It costs time, stress, sleepless nights, anxiety, restlessness and some hair loss(the list could be long for others) if you get a RFE relating to AC21, these are all bonus in addition to the money you spend for filing MTR.

If they already cashed your check for all the applications, you can call USCIS and ask what happened.
Can't you see the receipt # of her I-485 and your I-765 at the back of the check?

USCIS had been given strict guidelines to process all cases within a six month timeframe depending on the type of the case. But many cases have come to light which are not seeing the light of the day.
How about filing our taxes on April 16, but not on April 15.

Can we go after State dept to have them make an administrative fix to publish 2 sets of Visa dates, one for Visa posts and one for USCIS. CIS Dates to reflect their processing length and allow for an early AOS application..

I can't say which is right, but I can share my information (so far). My EAD was supposedly sent Sept. 5th. On Oct. 4th when I had not received it, I called USCIS and spoke to CSR, who put in a request for a resend of the card. I still have not received it, so after 45 days (the requested wait this time) I called again today. I have another service request number now and am told to wait another 45 days... At least the CSR admited she didn't think anything was done after I called in October! I wonder how many "45 days" they want me to wait!

I was nice and easy few years ago which we used to get stamped here and used to say "Department of State" for the location it was stamped. I got my visa stamped once here in US.

You would send the needed paperwork and she will appear for her visa. You wouldnt need to be along with her unless you are already out of US and has a expired visa.

If I take a training course from Sun microsystems by paying them when I am on H4, is it illegal?
Technically, before October 1st - there is no employee-employer relation. It can be a trainer-trainee relation like Sun example above.
Also, please don't forget to consult a good lawyer when you have any questions about whether anything is legal or illegal.

My GC PD (EB2-I) Mar 2008 I140 approved with Employer A
Currently I filed for the H1B extension with Employer A, it is in processing (for 3 years)
Now
I got an offer from my client (Employer B) for a permanent position
1. Can I apply for H1B transfer to Employer B while the Employer A extension is pending?
2. If I apply transfer to Employer B, after Employer A Extension is approved, will I get 3 years extension?
3. Can I port my PD (As I have approved I140 with Employer A) to my GC process with Employer B?
4. Are there any other complications & Risks?
Please give me the information

The RFE talks about the office space.
Currently my employer has 3 employees and the available space is for 3 people. One of them is an Account Manager and basically the Manager has adopted the HOT DESK philosophy; so, basically the current work space is ok to accommodate me.
Can you please help to answer this request?

I got RFE on 485(field in Dec 2004) in last month for TB Skin test and employement letter. My PD is not current but INS is processing my application. I am waiting for physical notice from attorney. I have dependent whose AOS is not filed now I can not file due to retrogression.
With July bulletin my PD becomes current I am ready to file AOS to my dependent. Offcourse not sure that once I submitted to attorney how soon he will send to USCIS.
I have question that which one is best option to file dependet's AOS?
Submit dependent's AOS with evidences to RFE ? Means in same cover?
or

I came to US on B2 10-year multiple visa, my I-94 is going to expire in a few weeks (first time extension approved ). My husband�s citizenship application has been pending for the past 10 months, it is in internal security check , so don't know how long it will take to clear.
What are the consequences if I over stay on my B1 visa for about 150 days, during which I apply for my I-130 and then go back to my home country and go for the consulor processing. Is this can be done? I got different opinions so confused. Would it impact my consular interview?
The hope is my husband�s citizenship would be approved before that and I might never have to leave the US.

My insurance company (Progressive) is charging a ridiculously high rate for liability only insurance for my H4 spouse who currently holds a valid permit. They say the rate will go further up when she gets a perm license after passing the road test.
I have heard this issue from other H1Bs who have different insurance carriers than mine.
Have you guys found a cheaper alternative? Insurance agents etc??

Just wait a few more days and you will receive his I-485 receipt. Some members received online rejection only to find later on that they have been issued a receipt notice.

can someone pls help me with a few question on re entry permit. i will be going back to us after 1year 8months. i had applied for re entry perit in oct 2007 - i left us in may 2008 - my re entry permit is valid till july 2010. i will be going to us in feb 2010. my question is will i have problem because i left us before i got my permit. my husband who was still in us got my permit for me.

My employer applied for my PERM and i-140 in 2005 in the EB-2 category. Both were approved.
In 2007, I left my employer to pursue an MBA, and converted my H-1B to F-1 visa. Now I am planning to return to my old employer.
I would like to know whether
a) if my employer did not revoke my i-140, is my old PERM still vaild? Can I apply for a new I-140 and a new I-485 using my old approved PERM.
b) if my employer did revoke my i-140, is my old PERM still vaid? I know I can retain the priority date, but was wondering what is the status of my old PERM?
Any help is appreciated.

By chance, I was browsing the USCIS homepage when I came across guidelines for the change of address form. It says that not changing your address within 10 days is a criminal misdemeanor. Does anyone know when this law was passed?
