC situation is concerned. It may not make the most sense in the long term but is a good way of hedging your bets until you know for sure which way immigration issues are headed.
This may be a good soln for people who do not want to loose their Canadian PR or those who dont want to move back to India for their own reasons (ppl like me who have been in this country for 10 plus yrs on F1 and H1 cobined but with no GC in sight).

I have applied for I -140 (EB2) but I am with 10+Diploma(3 years) +Bachelors of Electronics from Mumbai Univerisity(3 years).
Is it considered 4 year degree and good for EB2 along with prior 5 years of experience?

It's important to have the goal clear. Trouble with "Truth based Stories" is that they deviate very soon from the truth & start focussing more on the aspect of entertainment (American Gangster as a recent example). I don't like the idea of diluting the subject to make it more entertaining.
Entertainment means different things to different people. There has to be a target audience in mind before making a movie. The larger the target audience you focus on, the lower the common denominator becomes. This is the reason Lou Dobbs has a bigger audience than Bill Maher.
I think the idea of documentary is more true to our purpose even if it may reach fewer people.

I vaguely remember a discussion several months ago on the forum about people that have gone back to their home countries after having waited for their green cards.
We have a media interview opportunity and need to find such examples. I remember an instance about a person going back to Bombay after he had immigration issues. He had set up his company there. Such people who could have helped US economy and growth will make a compelling story.
Pls. let me know urgently of any such cases and I will follow it up. This is required today and we have a short time window.
Two of my colleagues went back to India after facing GC hurdles. Among the two one is Phd in Atomic Science and Computer Science and lead a group of people and another is a Project Leader.
In the first one's case it took more than 4 years for him to clear his labor and got frustrated by this process. He initially sent his family back to home because of uncertainty. That created more hurdles for him as well as his family could not able to get AP in time and he is nearing completion of his 6 year H1 as well. Eventually he decided to pack his bag and went back to his home country, setup a big business and now visiting US on business Visa and take some of the jobs from here to there :)
[Side note: His approved LC remains unused at the company end even now, but finding a suitable person seems to be an uphill task for the Management and HR]
In the second one's case his labor took almost 5 years to clear and having frustrated, he decided to go back as well. He does not want hang in a place where a decision cannot be given in a timely manner. He got some special technical skills and his roll is now being replaced by 2 people. He also went back to his home country, joined a big IT firm as a Director and getting more jobs to be outsourced there :)
In both the cases, US is a clear looser by not taking advantage of the skill sets they have.
