The Forums are not secure as they are watched by anti immigrant groups. Key communications like this can only be through state chapters as the membership to the state chapters are secure. The only requirement is that both I-140 must have same beneficiary and all I-140 must belong to eb-1, eb-2, OR eb-3 preference categories.
The Priority Date recapture applies ONLY for immigrant petitions (I-140) approved under EB-1, EB-2 or EB-3 classification.

is that this bill will easily pass also the House. The problem is that the Speaker and the house leader has some agreement that the only bill that goes to the floor must have the majority of the republicans votes. That is the reality. I am positive that if nothing happen this year, it will happen next year if the house will go under the Dems.
The reality is that a little group of republicans (not even conservator, Mc Cain and Flakle are conservator and you see their opinion) are agianst any type of immigration.

not true. Irrespective of whether your 485 is filed or not, if your PD is not current, you can get a 3 year extension of your H1 if your I-140 is filed.
Saying this based on personal experience, and this has also been clarified by USCIS in its FAQ. Your attorney needs to mention that and ask for 3 years when the extension request is made. If they request one, they'll get one.

My H1 B expires this December. My lawyer has filed for extension. Looks like I will get my extension approved only in Jan. He mentioned that I can work on a pending H1-B extension for 240 days. Is this true? Also can I get my DL renewed using the H1-B receipt notice? Gurus please advise.
You may want to go to your DMV and inquire. You may want to switch to premium processing at the end of Nov. if at that time it is still not approved, if you have to drive to work.

Wake up people .... E-filing is better than paper filing !!!
Why me and some other Desis still do not e-file - cause, most likely our company lawyers takes care of it. And it works just as well. We get to do the all important task of signing the papers. :D
Good point though... seriously consider e-filing next time. With the retrogressed dates and no CIR in sight, most of us Desis will get ample opportunity to test out newer technologies by the time we get our GCs. :D

My checks got encashed this friday. Applications were delivered to NSC on July 2nd, later forwarded to TSC. My I140 was approved in TSC.

That sounds about right except "Contribution to IV" may have to increase from $100 to something more or every single member needs to contribute, which unfortunately isn't happening.
I am not sure what non-contributing members are waiting for. May be they need to ask their financial advisor if few hundred dollars of investment for their greencard isn't the best investment they can ever make. We would rather pay thousands of dollars in visa extensions but wouldn't contribute hundred dollars to IV so that we can have a GC faster. If this is not poor money management, I wonder what is.

I am not telling the July and August application only, but total pending. The 320,000 is the total AOS application receipted due to JULY VB....that is not including those pending before July.
My estimate based on that file I posted is that there are about 600k pending...and correct, it also included family based application like K1.

Unless you can play some smart games using an attorney, you cannot use an EAD to change job classifications as long as you are the primary applicant.

Not sure why you guys still use the paper filing route rather than e-filing. Then you wouldnt be wondering about check cashing etc etc. I have e-filed for both AP and EAD for the last 3 years. Last time my wife's e-filed EAD came in less than 4 weeks.

After many calls and emails we received W-2 Thursday that has income and taxes of only first two months. Now he says that he showed remaining 4 months as his profit so he can only send 1099. Please advise if I can take any legal action against this employer.

Hi,
Some online tax return websites have capabilities of pulling your W2 information from IRS site. I know turbotax does. Print out all those copies and your pay stubs. Send it to IRS with letter stating your problem. Before you do please apply for extension as april 15th is last date for tax return filing.
My wife worked as a consultant for first half of 2008 with a desi employer as an employee (on W-2). After many calls and emails we received W-2 Thursday that has income and taxes of only first two months. Now he says that he showed remaining 4 months as his profit so he can only send 1099. Please advise if I can take any legal action against this employer.

thanks, it sure clarifies things.. and from what I read, these applications work in parallel. RFE on one application has no efffect on the other one. you just have to wait for one of them to come through, mostly probably EB1A. once you get approved on EB1A, they will cancel the remaining 2 applications. Good luck..
There is a reason for multiple I 140s in my case. There are benefits to each of them:
1. EB2 PERM based: already have it approved.
2. EB2 NIW:
3. EB1A (My best bet!)

Applications were sent to NSC on July 19th' 2007. I got my receipt numbers today and all three numbers (I485, EAD & AP) start with WAC ### ### ####. The online status for the applications say that the 485 application was transfered to Texas Service Center and the EAD & AP applications were sent to Califorina Service Center.
Also just fyi, my I-140 app. is pending at NSC since Dec' 2006. So now I am all over the country :-) Don't know its good or bad. Any idea anyone?

Relax guys. My online status still showing "Fingerprinting fee rejected and case is in suspense" despite having finger printing done at ASC a year back.
I cannot confirm or deny the following piece of gossip but...
A mistake has been made on the system for payments. Some bright spark for got to put a so called "where" statement into the billing system for USCIS after the pricing structure changes went into effect. I am told this is being dealt with, but some applicants may find incorrect fees on their accounts pop up. Each lawyer will have different way of dealing with this problem. If you are pre price increase and have a suspended case; this maybe the reason for it...

they are right. you have to get your medical. i would suggest that you travel even for 3-5 hours just to get it done. if you are near houston, there are a lot of listed doctors here. getting an appointment will not be a problem. i had my check-up/vaccines on a monday and got the results wednesday.

The ICE, USCIS and DOL are there and very much capable to take care these scams. So if you have any information about the fraud...contact those authorities. We don�t have anything to do with that. Otherwise please get lost.
