On March 12, 2002, the House passed such an extension. Section
245(i) of the Immigration and Nationality Act was first enacted as a temporary
provision in 1994 and has been extended several times since then. It enables

What does it mean that EB2 numbers became unavailable as of Aug 21st? !!!!!
The Sept Visa bulletin (http://travel.state.gov/visa/frvi/bulletin/bulletin_4328.html) states that India EB2 cutoff date is 01 Aug 06 !!
If the visa numbers are indeed exhausted, then, the Sept Visa bulletin will be INCORRECT ! and the USCIS/DOS has to redact the Sept bulletin !!! Sounds like another fiasco brewing to me ! Call it EB2-I Fiasco ! You heard it first here. :)
Would be interesting to see how one can legally corner USCIS with proper evidence that they bungled up. They could always keep all cases in pending state , saying they are still processing/waiting for data, examining details etc, and not have to approve any EB2 cases in the month of Sept..... But would be very difficult to hide it from public and AILA etc...
They could then wait until Oct so new numbers get allotted, and then they can adjust EB2-I cutoff dates more carefully at that time.... gimme_GC2006 pray to god that , come oct bulletin, EB2-I does not retrogress beneath your PD ! All my best wishes to you.
Just noticed that EB2 cutoff for EB2-I in Aug bulletin was 01 Jun 06 !!!
And in Sept bulletin they advanced it by two more months to 01 Aug 06 !!!!...But now their systems show that Visa numbers are all exhausted even before we enter Sept !!! Holy Cow! :eek:
This would expose their blatant lottery mechanism that they employ to simply advance and then retrogress PDs without the simplest of clues as to how many cases they have pending and could be processed
This would also explain "cut off date not established" that the IO quoted as the reason.....
The visa numbers exhausted midway thru the month of the bulletin...so the system went into some init mode, waiting for next cutoff date to be established. But this time, come sept, the system would again see a valid cutoff date (actually a progressed date!!) , but NO VISA numbers !!

I think you should consider accepting stories of those you have yet to start their GC process. This gives another perspective, to tell people that even those who are highly qualified and experienced are in two minds whether to file for GC or not. Why this thought? this is because the delays and long wait acts as a deterent. End of the day, if these people are already frustrated at the onset, then they may decide to leave US and seek opportunities elsewhere, leading to loss of such valuable talent to the US. This was explicitly highlighted in yesterday's Judiciary Committee presentations by the four Economists.
While accepting stories from those waiting for GC, please also accept stories from those who are apprehensive of filing due to the delays, hence conveying a reason that US risks losing highly skilled workers should these circumstances continue.

I completed my MS in Computer Science from US around 6 years back, was on OPT for a year & thereafter moved out of US & came back to my home town. Have been working here for 6 years now in the software field & have now applied for H1B under masters Quota. Was wondering if I am eligible to apply under this quota as I am neither a fresh masters graduate nor have any status in the US. Also, my lawyer has only filled out the I-129 form. Is there any special form that needs to be filled out to be considered for Master's quota?

So why bring it up at all? l have lived in Texas in hispanic majority communities. I havent met any who want california or texas to be a part of mexico. If we start bringing history into it, then the only people who should be here are the native americans.

I also had same FNU problem.
In my passport Surname was empty and Give Name was my First Name + Last Name (which was actually my surname). I didn't notice this really till I got my first H1b Visa stamp. On DS Forms you have to fill just like in passport.
So my first H1-B visa had
Surname : First Name + Last Name and
First Name : FNU
I had my name proper on my first I-94 card( since I filled it) so luckily I was able to take by First DL in my proper name. DMV initially gave me trouble but when i showed my other documents including Birth Certificate they gave me the DL (NJ) with proper names
To fix it next time when I went for vacation back to India I went to issued passport Office and they stamped be an observation in one of the inside pages which said the name should be read as
First Name : My First Name
Last name : My Last name
Then when I renewed my H1-B later I properly updated my DS forms and my name came fine in second H1-B stamp .
So far no problem till now. I am hoping to fix this issue permanently in my renewal passport which I need to take in 2010 and forget about this forever.

However, in the event that USCIS received more than 20,000 cases that would qualify for this exemption on April 2 and April 3, USCIS will first conduct a computer-generated radom lottery to select 20,000 filings for processing, and those filings that are not selected will be subject to the FY 2008 cap and must be considered in that random selection process as well.

I applied for passport renewal (Chicago consulate) without name change form. In the Online application, I splitted the name as needed (earlier my name was under Given name). The renewal passport was sent to me with the way I entered the name (splitting) without any additional forms or affidavits.
