Anyway this is the situation. I'm in EB3 with a PD Dec 2002. DH is in EB2 with a PD in 2006. Can he file I-485 for us using my PD according to the above law?
The answer is NO, but ask your lawyer anyway.

Seeing the enthusiasm of all the people on this message board, I would like to request IV Core to co-ordinate rallies in various cities by doing the following:
1. Facilitate a common date for all rallies through consensus
2. Facilitate the development of a common theme through consensus
3. Facilitate an official statement on our position on "employers that abuse the immigration system"
I propose that the San Jose rally organizers should act as advisors to other local chapters since they did a wonderful job organizing the rally.

I read through the first guy's testimony and all it talks about are the yearly issuance of student visas from FY2001-07. Can you point me to the person who actually talks about EB green cards for STEM students in the US?

the only difeerence is in the ease with which you shift employers.
when it was not called transfer you had to wait for approval of new H1 but now you can start working for new employer upon getting the receipt.

Wait time for spouse to get a green card as a derivative from you would be apporximately 5 years since you already have your green card now. the best option is to wait for to get your US citizenship and them apply for your spouse and in that case the max. wait time os only 3-6 months. Hoep this helps.

I came to US on B2 10-year multiple visa, my I-94 is going to expire in a few weeks (first time extension approved ). My husband�s citizenship application has been pending for the past 10 months, it is in internal security check , so don't know how long it will take to clear.
What are the consequences if I over stay on my B1 visa for about 150 days, during which I apply for my I-130 and then go back to my home country and go for the consulor processing. Is this can be done? I got different opinions so confused. Would it impact my consular interview?
The hope is my husband�s citizenship would be approved before that and I might never have to leave the US.

also try taking appointment by sending someone to the mumbai office. only a portion of the appointments are available on the internet. you can get a better date by taking a local appointment. it can be taken anywhere where there is VFS office (pune etc) if mumbai is not a convenient place for you. this was the case around 3 years ago, i dont know if it has changed now, but worth exploring the option.

I have applied for H1B transfer and here is my situation.
H1B expiration date with ex employer was 06/10/2010 and I transferred the H1B to a new employer on 06/01/2010 and the approval came on 08/09/2010. However the approval notice says the validity date is from 08/02/2010 to 08/01/2011. It should have been 06/11/2010 because we filed this transfer before the expiration date.
We sent an inquiry but the officer was saying the application was submitted based on new employment and not continuation of previously approved employment without change with the same employer, so we will not change our decision.
What should I do? I think I was out of status from 06/11 to 08/01. Does anyone have any information?

It is mentioned by many that PD should be current at the time of GC approval. Is that right?
I know people from India who got their GC approved when their PD is not current.
One can check this easily in looking for I-485 approvals to people from India who submitted their applications concurrently in EB2 category after say april 2004. Disregard the cases which got approved in July 2007. Still there are many cases remaining invalidating the 'rule'!
The strict rule is that one's PD needs to be current for approval. But if there aren't earlier PDs available for approval ( say stuck in namecheck ) and if USCIS doesn't want to visa numbers for a year to be wasted , then one can get approved even if PD is not current.
