The short answer is most republicans voted yes for the senator Cornyn's bill to recapture the unused employment -based visas from previous years and almost all Democrats voted No (except Murray democrat from Washington voted yes for the bill. I guess Microsoft does have influencial power on the senator from Washington state)

``(II) The visas remaining from the total made available under subclause (I) shall be allocated equally among employment-based immigrants with approved petitions under paragraph (1), (2), or (3) of section 203(b) of the Immigration and Nationality Act (and their family members accompanying or following to join).''.
(b) H-1B Visa Availability.--Section 214(g)(1)(A) of the Immigration and Nationality Act (8 U.S.C. 1184(g)(1)(A)) is amended--
(1) in clause (vi), by striking ``and'' at the end;
(2) by redesignating clause (vii) as clause (ix); and
(3) by inserting after clause (vi) the following:
``(vii) 65,000 in each of fiscal years 2004 through 2007
``(viii) 115,000 in fiscal year 2008; and''.

Oh I forgot to mention.. I reached home at 11 and found several envelopes laying on the floor at my doorsteps..
I received my receipts, FP notice and EAD all at same time.. YAHHHHHOOOOOOOO
USCIS found out that I attended IV Social Event and sent me my EAD ;)..

Guys if the employer's lawyer is not giving you information regarding the I140 and you are going behind their back for this information is it really going to help you with portability? It looks like they are just trying to make life miserable for you and what guarantee is there that they will not revoke your I140? I140 portability does not work if they revoke your I 140.

Which center did u visit in PA?? I'm from PA also DL expires 9/30/07 along with H1..
PennDot Issued 1 year driver's license for both me and my wife. We took H1B 8th year original receipt notice, original employer verification letter and passports. PennDot issued 1 year license based on that. One of my friend who is on H1 went to DMV office to change State from TX to Colorado and they gave him a case number asked him to go to MVI office for immigration status check in Denver...

I agree with both the ideas.
In fact the idea of the banner with 'Waiting for X years' is fantastic ..
That would be an amazing sight where everyone holds placards that say since when they have been waiting.
If it's even 400 people .. we have 400 people saying look we've been waiting since 5,7 or 9 years.
It's also important to get in heavyweights like either local folks like Google HR head or any public face. Google has always supported the Immigration issues .. since they have problems because they couldn't hire folks when the h1 lottery happenned.

Was there a bill to create this category or this was decision taken by the USCIS.
Its a good move, I know that this initiative was started by an Officer from US Army whose interpreter was getting death threats for helping the US. When he saw that it was not an isolated incidence he started lobbying the state department to create a separate category. I have been following that story for a couple of months, but was not aware that a bill was passed to create a new category or visas. (i am sure, that USCIS cannot take a unilateral decision to add more visas or else why would we be begging for recapture bills)

I think that is an Open category and anyone who can show that their life is in danger in their Homeland can apply...For Iraq, since tehre are too many, they may be limiting 5K per year...

I think you need a second opinion from a lawyer, no one here can really help you (unless he/she is a lawyer).
If your version of the story is really the absolute truth (assuming there is no wrong doing on your part) then you should fight, the system is fair (I'm sure people understand language barriers) and I'm sure judgment will be in your favor.
Just a word of caution... Don't underestimate the intelligence of people making the judgment, they deal with such cases everyday - they can easily smell a rat.
GC is not life, the trial verdict can change your life for better or for worse (specially if there is jail time involved).

Just a word of caution... Don't underestimate the intelligence of people making the judgment, they deal with such cases everyday - they can easily smell a rat.
GC is not life, the trial verdict can change your life for better or for worse (specially if there is jail time involved).

Looking at this scenario, it makes all the more sense to move to Canada.
Unless US starts skilled immigration, it is destined to become a 3rd world country. China would overtake it as the largest economy.
It is estimated that in about 20-30 years the worker:retiree ratio would be 2:1, thereby having a large tax on the employed.

A very horrible psychopath who has proven himself to be a loser all his life has given me a red with the following " hehehehehhehehehehh" words for my above post.
My message to whoever gave me a red - u r such a loser.
Invoking AC21 is easy, but you need to know what you can expect and how to resolve it
(1) If you decided to change to new employer using EAD - there is nothing you need to do. Just join and work.
(2) As employer is asking what they need to do - tell them they need to provide an AC21 letter of support - you can find various formats on the web.
(3) Your new job must be in same or similar category.
(4) Call customer service to verify your address on file - also hire a personal attorney and make sure they file g 28 and have them on file too for USCIS communication
(5) Your AC21 letter may/may not reach your file depending on the service center, officer and a lot of other factors.
(6) Usually most AC21 cases go through just fine unless your ex employer requests a revoke on i 140 - in such a situation you may get an RFE, NOID or a straight denial on 485 - nothing to worry about - you can resolve all these and you will find yourself back on track.

There are favorable indications from the industry that they will get increased H1Bs. There is hence a strong belief among many lawyers that the H1B lobby will provide some relief. But we need to meet lawmakers so that they don't forget about the Green cards.
If you live in NY state, please contact bottlemani or myself. We need to organize ourselves before meeting the lawmakers. We will also have to take the trouble to drive to their offices. If we don't do this, all these pessimistic predictions will come true. Believe me, meeting the folks in the offices of the lawmakers makes a huge difference.
I agree with you qplearn and botlemani. Thank you for making this effort. It is sad to see that only few people have signed up for state chapters. there are very few on your NY thread even though we have several members from NYC and NY state. We all need to change our attitude and help each other in this common cause. If we all think that someone/others will do it for us, then nobody will do anything and we will all continue to wait for our greencards for the next several years. IV is providing everyone an opportuity and tools to help and work. IV core is working overtime to get it done. We cannot succeed if we do not get support from each and every member.
