I am planning to send papers to my father, but i am Not able to see appointments available dates for Visitor Visa in Hyderabad. Always it says not available. Has anyone heard about the immigrant advocacy groups that are planning a protest march on Washington one day after Obama's inaguration. They plan to demand that immigration raids stop and that immigration reform be taken up during the first 100 days of Obama's administration (while recognizing that the economy comes first)
The marches are apparently being organized by the Coalition for Humane Immigrant Rights of Los Angeles (CHIRLA). These news are very fresh and thus far I have only seen it on Spanish language media (3 different online newspapers). Here is the note in Spanish: http://www.chirla.org/node/246
Should we march ourselves for legal immigrants? Send flowers? The inaguration and following days will be very visible.

Completing Form ETA 750
AILA: Has the issue been resolved as to how to complete item 10 on Form ETA 750B? As discussed, the item asks for either 10a or 10b to be completed, whichever is appropriate, not both. Please note that Consulate location has not been a required entry since 1990. The reason the question existed was that under the pre-1990 preference system, one could process under a non-preference category with an approved labor certification and no I-140 petition so the question was necessary on the ETA 750. Since 1990, the item should have been marked "N/A". Therefore, we suggest that the item is no longer relevant.

My company would like to send me France on business.
But My H1 visa expired Jan 2006.
I got H1 approval up 2009 but passport is not stamped.
My lawyer told me that I can go to Paris (France) and visa stamped.
I am not sure France consulate will issue me visa to enter France.
Any comments and any input?

Hi,
I came to US on L1 Visa and later applied for COS to H1 last year. I work for consulting company. My client wants me to travel to Nigeria for 3-4 weeks for project implementation. I would like to if I can get my H1 Visa stamping there. Will there be any issues in getting the stamping and should I need to do any legal preparation for the same ?
I would like to hear advice from seniors and anyone who has faced similar situation.

My EB2 I-140 got approved during 1st week of April and USCIS successfully ported my EB3 priority date of Jan, 2006 to the new EB2 I-140. As per my attorney, interfiling shouldn't be done as I have been with same employer all along and same employer sponsored for my porting. The attorney says, this should be automatically taken care of by USCIS.
My question is...I couldn't find the proper procedure/documentation for my scenario. Did any body come across this situation and can any one offer any suggestion?

I have just gone thru March recording of IV lawyer call and the below caught my attention. Ms Susan mentioned that any company name change after I140 approval has to refile I 140. I am utterly confused as that particular scenario affect me and i would like to know what best course of action i can take at this point.
I filed LC and I 140 with company A
My I 140 got approved
Before i filed my I 485 my company changed its name
I asked my attorney at that time if we need to take any special action
Attorney said they can just add an amendment while applying for I 485 about name change and apply with approved I 140, which is with old company name.
I and my wife work on EAD for past 3 years and i am still employed with same company. I wonder which one of above attorney is correct and what i should do.
Does the fact that my I485 is pending for more than 180 days after approval of my I 140 will come to rescue in case of question about company name change (AC21)

Which center did you sent out documents to?
I saw in other threads that some people who aplied for AP in Dec got approval on 30th Jan. So I believe you should be getting it soon.
I also applied for AP and waiting for approval, I believe I should get it in anytime between 1-2 months.
I asked same Question, whether I can travel outside after applying or after getting receipt and come back after approval. Many attorneys say its not good practise and insisted me staying in US untill I get AP Approval.
If there is no other go, I believe your wife can get H4 stamping and come back, unless she has EAD and want to start working after she comes back (Not sure if that will be an issues).

This is not the appropriate place to ask this question. Most of us here are still waiting to get our green card. You may find answer to your question at another forum that have people who already took the oath.
It is ok in my opinion. This is a 'Ask a lawyer' area and people can ask any immigration related question to the panel of IV lawyers for free. We now have 15 lawyers in IV panel.
