Everybody is trying to survive in this world ..diff people react differently to same situation..lying on resume/achievements is not illegal(reason y no body is prosecuted because of this fact..they are simply denied that benefit) however its unethical ..but iam not here to preach ethics.

My point to say all companies lie/manipulate things to certain extent..desi consultants atleast dont deprive lives like other BIG companies where shareholders are kept in dark until they realize that company is no more worth anything.
Iam not supporting any malpractises are anything anyways this is not a criminal thing its just immoral ..however if theres a loop hole and people want to chance it its upto them. They will be appropriately denied if they are caught, However its not like they are killing anybody.
Finally what do you think when even govt is planning to make illegals legals ..its respecting peoples wishes against legal things(ofcourse they get benifitted)Humanity/compassion is number one..rules are for our well being ..they are not hard and fast. Check for your reputation here i think it says some thing.

I received the exact same Email notice from USCIS as you on Sept. 28, 2007. I'm confused! I got my H1B 7th year extention approved in Feb. 2006. What happened to this case?

Was just watching Late Edition on CNN..with Arlen Specter and Chuck Schumer.. Specter did mention that he expects the CIR to be passed in the next few weeks in the lame duck session by the house.. infact he mentioned that the conservative outgoing speaker Hastert in favour of this at this time..so house might pass this now..with the senate already passed this..

Has any of you guys heard of "Follow to Join". I believe that if you are "legaly married" before filing I-485 then you should be able to bring your spouse in whenever your GC is approved. If your GC is not approved by the time you get married i think she should be able to come in under H4.
Not before filing I-485 but before your I-485 approval. You are safe even if you marry 1 day before approval.
I'm in a similar situation but more complex. My fiancee was in the US on J-1 visa and had to go back because of 2 year Home residency requirement. I have e-mailed my attorney but she's on vacation until next week. I have my 140 approved and am not sure what next step is as my fiancee's j1 2 year HRR is not up until Jan 2008.

I called the local senator's office (Maryland) and they couldn't give me a response. They claim that they don't have access to the information on a bill status if it is a federal bill. But if I call the representatives from California, the office asked me to call my local representative for information on bill status!
The only house bill with a Senate version is HR 6039 (26 co sponsors). However the corresponding senate version S.3084 only has 2 co sponsors.

EB3 I is still very unfortunate... I guess this is how the melting pot works... correct me if I am wrong.
Out of 140K Visas 7%= 9800 is assigned to India (All Categories)
Out of 9800 - First EB1 then left over EB2 and Then leftover to EB3 :(
From over all left over of 140K - First EB1 then left over EB2 and Then leftover to EB3 (all other countries) - Left over (EB3 China) - Left over to (EB3 India) :(
EB3 India is lowest on the FOOD Chain!!!

Are you working for someone else now and your own company is on the side?
I have wanted to start some business on the side, but thought that was not possible without a GC.
Can you share your experiences on how you did this?

Here's what i did. I enrolled myself as a part time student into an accredited college to pursue MS degree as soon as i filed my LC for GC in Feb 2002. This is what i thougt when my GC papers were filed.
By the time i complete my MS degree, i would have my GC in hand. But i completed my MS degree in Dec'04 while my LC was still rotting in DBEC.
Finally when LC was approved in Aug'05 and i thought of starting my own company before filing I-140. But i filed my I-140 papers in November 05 and started my company in Jan'06 along with one more partner who has GC.
My I-140 was approved and at the same time our own company completed our first overseas transaction.
Now i am waiting to file my I-485. Now i am thinking of doing PMP.
Note: 3 good things happend in the meantime since feb 2002.
I got married and i have two kids.

Did you keep new filing fee also? When I spoke to custumer service by 800 number call, she said you have to keep new check and original sealed medical along with duplicat filing.Wish you all the best!

485 Filling: 07/12/07
Receipt Date: 08/17/07
Got EAD, AP approved. Just last week I did my finger prints.....
I don't where I am and what would happend to my case....I am planning to change my job using AC21...is that going to impact anything to my processing????
What do you thing about the time frame for my case based on my PD????
Guru's please advice....as I am planning to chnage my job in March or April/08.....

If you have health insurance (which I doubt) go to some doc. and get some life injected. That will certainly help you in your current situation and you may be able to jump to EB1.:D

I think it all boils down to how desparate we are for GCs, many people here on H1 just want to count their valid H1 visa and multiply them by thier montly savings,
but Irish and many illegals itz a do or die situation they are smart people to knock on law makers door, before law-enforcing people knock on thier doors
If they werent desperate, they wouldnt be depressed due to BECs. The whole point of being depressed is because the validity of H1 is only as long as the job is valid. If economic recession hits and there are massive layoffs, even if you are in your first year H1 with 5 years remaining, you would be out of status on your way to becoming genuine illegal. And if you are in 7+ year of H1, then ofcourse you are walking on thin ice.
Trust me, there is desperation out there.
The problem is... The legals think way too much and analyze too much. The illegals get 5 minute guidance from someone on how to talk to lawmakers and they just do it without delving into the "Enemy of the state" kind of movie fantasies.

USCIS can't cash the checks. A check submitted with AnY application can only be cashed if and when the agency decides that the application can be accepted and processed(initial processing.)

another common tactic is to bounce checks on pretext that signature on check does not match that on signature card.
one more is to freeze the accoutn for inactivity > 90 days.
I have been victim on more than 1 occasion for each of above tactics. Each time its annoyance ( writing letter. nothing gets done online), fees charged and increased blood pressure.
Unfortunately switching costs are high due to time taken to open new accounts and there is no guarantee that others are any better.
You are right. I was also a victim of account being frozen. It is really frustrating to see that your account has been frozen when you have to urgently send money. They do not even notify the customers before the account is frozen.

You're welcome. Even while we all suffer due to the retrogression, most of which is out of our control, I believe we can still remain positive in areas over which we do have control, like our sense of humor and ability to get along with everyone by agreeing to disagree in a civil manner. Unfortunately this forum of so called "highly skilled" sorely lacks it. Every disagreement/debate becomes personal and quickly dissolves into a shouting match. It's really sad. We need to learn to be happy for others who are more fortunate and sympathize with others who are less fortunate. We don't have to be highly skilled to be that...just human.
