Some of the reasons I can think of�
Employers will be right in the eyes of the law since there will be an agreement signed by both parties, the law does not care if the agreement was signed under duress, under mild threat or when the employee was ignorant.
Employer is legally bound to pay only what is in the LCA, that amount will be way less than what you get by pay rise, percentage or whatever. So when the employee leaves the employer could keep majority of the share and give only what is mentioned in LCA.
Good employers treat both their current employees as well as old employees equally and that is how they grow, but bad employers don�t. They do not want the employee to leave when they do not have a GC yet, so they will try all the tricks in the book (perfectly legal but highly unethical and totally unprofessional) to keep him saying that if an RFE shows up, they might not be able to respond in time if they are not with them.
They do not find projects, but since the employee is on their payroll, he will find a job himself to remain in status. Here too the employer has not broken any law.
In all of the above instances do you have a case to sue the employer?. No, even if you do have a case do you sue them?. No, cause you need them and then history repeats�.

Most immigrants apply for citizenship in developed countries for the sheer luxury of visa free travel to most countries and to bring their spouse/families closer to them without any immigration hassles. It has got nothing to do with renouncing all the ties with their home countries.
I know a friend who recently became a Canadian citizen and he said that he was murmuring a Hindi film song when the Canadian national anthem was played during the oath ceremony. The only reason he immigrated to Canada was to get a Canadian passport so that he can work in US and travel around the world without visa hassles.
I also have a friend who�s a US citizen and he was able to get his newly wed wife into US in 3 months. He visits India regularly to take care of his property investments, watches cricket/desi movies, loves eating food at the road side eateries and by all means he�s still an Indian at heart.
Citizenship is like getting an unlimited credit our existing credit card (GC). The more the limit the more flexibility we get. So let�s avoid bringing patriotic fervor into such posts.

Looks like he has realized that he has been sidelined and did not really get any support for his actions( $ 3500 ) in the press or the media , so now this guy this does this about face and tries to be " so sympathetic" . Looks like the tech lobby stopped the flow of his campaign money and ALIPAC's and the 1500 member programmers guild's coffers are not enough to fund his campaign . :D
He is partially right in saying that there is some fraud in the system , but why have we got to increase the "Tution Fee" by $ 3500 to fight fraud . :mad:As if the students in the US do ot have enough scholarships already . Are they not ripping us enough already on visa and green card costs . We also pay Social security taxes which must technically be returned to people who will never enjoy them .

whatever the case is, this guy is doing it legally. Granted, he is taking advantage of the loop hole in the system. HOWEVER, it is legal. Trust me, we have taken advantage of several similar system loops holes in our lives.

I had H1B valid up to 2010 (3 years extension because of I-140 being approved). Then I traveled abroad and entered US last December using AP. My new I-94 said "paroled in" and had an expiry date of Dec 2008 (till the date the AP was valid). Last week my company applied for transferring my H1B to one of it's subsidiaries as my position was transferred to the new subsidiary. They applied using premium processing and got an approval this week. My new H1 is valid for the next three years now (till 2011) :)
Also, although I entered US using AP I continued working using my old H1B. I did not use EAD. I talked to my attorney and according to them entering on AP does NOT automatically switch you to EAD. You can still keep on working on your original H1B. Since my H1B transfer was approved later I believe they are correct in this regard.

IV will be soon posting some updates on this. We have done some ground work on this issue in the recent past and have got positive response. Stronger support from our members, will definitely help us push this agenda item. IV feels that this issue is going to be a big roadblock for a lot of us now, after people have filed their I485s. It is possible to get a much wider bi-partisan support on this issue by us and we are already pursuing it.

Leadership or Money is not issue for getting results. Why there is so much oppositon to H1b and GC increase? There is a fear in certain american people that they may lose job to the low wage H1b people. Is anyone either corportions or Pro-immigrants trying to remove the fear? Is skill bill has any protection to american workers? We want to increase to h1b or gc without botherng the impact. Now USA really need more h1bs and gcs. But are we suggesting anything when job growth stops or recession happens? Rememember so many people were laid off between 2000 to 2003 including H1b people and Americans but that time also most of 195k h1b was used. I knew lot of people

We all can certainly do one thing, we can write emails, letters to editors and media talking about our personal situations, highlighting EB visa backlog and how that is hurting legal-tax paying aliens like us. We can raise awareness in the media and we can bring new members.
When something is asked of us, we should do that. Pappu asked everyone to write to the editors thanking them for the story about immigrant entreprenuers. Just yesterday, we had some people come forward and write to all these editors.
Myself and some other members even posted names and emails of all the editors that we should thank in the "news article thread". If all of us can go there and write emails and flood them with thank-you notes, we will get noticed. Remember the print media business is based on how many readers they have, we have to make them feel that this issue is very important and is getting them more readers and membership.

This was because a few people wrote to them about IV and requested them to do a followup article abut us. I had found about 72 articles yesterday morning and we had more than 50 potential reporters to contact.It is not easy to get press coverage and this is one opportunity where we can captitalize on the venture captitalist story (no pun intentended).

Good post I like it and I probably may follow most of these eventually but, if I think about it, it seems to me lot of stress. Maintaining records from past ten (GC)/fifteen (Citizenship) years is certainly a stressful activity. Except education certificates I never cared for anything in my home country. In spite of taking care of all this, if you get involved in an unfortunate event everything GC/Citizenship goes into vain and back to square one.
I am not trying to discourage or depress any one. It�s just a thought.

Maintaining detailed documentation can be a big pain in you-know-where, particularly if I am asked to do it suddenly today (believe me, I am one of the world's leading disorganized blokes). Instead, if I begin to get organized early, the process eventually becomes incremental and stress-free. That is what I wanted to share here, the idea of getting organized early to have a smoother passage of time later (much like invest-today-afford-later philosophy). Unfortunate events are unpredictable, but that should not mean I ignore what I can control :)

Though your case is weak(in my personal opinion because you seem to have entered US uninvited), A complaint against the employer may unravel some strong cases when the investigation happens.
This is from my experience:
Few years ago, some one complained against our employer about back wages and we all benefited from it. Our employer had to pay the wages for the vacations that we took (supposedly paid vacation) which they would not have paid, if the investigation had not occurred.
Though your case is weak(in my personal opinion because you seem to have entered US uninvited), A complaint against the employer may unravel some strong cases when the investigation happens.

Hi Smartboy75 & Wawa, I also received the same update on Sep 28th ,I am in pending h1b transfer and uscis tried to reopen my previous approved h1b .
I am June filer and got all the receipts. Please keep me posted as well.
