Here is why it will not happen on the first 3 or 4 days atleast.
This is not like H1B, which was hyped around for 2 months and forced every one to file on Apr 1st. More over it has a cap of 65k on it.
The most imp thing is there must be some rationale or logic (other than for fees etc) behind how they could make every category current. Some of you might know that DOS gives USCIS visa numbers quarterly. It means that the final quarter quota has not opened yet. The final quarter quota for EB1/2/3 is around 22000 (approx 7500X3). The EB5 leftovers ( conservatively 9000 , see 2006 stats) will also be added to the EB1 and possibly down to EB2/3 . The total number of visas that will be available to USCIS on Jul 2nd (first fiscal day of final quarter)is 31-33,000. The per country limits are relaxed in the final quarter so that unused go to the over subscribed countries.
DOS has to be utterly dumb, insane and ludacris to make every category current, if these 33K are the only numbers available. If DOS and USCIS has statistics for the first 3 quarters ( first 2 quarters + 2 months of 3rd quarter) telling that all the visa numbers released were in the previous quarters were consumed 100%, they would not make it current. That kinda tells us that the numbers allocated in the first 3 quarters were severely under utilized. How severely? No one knows as DOS does not do per quarter statistics.
More over, If its written into law that DOS can only issue VB once per month, and cannot update it during the month, they cannot do a damn thing. If it's not, it comes down to the implementation and interpretation of the agency. USCIS and DOS can release an updated bulletin if they get an over whelming filings for EB 485. Again, there is not enough time for USCIS/DOS to prepare like they did for H1, because the rumor has been out for 4 or 5 days. It might happen in the 2nd week or so if its not written into law.
The sad part is lawyers who are supposed to give concrete information are driving these insane rumors and the beneficiaries are going crazy. Looks like some lawyers have to understand that "Some key strokes can cause significant damage to their reputation"

Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

Please keep writing. As many posters already pointed out - economy is getting worse and changing job may become a necessity to many of us. We cannot afford to jeopardize our green card process - if our old employer withdraws I140. Our only way is to raise and get enough attention to this issue so something is done quickly before it becomes a norm.

I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don’t have a valid US visa. (Note: If you have AP, and don’t have a valid visa, you still need a TV).
I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don’t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).
Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the “I will kill you right now” look on my wife’s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).
It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.
I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don’t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the “good feeling” that you experience during the days leading to your trip.
I haven’t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.

They even fingerprint you during the transit and they have special baggage scan at India when you return. But you know what things have changed. No body cares now for them when they come to visit India. This December when I was at domestic airport(small city), the porter came to me rather than going to a firang lady. Reason : desis give more tips now, like give 100/200Rs and the goras pay 1 USD :) and they know the maths.
Other incident, before boarding , a firang missed her baggage tag and when security lady asked for it, this firang was fuming and said it's their mistake. Now this lady cop, in her simple English said, Madam, please get out of this line, go to security check again, and get the tags, otherwise you won't be able to board the plane.
No one treats them as VIP any more back in India.

I am in the same boat. My employer decided to file my case under EB3. For that, even the job position was in such a way that required only EB3. I had 7 years experience at that time. So it could have been EB2. That is fine, I am not sad about it.
My question is, since the original position had requirements that met EB3 and not EB2, how can you now justify moving to EB2 within the same company and for the same position?
You can't move to EB2 if both employer and position remain the same. I was promoted after working with them for 3 years!:rolleyes: Plus I have a Masters in Computer Science. My new position required more experience and a Master's Degree, hence qualified for an EB2.
Similarly, you can change employers and look for a better job. Then you can use the experience gained at the previous employer. But, ALWAYS, the job requirement has to state the need for years of experience or Advanced degree.

I also beleive, it is not the companies that are evil. It is the system that provides the incentive. And I am trying to take away that incentive.
First: I appreciate that you have not lost your cool yet despite all the opposition and rude posts against you. We will not close the thread as long as the discussion remains civil.
While I personally do not support the lawsuit idea because it divides the community in two parts and there are better ways to help the community. You can try to help positively for the greater good for everyone or run a negative campaign that will help some but hurt others who are also like you and are genuinely following the law. I also think it will be expensive and may not have a lifeline. As IV members we need to all work together to fix the system. This was the basis of founding IV. The aim was never to look after our own selfish interests and hurt others who are like us. We never discriminated between different EB categories or country of changeability. The intent of our fight is not to deny others their greencards and get ours first, but to allow everyone get their greencards. The intent is to have the system be efficient and work the way it was intended. IV core team has never made action items or ask lists in campaigns to suit their own selfish needs.
Now in this post you have raised a serious issue. If a fraud is going on, do collect evidence and file a complaint against it. If consulting companies are making money by gaming the system, drag those companies in your complaint. Help punish such people who are gaming the system. IV community will appreciate that.

My lawyer recommends to do independent filing without the spouse. He says you get 2 bites at the apple. When the dates becomes current,USCIS won't adjudicate immediately. We have time to add the derivative spouse later on.
Making AOS filing is not acceptable to USCIS and may trigger personal interviews and confusion. He also said take the spouse approved 140 and do an addendum to the 485 saying he/she is doing an independent 485 though we are married.

Hey Buddy, as far as I know when you use AC21 you loose your non-immigrant status but start working leagally. So changing H1 to the new company is not needed.
And as far as I can think, if you change your H1 to a new company at that pont it might even affect negatively on your green card process. Please check that with a lawyer.

If possible ask your company HR reps (and coworkers) to make a call too, it will help. Call by the company will make an additional impact. I have asked mine to call. No harm in shooting off an email.
