    i was thinking...

    500000 legal immigrants, even if u assume 4 per family , ONLY 125000 houses can be sold...(even if 50% qualify for a loan.. thats just 62500 houses sold.. last i read..there were millions of homes for sale)
    if the average cost of the house is 250000, thats additional 31.25 Billion $ in credit borrowing... where is the money?


    I agree with you that this is not big enough to stop the entire crisis. But look at the cities where there are lot of immigrants. I can give you one example where it could make huge impact.
    Seattle (King County) home of Microsoft has a housing inventory of 8600 single family homes around 1200 condos. It takes 10 months to clear up the inventory.
    Microsoft applied around 2K new H1B last year. So my guess is it might have applied around 8k in last 4 years. Lets assume 60% of those didn't GC's. So around 5k people waiting in the line. Lets say out of which 4K didn't buy a house and are willing to buy a house. So 4K new buyers in a market which has 10K units. If every one buys house in next few months then the months of supply will become 6.
    There lot of other companies located in this area which also apply for H1Bs.

    So the point is immigrants can save or make big enough impact some housing markets.
    Revival of housing market revives the economy. May be we should identify those markets and talk to those senators.

    Of the hundreds of thousands of July 07 filers, who paid a mere $325 for their I-485 application, do you think USCIS will devote the time/effort to constantly keep track of the applicant's eligibility of 485 over the next several years???? It will take atleast 4-5 years for several of us to finally get a visa number. Several of us will move/have address changes during these years.

    It took them 2.5 years to process these...imagine the nightmare if they were to try doing subsequent rounds....

    Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?

    Dude...USCIS is already on its way of bragging to the congress that it has pre-adjudicated all these 485 applications. I think if they touch these pre-adjudicated applications, then someone has to answer to someone of what is going on...why haven't you still worked on this? why are you devoting your time to these old 485 applications when there are new ones yet to be processed.

    I think once the application is pre-adjudicated...that's it!! I don't believe USCIS will spend anymore time and resources to these applications again...until a visa number is available from DOS and they apply the number to the pre-adjudicated application....my 2 cents!

    I have filed FIOA request and got reference no. or control number with below information in letter after 3 weeks of mailing initial form G-639 (notarized)....

    All FOIA/PA related requests, including address changes, must be submitted in writing and be signed by the requestor. Please include the control number on all correspondence. Requests may be mailed to the "FOIA/PA Officer at the National Records Center. P.O. Box 648010. Lee's Summit. MO 64064-8010" or fax to 816-350-5785. You may also submit FOIA/PA related requests to email address at uscis.foia@dhs.gov.

    I have applied for FOIA during Oct 2007. No response yet. Just checked the status. Thank you very much for the link. I did not know it existed earlier. Do you happen to know how I can change the address because I have moved ? I called the number they listed for FOIA on reciept notice. The asked me to call the regular USCIS number to update the address. The person who answered the regular USCIS customer service had no Idea about reciept notices starting with NRC. Any solution for this?

    Don't go for gun even after you get green card. You can think about it after your citizenship. Green is just another type of visa which can be taken away. You right are fully protected only after you become a citizen. Even there also there is a catch in case of Naturalized of the govt wants to go after you you cant dig you history and find a violation and based on that void the CG you got and the citizenship.

    I am trying to say something about my financial success instead of lifestyle.
    But I have a good lifestyle too. I socialize, have parties all the time, have 2 nice kids and a nice house and a nice family. What else you want in life.
    but after some time, you get bored by these things, you want to go up in your career(I am just maintaining status quo), want to do some other things, for which I need GC.

    If AOS takes many years, then keep the non-immigrant visa, so that no need to worry about AP.

    You are suggesting how to avoid it rather then try to acknowledge that there is a problem in the wording of AP. By problem, I meant the whole dynamics has changes over the years, so, its time they change to reflect today's reality.

    There may not be everyone who would continue to be on H1 while their AOS is pending.

    Even if its multiplied by 100 we should be ok, if the USCIS does a good of not waisting visas by doing their best in the month of Sep. Say we have 6500 * 2 .25 (Family) = 15000people waiting from EB2 2004. Looking at the spillover numbers from last year, we might be lucky enough. Just trying to be optimistic for the next 35 days.

    We received our 2nd biometric appointment notice for Sep 11th. Our Notice date is Sep 19th 2007. Just keeping my fingers crossed and hoping for something good. :)

    It may sound crazy, 2nd biometrics may not be good sign when dates are current. I had my 2nd FP in June09. I spoke with IO out of curiousity to know of any update- more so to know whether my case is pre-adjudicated (as there was lot of roar on recent preadjudication). IO told me my 'NC is pending'. I told her that around this time, last year, I was repeated told on infopass and on phone that my NC/BC etc is cleared and case waiting for Visa#. She that that is true but 2ND FP TRIGGERs NC and unless they get clearance they have to wait for 180 days before my case is ready for adjudication.

    The, few, motivated members like me who do take time off to visit Congressmen offices - do make all the points written down by you and some more. Our issue isn't that we are short of ideas or points. We have them in plenty. I assure you that I have raised these issues and made these points in every meeting that I have had so far.

    Our issue is shortage of volunteers ready to visit Congressmen offices and making these points. It's highly critical that IV members keep visiting these lawmaker offices in small groups on a continuing basis (one group after another) to keep up the pressure and convince them of the genuineness and the breadth of our problem.

    It would help our cause immensely if members did actually meet the lawmakers and made these points themselves, instead of expecting the few motivated members to act like a postman between them and the lawmakers. If lawmakers saw a larger number of members approaching them with the same points, it will make a better impact than a group of three which approaches them one in a while. It would help your cause as well as ours, if members did take initiative, set up meetings, and participated in these activities organized by state chapters in greater numbers

    o.k. I agree. This was my suggestion - whenever core or senior or motivated members meet congressmen or other important people - he/she can just add this comment(in addition to whatever else they want to say) -

    we represent the legal immigrant community. we believe that around 300K legal immigrants would contribute more to the US if something was done to take care of the inefficiencies and the long delays at USCIS. many of us have put on hold important decisions like buying houses, cars etc because of the uncertainities in the legal immigration process ..if something steps were taken to give the legal community ( like multiple year EAD's, less wastage of visa / visa recapture etc etc etc) ...then we can communicate the same to our members and this would help everyone etc etc etc. and maybe add the point that due to excessive delays and uncertainities (and the uncaring attitude of USCIS ..driver license issues etc) many skilled immi end up migrating to other countries which are more welcoming like canada, australia etc

    I dont see how the above can hurt ?? maybe we need to write the above in a better way ...BTW even greenspan earlier had said that the problem in housing was an excess inventory of about 200 to 300 k house..ofcourse we cannot solve the present problems which is beyond everyone ..our aim is just to get more stability with multiple year EAD or faster GC's

    Dollar has been going down consistently for 6-7 years now. So if any of your thoughts were right atleast one of the points would have already happened. If you think NRIs are driving Indian real estate prices then you're in dark, the kind of money people have there is just amazing, we hardly matter there. Also I did not understand how imported agriculture products will effect farmers ?

    What are the implications for software industries - if dollar goes down againest rupee?

    a. Lesser profit margins for Indian companies which might result in cost cuts and layoffs;
    b. Lesser salary for Indian software employees in India;
    c. BSE will crash down to adjust to the currency changes;
    d. Indian real estate market will go down as the NRIs will not be able to afford land prices;
    e. Indian farmers will be effected because imported agricultural products and food grains will be cheaper;
    f. American companies will not be able to afford outsourcing in India and will be forced to bring more H1b employees from India to develop inhouse;

    I don' think they should have been rude. However they do have a point. He should NOT have shown BOTH H1b visa and AP. You can enter on one or the other.
    I have entered on AP previously and my experience was very good. Only thing is you have to undergo that "secondary inspection" process where they have to verify your pending status details.
    When you hand them both, you might feel you are doing it in full disclosure,
    however they perceive you are not clear in your intentions. When you show them your AP, their main verification is, whether this 485 case is still open and pending. With H1b they want to know if you are working for your visa petitioning employer.
    The morale of the story is, if you have availed yourself of AC21 and moved into another job, you must use AP to reenter, either that or if you moved with a H1 transfer you can use that, however, presenting your old H1b is asking for trouble. H1b is employer specific. We always need to remember that. AP is not.

    I intend to travel to my home country I have H1 (not stamped but valid till 2010) working for the same sponsor if I use AP to enter US do I lose my H1 status.I have EAD but did not use it.

    That may be the unofficial version. Officially you can apply even you haven't worked or studied in Canada if you qualify as a skilled worker with a year of experience. You get extra points for having a job offer from a Canadian employer but not having one does not disqualify you automatically. I'm not talking about getting the GC. I'm just talking about the application process. Some kind of processing is needed even to reject an application and I do not think USCIS is capable of handling the increased traffic that switching to a point based system would result in.

    No its official. From Feb 2008 federal skilled worker class is restricted to people with 1 year Canada work or student experience or 38 occupations only.

    So lets do the numbers. If 10,000 of us buy houses worth $300K.

    Lets say, each make 20% downpayment.

    10,000 * $ 60,000 = $ 600 Million (right away gets pumped into the market)

    each pays mortgate of $2000 per month which makes by next year this time

    10, 000 * $2000 * 12 = $240 Million.

    So which this plan, for 1 year, we are helping the economy by $ 840 Million. :confused:

    Hmm, Is that number sufficient enough for Berneke to even think about our plan?

    This Tracker facility we have in IV is good. Kudos to the Admin team who implemented this thing.

    These are my observations. I could be grossly mistaken. Pardon me if I am wrong.

    There are approximately 26,000 people who have put in their priority dates and other such data in the tracker. When I compared similar cases, I got some 265 who were EB3 India with a priority date in 2002. That is approximately 1 %, give or take.

    Here I have ignored EB3 India 2001 guys. But that number would be very less I believe.

    1% of 400k is 4000 which is what USCIS issues GC for EB3 India in a year.

    Does that mean I could get my GC this year.

    Hope these numbers are right.

    We are going to clean up data further in the coming weeks. People who have missing fields may not be part of the tracker etc. The analysis will also be expanded to give more representation of the data from all angles. We are also working on some more features in the tracker that will make it really informative. At this time we are waiting for everyone to input their data or update their data and also get others who do not have a profile on IV to come here and input their data. Please help us in this task and bring everyone to IV tracker. Once we have more data that can help us represent a better % of the overall actual applications in USCIS data, the analysis will be much better. At a later stage we are thinking of bringing some statistics experts on board to create monthly analysis of the data and publish report for our members.

    Folks,

    I've been hearing a lot of banter about the L1 Vs H1-B the fact remains both these categories are badly abused, it doesnt matter who is the bigger evil. I would tend to agree that L1 has a worse abuse rate however.

    The issue however is that these so called "high skilled" visas arent high skilled anymore. If you closely look at the people coming in I would bet a majority of them who came during the dot com era didnt even have basic engineering degrees , and a huge majority of those coming in now have these degrees but from institutions which are completely crappy, the college plays a big role in framing who you are and yeah people can argue "there are bright students" in these colleges, but they are just plain minimal at best. So bottomline a majority of these are not highly skilled or talented people.

    When the H1-B was conceived it was supposed to pave its way really skilled engineers with excellent credentials and it is not the case anymore, if you are going to tell me things like QA and Data Warehousing need mind boggling skills I think I can just have a good laugh at it. The local citizens are very much capable of executing on them. These jobs account for a huge majority of the software based jobs in the US, yes this is not the only category for H1-B jobs but software accounts for a big chunk.

    I think of the H1-B visa as something analogous to getting into the best schools in India or the best schools out here, you cannot be crappy and get admitted to those schools, neither can you pay shit loads of money and get admitted, and this is what is happening. Consultants bringing in people from wherever charging them a huge sum of money filing for their H1-B and then looking out for a job for them, the only skill here is the consultants skill in finding the person a job :-). The new trend is the students with masters degrees from here getting placed in a job which is completely against what they specialised in, if a student after his/her masters doesnt find a job its either his badluck or he just wasnt good enough even after a masters and just isnt ineligible and these consultants have found a way to place the inept students as well which sucks at best. I do not agree with the notion of good consultants, every consultant abuses the employment based Visa system, and I am for a cap on L1-B visa's or a limit thats decided by the number of employees a firm employs in the US.


    So unless USCIS see's a way of somehow screening out the best and the brightest and weed out these consultants so only the best and brightest are brought in, I can vouch that a majority of the American Technology companies (Cisco, Intel, Microsoft, Qualcomm etal) do not abuse the H1-B system neither do they undercut wages. In the end they fail to meet their hiring needs since the system is flooded with so may people who do not deserve to get in.

    I donot think I deserve $180/hr.... Right now I make $85K plus a 10% bonus.

    You are missing the point. I do NOT think I am SPECIAL. I have an MBA from a US reputed Univ. plus 5 years of experience... I do assessment of their existing IT systems and give recommendations.

    My logic is differrent.. This is valid for US born people too. WHY would a company pay $180 an hour to a consulting Co. for the same skill-sets.... however, when you go to them directly they will just pay you $60-$70.
