How do you come to these conclusions what congress intended. AC21's main provisions were to recapture unused visas for certain years; extend h-1b beyond six years; allow someone to change a job after 485 pending for more then six months; allow unused visas to be allocated to oversubscribed countries on a quarterly basis rather then in the fourth quarter.
I came to the conclusion just based on section INA 202 (a) (5) (A). Nothing more nothing less. You came to funny conclusion of "quaterly basis".

IV members, we need your stories. We are going to make an all out effort to pass this on to senators/media folks to realize the urgency of the situation.
Who's story do we need?
Your story about how you are affected by retrogression/back log etc. It could be as simple as 'I have a BS in Mathematics and am stuck in back log for 2 years and cannot fulfil my dreams professionally' to 'I have a PhD in Nuclear Science and US needs me coz there are only a handful of us!' Anything and everything works.
We have literally recieved stories of stay at home moms (because of H4 they cannot work) to folks who have been interviewed by MIT! The whole spectrum helps.....please please send us your stories...we need all the weapons when we go face the senators on behalf of IV

Media folks
Sometimes we get approached by journalists who need a story the very next day. They are looking for specific subjects for the story though.
An example is say the Investors Business Daily (a financial daily). A reporter might come to us and ask us if we have anyone from the Finance sector who is suffering due to retrogression and is willing to speak up about it. They might also add that we need only Eb1/Eb2 category folks.
When this happens, we are in a mad scramble to find folks who fit this criteria so that we do not lose this chance.
Another example might be of a Medical Journal looking for doctors stuck due to retrogression.
We are constantly getting requests like this but cannot capitalize on it because we do not have enough stories already available to fit the criteria.
So please send in your stories. It need not be earth shattering at all (most of us are mere mortals). You never know when a reporter is specifically looking for a story similar to yours and you might just tilt the balance in favor of skilled immigrants.
We promise we will not reveal your story to media if you do not want to.
Though there is no harm to reveal one's name in media as can be evidenced by the folks featured in the Roll Call article, Philly Inquirer and News Observer.
At the same time we understand that you might have reasons to remain out of media and we will fully respect that.

Lately when we go to meet them, most of the staff have already visited our website multiple times, know about us because of phone calls and faxes by members and ofcourse the articles that have been published....on top of this when we provide stories of members from their constituency, 50% of our work is already achieved....the liason team and QGA take over from there.

Looks like this idea has come out of mere frustration. Do you know how many people want to immigrate to the USA? Do you know how many people are waiting in line? Do you think it is correct that only EB-immigrants should be given preference? Why because USA needs all of them? While I have used "you" in the previous sentences, I don't mean just you....rather "we".
If you have time-bound path to immigration, then right now, the whole Federal Govt. and all employees will have to work only on getting the immigration files cleared. Under current circumstances, I think the current system will get you a GC faster than if they switched to "time bound" today. Do you realize, how many people will suddenly be suing the Govt. for delays? There is no country which guarantees time-bound path to PR.
While I forcefully oppose the DREAM ACT and CIR, these did not give time bound GCs but only allowed illegals to convert to legals and in time APPLY for GC if they become eligible.

I honestly do not understand why you seem to be opposed to this approach to alleviate the sufferings of so mant EB3 (esp) and EB2 friends. Discussion and debate are always good.
Here are a few facts:
1. Most of the advanced countries in the world - UK, Australia, NZ, Switzerland, Singapore and some Scandinavian countries offer a time based path to residency and citizenship for the educated class of people who come through the proper channel to work
2. In Canada, Australia, NZ (there could be other countries, but I am not sure) people can apply for a PR based on their OWN education and experience. They are not held hostage by their employers and harassed for ages. It is happening here because the lobbies are very powerful and are supported financially by the corporations to serve their interests. The system has been craftily designed to ensure long term indentured labour
3. In the entire scheme of things the real beneficiaries are the employers and the law firms
4. The system would be streamlined and the work of the government would become much simpler and faster. This is the way governments works in several western countries who offer a time bound programme
5. Every month our EB friends need not stare at the bulletin with great expectations and waste their time
6.Everyone can plan their future better. (I do not think I need to explain this)

Guys,
I want your input on a very important issue. So far I haven't heard anything proper from IV Core. We achieved the pledge goal. This really shows everybody's passion to get the real data.
We have couple of options:
1. We deposit all the amount to IV's regular account. In that case quite a few guys have asked for guarantee that first $5000 out of this money will be spent specifically for this purpose.
2. We create a new paypal account, get all the donation in that acccount and one of us get the data from USCIS and share with everyone on IV thread itself.
Please let me know your opinion ASAP. This is very important and quick reply is necessary.

I just spoke to Indian consulate, NYC. The procedure to correct the last name is very simple. All you need is an Affidavit from the person (Signed in US, saying that you are correcting your name.), 4 photos and a copy of 797 or Visa. No need of advertizements, or Indian affidavit.
Please note, this is applicable only if,
In your passport Surname is Blank
Given name has <first name><last Name> (and all spelling etc are correct)
and you want it to be corrected to
Surname <last Name>
Given Name <First Name>
They will issue a new booklet with corrected name. It's same day service in NYC.
Sent you a PM, can you reply back.
Please note, this is applicable only if,
In your passport Surname is Blank

We can't have that. You would be released from your suffering and anxiety. That would render our cleverly thought out process to make-you-wait-forever meaningless.
On top of that, you add a layer of work to me! That cuts into my 3 hr lunch, 2 hr coffee time, and 1 hr toilet break. NO!
And the worst thing ever is: should the idea be implemented, it would add transparency to what we are doing and.. and.. oh noes! *GASP* we would have to provide accountability! NO NO NO NO NOOOOOOOooo.

This is very nice, but lets not make it EB2 India specific, other EB2 and EB3 has the very same issues. Let make it a bit more generic so that everyone can participate. 100 letters would not achieve anything 1000 would surely make a difference.

You know it might just mean that that the annual quota for I/C is over but the overflow is not a part of any quota. So EB 2 I/C should still see approvals...IMHO dont worry about the memo.
As per one of the patrons on another thread an IO showed him a memo recieved by USCIS suggesting that all Visa numbers for EB2 India/China were exhausted

Refer the following from Page (17) and (18) on Criminal Penalties
2. Criminal Penalties
a. Engaging in a pattern or practice of knowingly hiring or continuing to employ unauthorized aliens
Persons or entities who are convicted of having engaged in a pattern or practice of knowingly hiring unauthorized aliens (or continuing to employ aliens knowing that they are or have become unauthorized to work in the United States) after
November 6, 1986, may face fines of up to $3,000 per employee and/or six months imprisonment.
So the worst that could happen is that our friend ends up paying $3,000. Also note that I-485 will be in trouble if and only if the prison term in more than 1 year (or) if the beneficiary had failed to include his arrest record on his I-485 application. Besides that, there are many waivers available for first time convictions.
When USCIS is protecting illegal aliens through "U Visas", wouldn't they be considerate on a case involving the baby of a legal alien?
Going by the above, it makes sense for "thunderbolt" to take help from a qualified attorney and report this case to cops. Posting the video in youtube or bashing the Nanny is Sulekha/citysearch is all fine. But when you child grows up and asks what you did when he was abused as by the nanny, you don't wanna answer "Dear child! I took the video footage of the abuse, showed it to my friends and posted it on you tube and then I bashed her with my comments on sulekha/citysearch."
Hence if there's any justice to be done for the poor soul who couldn't even express himself, then take the evil nanny to cops. Or else you're just letting everyone to walk all over you like a doormat.

Sorry that I had to wait this long to contribute. Been tight with my debt and payments and also secretly monitoring this board and praying for your success. My first contribution of $20 was sent via paypal.
I personally feel that not a lot of people out there know about paypal or are just too scared to transact online.
It would be awesome if a portion of the money could be used to start a mailing campaign via snail mail by including a contribution plea letter along with a form that can be filled and mailed with a cheque to IV. Just like those credit card offers. Obviously to all the registered members.
Also, psychologically, when you navigate to the contribution page, the list of contribution amount options starts with $100. And then all the way to the right is the "other" option. It takes time for the eye to get to the "other" amount option as a result of which an anonymous/interested user navigating to the page sees contribution amounts in multiples of $100 thereby creating doubt/hesitation without realizing that you can choose the "other" option to contribute in smaller numbers. It would be great if you could put in a blank text field first and then the other options with multiples of $100.
Just my 0.02 cents.
Keep pushing and for all you guys watching in the sidelines watch "Gandhi" - the movie, for inspiration. Seriously!

I know many of you single non-immigrants living alone don't have to shop around for Christmas. I know I don't because my family doesn't live here. So maybe you can gift IV with a small contribution.
Maybe you can skip a carwash this month (for all those living in the south, i.e.) and do it yourself and send in the money to IV. Small drops of water make an ocean. So don't think your contribution, however small it may be, is not going to help.
If you really don't have the money to contribute, atleast buy a $1 greeting card and a $0.39 stamp and send it to IV thanking them for fighting on your behalf. Its that simple.

I know many of you single non-immigrants living alone don't have to shop around for Christmas. I know I don't because my family doesn't live here. So maybe you can gift IV with a small contribution.
Maybe you can skip a carwash this month (for all those living in the south, i.e.) and do it yourself and send in the money to IV. Small drops of water make an ocean. So don't think your contribution, however small it may be, is not going to help.
If you really don't have the money to contribute, atleast buy a $1 greeting card and a $0.39 stamp and send it to IV thanking them for fighting on your behalf. Its that simple.

Giving GC to STEM graduates is not the right way. If US needs to keep these educated people in US then US needs to make sure these educated people get an H1B without any issues and then they are on the path to GC like everyone else because H1B is a dual intenet visa. Jumping from a F1 visa to a GC visa is not correct as F1 visa is not a immigration intenet visa

Why should STEM graduates have it easy when a H1B has to struggle and wait in liner to get a GC.
I would agree to this only is the requirement is made so that only PHD and scientist who have atleats acouple of research papers published be given GC and not every Tom, Dick and harry who completes 4 years engg degree in india from a 2 bit university and whose parents have money and uses this money to pay for 2 years MS.
People who are going to benefit by this will support this. Others oppose.

One thing to remember is this provision helps STEM grads irrespective of their EB-class.

Lastly, everybody's parents don't have so much money like you think. People do get 13% student loans in India to fund their studies.

I just talked to a NSC representative and he told me that my case is sent to extended review. Now what is this extended review?
Well, what annoys and confused me is that when I took Info pass day before yesterday she told me that my case is with IO. And now NSC rep is giving me another version called extended review.

Vldrao is not a god. His assumptions are based on the facts from USCIS data, Do you know that 22k visas were not issued. If yes,quote that. Nobody knows and all are playing guessing game. Leave him alone.

For me as one, I do NOT think 22K visas were used up in 21 calender days(ie approx 15 working days).
As for as vld..is concerned, I wanted his input cause his GUESS seemed to be pretty accurate as the thing were going. So to say, chill.

Even if 1000 of our ~41000 members contribute 100 dollars each, we can host two more events like this.
It makes sense to ask help from outside of the organization only when our internal resources are all exhausted. However, sadly, most of us do not want to even contribute for the good cause. :o
I am not a dornor, BUT, I am going to say this one more time:
1000 X $100 (one-time) = $100,000.00 (one time)
41,000 X $10/year = $410,000/YEAR
Take your pick.
It is is high time to make IV a paid subscription site, something as little as $10/year should bring in a STEADY, healthy flow of funds.
Even if HALF of IV members drop off, because of this $10/yr fee, we will still have $200,000.00/year in assured, steady flow.
I would like to see Pappu's comments on this, once he gets so time off from the avocacy effort.
BTW, I did send in my contribution for Advocacy effort.
