Like other people said, take the job and move on. No need to send any documents to file AC21.
I changed job last year and did not send any AC21 document. This year when I got employment verification RFE, my attorney sent a letter from my new employer that I am working on a similar position and also an AC21 eligibility letter. So AC21 can be done if and when you get a RFE for employment.
All is good (at least that's what I think)

Is it so difficult to make you adults understand that the thurst we need year would be the biggest...do you want the tech lobbyist to increase only H1B's (remember they have lot of money). Guys we will lost in the crowd if don't prepare ourselves for the forthcoming face offs next year. We are closing in on the traget, but only thing which can make it happen is more members and more money.

donated $50; learned about the organization on June 8, participated in the event - not knowing any of the issues. Was an eye opener to the legislative process. I did not do much, just accompanied the IV members to the meetings - these members were well prepared to present the case as well as to answer questions. I am impressed, and here I am registered and donated.

Sorry but do not want to be a damper... But this thread does not give me the right feeling. I have been a member of IV i think from dec 2005 and contributed quite a few hundered dollars and just like this organization as a simplistic, good non-profit orgnization with good intentions....
But in this thread we see a taunt... which is more like we will not have numbers in DC and then some triades...
So far whenever such type of hate comments are posted, I have noticed that the IV core/ Super moderators either close the threads or blacklist the user....
But in this case we see periodically (i think a couple of times) that super moderators are only making comments that we need to prove numbers so join the rally....
Sorry to say this but i feel either this stage managed ( the triades) or super moderators/ IV core are taking advantage of this thread.... Both I feel are inappropriate....
If I am wrong in what i have stated - My apologies to Supermoderators / IV Core.... But If I am right then I think personally it is a sad day since it lowered the image of IV in front of a great admirer.
IV does not stoop this level of staging and creating animosity. As always believe in IV and its efforts. Everyone is focussed in the rally and making it a success, there is so much behind the scenes stuff that needs to be done, IV core does not have the time to manage threads is all I would say at this time. If your PD was current, but they didn't give you a visa, that is a mistake. Why should someone report getting a visa is a mistake? He applied for the visa, he/she got it. Is it his/her job to watch USCIS? What future problems should he/she expect for getting a visa?
It is your choice but there were suggestions from attorneys that if GC is issued when PD is not current, it should be reported to USCIS to avoid future troubles. Search this forum for details. There were two threads disucssing this.

I think he is telling the truth. Otherwise we would have almost 100% attendance for the rally. But it does not seem like. So, i think we "so called higly educated and qualified" need to think about it.

Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else�s small babies. She it seems had come here last year and taken care of someone else�s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old � who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child�s safety every day.

I'm curious if the POE officers know if a person has been laid off? A friend of mine is planning to travel to Canada for the first time. He has an H1b for the past 6 years and approved I-140 and extension. He was laid off for 5 months from Company A but has an approved extension for Company B. This was 4 years ago.. His been working for company B eversince w/o problems.

We don't want to create more divisions based on how they got in to queue for GC. As a matter of fact, my company filed I-140 based on a old labor, where the skills were matching exactly and the previous person left the company. The company that I work in has 8500 employees, I was not even aware that they filed premium for I-140. I did not have to pay dime for all the process.
Pls remember filing substitution labor was legal back then.
However, USCIS removed this provision in 2007 and the discussion ends there.
When you compare all other issues that are the root causes for the retrogression, we are spending the time and energy on some thing that would not help any one.

I didn't hear from USCIS until the middle of July when they sent a huge list of request for evidence regarding my case (although I've been working on the same company's H1s for last many years now).
Meanwhile, I applied for adjustment of status on July 2nd as a beneficiary on my wife's application. If my H-1B gets rejected after sending the request for evidence for some reason now will I be out of status? Since my 180 days from my last valid I-94 will expire in the middle of September, is it a good idea to go on H4 before the middle of September and reenter the country?
In worst case, what will be my status if USCIS gets back to me, say in October, and says my H-1B extension application has been rejected?
Any input from UN or other gurus is appreciated.

Therefore you *are* authorized to stay here as of that day until a decision on the 485 is made (the unlawful stay clock stops ticking). If you get rejected on your H1 extension, you can still stay in the country and possibly work on the EAD (a derivative benefit of the 485). If you think your wife's 485 is airtight, and there's a problem later you can use the 245(k) provision since you were in unlawful stay for less than 180 days.
