I read that he is here since 2007 and card production has been ordered, we are here since 2000 on H1B with no end in sight. Really painful
If anyone gets year 1800's labour legally through their employer I would not find it problamatic. If someone gets it illegally by paying money or something I would call it wrong.
Most people who escaped the common class were smart to identify the undefined territories of the law. So legal fine, ILLEGAL wrong.

I do agree with you, USCIS honors the old PD on the Labor, not the I-140 filing date.
Dont know the exact rule on the labor substitution cases, but i know for sure people who applied in 2007 with old sub labor PDs from 2000 and 2001 received their GCs. I would simply call them lucky as they found the Employers who took advantagfe of the sub labor rule and filed their petitions before the sunset date of July 16th 2007.
Lets hope USCIS do their job and approves only the genuine lab sub cases.
For rest of us who were the victims of backlog elimination centre and then the stupid July 2007 fiasco of making very EB category current, its just our bad luck, in backlog centre too DoL processed our apps out of order and now USCIS doing the same thing.

Another member from CA has joined this challange. The member has contacted me and I have just now spoken to the member. The member wants to stay as an annonymous donor. So far he has contributed $1500 over the past few months. This member has pledged to pitch in with some more money when the total contributions from other members reach the 30,000 & 60,000 dollar mark. Specifically, he will contribute $250 more when we get close to $30,000, and another $250 for the $60,000.

I didnot started this thread not blame anyone. Everyone knows IV is our only hope....sorry if it hurt someone.
All I wanted convey is that the current visa bulletin is an opportunity (just like jul 07), IV should try to take advantage of it. They made a mistake by putting in writing that USCIS can not estimate, lets use it to our full advantage.
Lesser mortals like myself can not do much...but surely IV core can.
IV core or state chapter leads are none other than "Once upon a time normal visitors to the website" - there are lot of members who are highly dedicated to the cause.
It will be great if people like you would not put yourself down and call yourself "less mortals". Even if you print out 25 flyers and put them in grocery stores - you have done something for IV. Contribute in every possible way. it is the collective effort that matters.
Join a state chapter and convey your willingness to do something - IV will know that you are there and can/will do what you can/will. Then IV can channelize your contributions in best possible way.
You are as much as any other member.

I edited the letter so please take a look at this version. Some of you'll have suggested I condense the letter to a series of questions alone - I think this is a good idea and will be more effective in capturing attention. I will prepare something in this format (but it will have to wait for the weekend).
For now, my intent with this letter is to ask that the ARBITRARY nature of the visa bulletin be put to an end. I am exhausted by the cycle of raised and dashed hopes when the visa bulletin moves forward and backward.
To those of you'll who brought up the issue of schisms between EB2 and EB3, please read paragraph two above. Let us correct this randomness before we tackle each of the issues that are making life so difficult for us. You could start by gathering your friends, co-workers and other EB3 applicants and put together your list of issues to be addressed along with solutions. My view is that if USCIS is incapable of taking care of the matter then we have to pitch in and suggest/prod/request/demand it of/from them.
Together we can do it!

There have been numerous occasions when there have been erratic movements in the DOS published visa bulletin dates. This, as we understand it, is owing to USCIS under- or over-estimating the number of applicants available for adjustment of status. And in the rare instances when the date finally moves forward by a substantial window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that??? Why bother publishing the cut-off date if approvals are to be randomly allocated???
We understand we have to stand in line and wait our turn. Each applicant is assigned a priority date which chronologically determines his/her turn for approval. To further complicate matters, once the I-485 is filed, a crop of other dates are issued by the USCIS – a receipt date, a notice date and a processing date. USCIS then takes the liberty to throw random rules at us – “Case adjudication is based on receipt date” “No, we process applications based on notice date”, “Actually, it’s the processing date that determines which applications are adjusted.” !!!
Please take a moment to consider how these conflicting statements and arbitrary decisions wreak havoc on our morale and psyches? No one, NOT even the USCIS, has a clue as to what exactly is happening in their processing centers. The USCIS has never been able to clearly state the exact number of applications languishing, excuse us, we meant pending, in their “service” centers! We, employment-based immigrants, are tax-paying, law-abiding, educated individuals contributing to America’s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:
1) Extended wait times at each step of the immigration process.
2) Lack of transparency on the part of USCIS (re: priority date, receipt date, notice date).
3) Lack of USCIS customer service – once applications are submitted to USCIS they disappear into a black hole. Barring a website where one nominally can check one’s case status (but which in reality remains static for months, even years!) there is no concept of updating an applicant on where his case stands. And this is despite the applicant paying immigration fees that often run into thousands of dollars over the years. We are simply expected to wait in a complete void of information, for however long it may take, until approval.
4) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).
While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled – we are bound to our sponsoring employer from the start to the end of the extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later. We want USCIS to be accountable to us, its paying customers.
We request you to lend us your ear and address these issues so that we are not subjected to them in the future.

I am EB3-I (pd 02 retrogressed) but was interested in this discussion so i emailed my lawyer about it. She said, historically the last month of the fiscal year has the most approvals as they try to clear as much as they can. You will see a lot more approvals from next week or sept 2nd week.
As you guys may already know. When a 485 file is with an adjudicating officer, h/she then is able to request a number via an online portal from the State Dept with the relevant case details.
I am hearing that for the last few days when EB2 India/China numbers are requested, instead of granted or not, the officers are getting a "pending" status report. They can't adjudicate without the number being approved from the State Dep't.
The same thing is not happening with ROW cases. Of course all of this is ridiculous and unfair but judging from last years events, I suppose we are to expect this. So it appears that the state Dep't might be doing some internal calculations. Not sure if they are trying to get info back from consular posts as well before they release the rest to the service centers.
However what is clear is that all is definitely not smooth with the communication at this time. Hopefully they will get it together and in the end not waste numbers. NSC was really slow off the mark earlier this month and those of us with old pending cases there, appear to have been the losers this rounds.
I'm praying they have numbers left over for next month. Based on what we are seeing they seem have gone into ramping down for Aug. already.

I just want to generate enough internet chatter so that the issue of substitute labor will come on CIS radar. I know for sure that a huge fraud was perpetrated during July 07 fiasco by some unscrupulous consulting companies who sold pre-approvevd labors like frozen pizzas. Just heat and eat.
And I also know for sure that IV has gained enough publicity that CIS folks might be tempted to check it now and then. May be they will take notice of this thread and start investigation of all the subst labors.
I surely am pissed as hell on somebody who came to this country in 2007, and got his/her GC by paying money for some 1999 pre approved labor. I will fight on.

I would not believe on hearsy and rumors. It can only be verified after talking to USCIS top officials.
