Guys MY PD is feb 2008. I am recently watching vias bulletins. I am in EB2.
Based on my watching previous visa bulletions ( after sep 2008) I dont see that it makes major difference if you file in EB3 or EB2.
Both are backloged very much and sincearly I dont hope inspite on being in EB2, I will get EAD or GC till 2015.
What are your thoughts, is it worth filing in EB2?

AFAIK, AP is considered only for emergency travel. That said, I think the officer was being over reactive.
As we all know, immigration laws are arcane. AP for emergency travel was ok when people used to get GC within 6 months of 485 filing. Now, when it can take anywhere from 1 to 3 years to get GC after 485 filing, does it make sense to have AP for only emergency?! Crap...

The poor response is because we are not together and we truly do not believe in our goal. With the assumption that 90% of IV members are Indians, I can safely say this is innate in our culture - we want to get the benefit without working for it AND once we get the benefit, we give a damn about the rest of "them". :mad:

With a few bills introduced or in the works, isn't it the time now to act and bring about awareness to our problems? I know IV has been working through state chapters. We can supplement those efforts with other means such as those suggested in this thread. We need to create an uproar about the hopeless situation and endless wait times due to retrogression, backlogs, and bureaucracy. I am not suggesting anything drastic. Just some peaceful ways that won't offend anybody to draw attention to the forgotten issues of EB immigrants.

Just because somebody's plans worked well , and some body's wife is happy staying home , all those GC chasers are now fools.
There are areas in USA where there is no appreciation at all in the real estate market , and not everybody is lucky enough to get the jobs immediately after coming on to the bench ., on H1B VISA.
In my opinion , 90% of the people on this forum have got all plans and ideas on what to do if there is no GC.But 100% of the peoples plans will be more successful ..if there is GC in hand.

Oh, I trust the attorneys to file it correctly, I was just wondering if there was any way of finding out if it was received and processed correctly. With the H1B, 140, 485, etc. you get a receipt notice, but I wasn't sure if that was the case with the G28, probably not.
The thought of the remote possibility of any correspondence from the USCIS going to the old attorney (for whatever reason), and not making it to me/new attorney in time to respond to it, is a little unnerving.
Well, anyway, no point losing sleep over these things, although it is easier said than done.

I agree. And this has happened. This happens NOT because new Attorney's G 28 did not get filed properly, it happens because VO may mix it up. Usually when a employer requests a revocation of 140 - in real - what the employer requests is "As this employee has left the company the prospects of his future employment with us is not there and we will not support this 140 petition in future. In other words an employer is telling INS "They will never hire you in future".
So the VO does two things here. They send acknowledgment letters to the employer and their Attorney on file and send RFE/NOID to you and your Attorney. In this process some mix up might happen. Remember, a lot of VOs are very ignorant about AC21 and they may not follow the guidelines properly. Under the AC21 law it is clear that all you do is to change job to a same/similar position. As long as you follow law nothing must happen.
Check your online status regularly - if you see LUDs call customer service - verify your address. If you do not get mail in 5 days - call again - if it is 15 days past call and ask them to fax it.

Well I jumped a little too early :) and opened a SR in July. The following is the response I received:

From some of the posts I found that some folks are concerned that it took so long to find and recognize talent from India at Oscars. Some felt Richard Attenborough's and Danny Boyle's movies got recognition whereas other Indian directors are not reaching the pinnacle.
Even though OSCAR is recognized globally, it is an American movie award (Yes there are exceptions in some categories of OSCAR -- such as Foreign Movies etc). So, because of that reason, normal Indian and other Foreign movies are not eligible to be considered for the OSCAR. It is the same reason why Hollywood movies are not getting awards at the National Film awards in India!!!
What I meant was, a particular movie has to meet certain eligibility criteria to be considered for the OSCARs. So, if a Bollywood movie directed by a Bollywood director meets those criteria, that movie can compete in the OSCARs.
So, In essence there is not that much discrimination at Hollywood - I found Hollywood as a place which embraces all cultures and beliefs. Hollywood is the real catalyst for the American melting pot theme.
This argument is not a personal one targeted at anyone. So - Please try to avoid personal level attacks - Instead criticize the argument - that will make this argument more interesting!

I can understand cases where dates are current. But how they decide on cases which might have "visas available in coming months"? Do they know beforehand the movement of dates for coming months? or does that mean they continue pre-adjudicating cases in an order (probably by Priority Date)?
Well - from what I understand is that - these are the low hanging fruits - just like how you optimize time and resources, they pick candidates that are approvable and and utilize the time to process.
It is actually meaningless unless they make it public - say - send a letter saying that your case is preadjudicated and all we are doing here is waiting for the number.
If it is something internal - then well as long as your file is lying on the shelf waiting for visa availability internal policies may change anytime.
The entire preadjudication thing was started at the peak of economic turmoil - some say it was planned to weed out as many bad apples as possible from the GC queue by issuing denials, noids and rfes - if this is the case - then this will continue to happen as long as economy does not improve and job market is still bad.

In most critical situations a person can file a lawsuit in federal court and ask court to 1) compel USCIS to process your EAD within 1-2 days and 2) enjoin DHS from going after the employer if person continues working with expired EAD. Part 2 is available only if employer wants to participate in a lawsuit. Otherwise, file it yourself, it requires the same amount of time as filing for EAD.

what I mean by that is, everyone who gets there EAD and AP due to this huge movement, will be applying for renewal in exactly 6 months, so there will be waves of applicants.
I'm assuming that almost all of the recent filers of 485 wont get there Green Card and hence will have to keep renewing there EAD's
it might be a smart thing to ask for less time EAD (is this possible)
so instead of asking 1Yr valid EAD, ask for 9 months EAD.
and since you can apply 6 months before expiry you will be eligible to file for EAD renewal in 3 months (when there will be less crowd)

1.Reuniting Families Act (S. 1085) Introduced in the Senate(*)
2. Senate Judiciary Committee to Hold a Hearing on the Uniting American Families Act(**)
Reference-(*)(**) www.aila.org/
The S.1085 in the US Senate caters to specifically recapturing visa numbers for employment based category; i.e. ALL lost visas from 1997-2007 in the employment based category.
Also to remember is that re-captured employment based visas can only be used in the employment category. They CANNOT be used; repeat CANNOT be used in the Family category; however the vice-versa is true; i.e. unused Family Visas can be used in the employment category as happened last year 2008.
The second bill Uniting American Families Act is in the US House. Though the intent of this bill is not the same as the senate bill S.1085 noted above; an amendment can be made to make it the same. Currently, they are scheduling a House hearing on 3rd. June, 2009 for that bill.
We need HIGH level of action on the above two bills from IV Core and the Community; because of two reasons-
1. Adminstration has CHANGED; so one cannot assume that things which happened in past years will be the same. i.e. No action will be taken by lawmakers on the Immigration front. Remember it is the Democrats and we are back in the good Clinton year politics (which passed AC-21).
2. We need our Green Cards soon. India is the ONLY nation where 80% of EB folks are waiting for two years or more after I-485 submission, given security checkas and pre-processing has already been made for applications pending for two years.
