So you guys are saying that because you are on a H1B you are working harder than others? Let me tell you that working hard does not guarantee your job. I have seen hard workers laid off left and right, be it US citizens, green card holders or H1Bs. In fact one of my GC friends said that it is a constant fear for him to be employed at all times, he was unemployed for 10 months after the dot com bust. That changed him completely, he said what will I do with my GC, can I feed my kids with a GC? I need a job. So it is everyone's perspective. I look at him and say at least you have a GC, he says at least you have a job. :)
I still think that GC is not a right. It is a privilege, as is a driving license. You have to pass the drivers test to get a license. Logiclife's message from centuries back about anyone being able to move to another country does not work in today's world. There were no visit visas needed to get to India or China for example in those years, but why is it a requirement to have a visa to visit India now? Things have changed.
BTW, I do think we should do what we can to improve the immigration process, but if nothing gets done its not the end of the world. We can "ask", "request" Congress to change laws. But surely you are not saying we "demand" for our rights to have a GC?

Today we might not be responsible for that, but I am sure lot of us will do the same after getting (if ever we get it) the Green Cards i.e. open such a consulting companies. Also we do not hesitate to call one of our friend, relative etc through one the tricks mentioned above. Finally many of us work or worked for such companies and let all these happen in these companies.
The sad part is that big companies like TCS, Wipro also do similar things, so why blame small desi companies.

Hey guys, thanks for the replies and the good advice, which helps a lot. It's true that prevailing wage for H1b and CG are different, so I don't think my employer is breaking the law...at least not yet. (Logiclife, what do you think? Wouldn't the attorney had told them that they are breaking the law?) It's just a hard reality check to realize that all the "we care about our employees" is just a smoke screen.

If I were in your place, I would not spend money to hire my own attorney- not yet. I would let the insurance attorney handle the initial few months, and only after things start happening, I'd think about paying an attorney myself. Meanwhile, use this interim period to look for a very good attorney- meet with a couple of them and decide which one would you choose, if you had to. Personal liability defense is handled best by firms specialized in tort defense (eg. who defend medical malpractise suits), and NOT by trial lawyers who are mostly experienced with plaintiff's cases.
Another thing, since YOU were the one who seems to have experienced most injuries in the accident, didn't you get letters from trial lawyers offering to sue the other folks and ask for damages (since THEY were at least 20% responsible for your injuries)? Such trial lawyers do not take any money from you upfront- they only take a % of the money recovered. This might make things too messy for you to handle- but give it a thought; sometimes offense is the best defence.

If I remember correctly the first car in front of you had already collided with the car number 2 and hence all the accidents. I don't know how they can put you at fault . So let the lawyers handle it and go all the way .

Niether many has tried this option (entering on AP and filing H1B transfer to different employer other than GC sponsers) nor USCIS has strong history of approving/dealing with these type of cases. After entering in AP, though one can very well contine the H1B with the same employer to whom any one work on H1B before leaving US. There is a memo for this type of situation. However, there is no specific memo to address this situation (Transfer). It is all depends on the individual adjucidator's logic. If they see your latest I-94 with parolee stamp, then they may deny (or issue a RFE )the H1B transfer, by the applying the the logic of one must be in the smae status to seek extension. If the deny/issue RFE, you can not counter act as there is no secific memo or policy by USCIS in this case.

You are right. L1s are paid shit and are not given proper insurance. Once L1 guy got sick and he went to Doctor and pharmacy, Pharmacy charged him $250 coz they wont take the shitty insurance (some Indian Insurance), L1s are being absued a lot

Yes US Post Doc (without US MS or PhD) might not qualify under SKIL. But on the other had, a post doc might have enough publications and such under his/her belt to try to go for EB1.

Post doc is a position not a US educational qualification and hence not a benefitiary of SKIL bill. The SKIL bill included US Master's and Ph.D's.
With your US MS you should not have any problem. Would require 3 years work experience to allow one to self adjust. We will need to wait and see what happens when it is introduced again in the new congress.

I think , of what Mr. Logic Life said summarizes and represents the state of us all , who wish to obtain a Green Card and are on H, L ect. VISAS.
I think, It is absolutely right "We deserve fair and speedy immigration.".
Opportunity of working in America is great ... but when skilled professionals will have to choose H1,L1 or GC , they land in an unpleasant experience, that goes on for ever until they obtain their GC.

2. At the end of the week one of them is selected and refunded 2 times his contribution amount
3. To make things interesting and ensure the scheme "helps" and not "hurts" IV: Change the selection process every once in a while e.g. One week you select the user who has donated an "average" amount, but next week you select the "highest" donor, in the 3rd week you select the "5th" name in the donor's list irrespective of his amount, and so on.

consider the following players/amounts in a given week:
user1: $20
user2: $100
user3: $10
user4: $45
user5: $25
user6: $50
user7: $25
user8: $5
user9: $10
user10: $100

Total: $390
Divide by 10 users: $39

Who donated an amount closest to the average? : user4 ($45)
Therefore, refund user4 for $90
