Do not get me wrong - I do not expect the IV activists to jump on the "ideas" I posts. They have done more than enough and have said that many times. Just one thing was not properly handled in my opinion - the backlog issue. There is no excuse for the Immigration dept for this backlog. This is a simple clerk's job which they screwed. IV as a an organization should clearly state it and insist on fast resolution by the respective authorities, not just foggy promises.
But it is time for the "grassroots" to start thinking and acting, not just waiting for someone else to do it for them. That is why I keep this conversation going and suggest "ideas".
Again, thanks for the good job done by the core team and volunteers done until now. Unfortunately this is just a beginnig of a long jurney...

I have applied for Advanced parole at the end of July 2007. My H1B visa is expired, but my H1B petition is still valid. Should I just take the risk of traveling and try to get H1B visa renewed to re-enter ?
OR should I just keep waiting for Advanced Parole to be approved ? I can wait until end of November 2007. But I am not sure whether I should plan to travel in Dec 2007 or not. I dont know how long its going to take to get the approved AP.
Any thoughts ?? Do any of the July filers who have filed for AP know what time frame should we expect for approval of I-131 (AP) ?

Please don't travel thru countries that impose this ridiculous transit Visa requirement on individuals, especially from India.

I think, last week, two threads were locked due to very hot discussion on this issue. This discussion will create more heat again.

As long as you show that your job is atleast 50% different from the previous within the same company, you can use the experience from the current employer. You dont need to be promoted or move to business development.
You can use the 5 years exp from current employer. But the new position itself should require 5 years exp to qualify for EB2. File your PERM then when you file you 140, include your previous approved EB3 140 with the older PD and ask to port the PD. Then when USCIS will approve your 140, it should have the correct EB2 cat and older PD(from EB3 app).
Thats all. I was able to recapture my PD but I had a Master's degree. The only issue was that I graduated AFTER I joined my long time employer. So in the old RIR world you could not use that but PERM relaxed/cleared up the 'graduation' issue and we filed for a new EB2 application. In your case you will use your 5 years exp to qualify for EB2 rather than Masters.
The process is tedious but rewarding at the end. Hopefully your corporate lawyers will help you in this. A lot depends on your company and your supervisor, they need to be motivated.

If you are talking about the discussion. then am referring to the items and not the discussions.Have I missed these items some where that are like the above. Then we are good to go. Can you let me know if the action items already there tries to encompass all thes issues and possible solutions. Ofcourse I know every one is talking and discussing but didn't see a concrete list except a description on the front page saying we are fighting for the cause of GC aspirants and some smaller descriptions.

I used to be client of Gowda couple of years back and I did not like the experience at all.
My situation was little different. Gowda's firm was the de-facto firm used by my employer although I used to pay all attorney fees out of my pocket. In spite of me paying for his fees the firm always put my employer's interests ahead of mine. My employer then was a typical blood sucking desi consultancy shop and used pending GC as one of their leverage to make employees stuck with them in spite of poor pay scale. As far as my own experience goes Gowda's firm happily played along with my employer in the grand scheme. They denied me any update regarding whether my labor was cleared as well as didn't send me any original approval notices/receipts etc. at my employer's request. When I raised lot of noise I was finally told I can no longer have direct access to the attorneys and have to route my requests through my employer! I wised up, cut short my losses and ditched both of them to join a big respectable company loosing my earlier PD and approved labor in the process (which I'm sure my employer must have sold back when LC substitution was legal). I finally received my GC in September.
Your experience maybe different if you directly retain Gowda without involving your employer. Competency is not an issue here, conflict of interest is.

Further I found that Gowda is not keen to handle EB cases, compared to Investor categoy cases and the rates are exorbitant if there are any RFEs or representations for smaller persons. I moved away to Ron Gotcher and found his fees are dead cheap and his services are thousands of time worth, compared to the fees I paid.

Is there a conspiracy, first there was delays in the processing of the EADs, now there is delay in the production of the EAD cards...
Are there more RFEs happening too?
My EAD renewal took almost 90 days to get approved, and my employer was ready to let me go if I did not get the approval before my EAD expired. Just made it with 2 days to spare.
Why every discussion has to end with donate - why donate? What IV has done so far? Where the money goes? EB2 vs EB3... etc. Stop hijacking threads.

In your case, you have the birth certificate, so you don't need to submit the non-availability certificate. It is better you contact your municipal office and apply for your birth certificate with your mother's name included.

Went there personally and reached the consulate at around 9:00 AM... they had the waiting area open and gave me a number... approx 40 people were ahead of mine ... I had to do two work and seems one number was good enough for that ... by 10:45 I got my turn and the lady at the counter took my papers and papers for my little one's PIO card ... I paid 20+20 = $40 extra so that they can USPS me the PP ... received it within one week and the PIO card within 10 days ... I was out by 11:00 AM from the consulate ... a personal advice, if you go personally avoid Monday or Friday .. go in a weekday and you will have better luck with the crowd...
Good thing about going personally is that you do not have to send any original doc (for PIO card case) ... they only kept my old PP and returned both the books via mail...
only advice do not except a good service at the CGINY ... the lady at the counter was nice but over all service was poor ... you can see people were enjoying morning news paper even if it was well past 9:15/9:30 ... and if you call the number no one will pick the phone ... that�s terrible ...
I took the pain of driving to NY all the way from Boston to get my passport renewed. I woke up at 3:00AM and stated off at 4:00AM so that I could reach the consulate by 8:00AM. I was told by my friends that I would get it in the evening itself. Unfortunately, I was faced with severe disappointment that they are no longer returning the passports on the same day. The worst part about the Indian consulate in NY is that they didn't update their Website. When I called them several times, non one answers the phone and speaks with courtesy.
After arriving at the consulate, we were made to wait in the cold for atleast an hour until 9:15AM (They open the doors at 9:30AM). They have no mercy for people. Also, the approach they took to call out people was terrible. It was like a fish market. I asked them if would get my passport back on the same day. I didn't get a straight answer until my number was called. I went there and atleast that lady talked to me with respect with a smiling on her face. Atlast I was told that they are not returning the passport on the same day. They asked me to pay 20 extra dollars so that they'd send the passport by Express mail (USPS). She also told me that I can track the passport.
I then drove back to Boston, the same afternoon. After exactly a week, I got the new passport booklet along with my old passport. I am fortunate enough to have all of the details printed accurately.
My strong advise to everyone is to send their passports by mail.
