    The applicants of I-485 are expected to experience delays in obtaining the green card for two factors: One is the visa number cut-off date movement in the Visa Bulletin. The other is the processing delays within the USCIS field offices, including Service Centers. Accordingly, "current" of their visa priority in the Visa Bulletin may not assure them immediate adjudication of their I-485 applications depending on the I-485 workloads and the processing backlogs within the agency.
    The following statistics reflect a steady increase in the number of I-485 applications (including family-based and other cases) during the months before the July VB fiasco hit the roof as is shown in the following table:

These cases will have to be processed and adjudicated generally in the order of receipt in each queue for those cases whose visa numbers will become current in the future. The new statistics for July and August 2007 will add a body temperature to the new I-485 filers with the realization why it would be so important that the political leaders and the Congress should act and pass a legislation to reform employment-based immigration system coming fall. Without such legislation, their journey for immigration will remain intolerably painful.

    If they get continus apps from Eb1 in each quater how can they set up cutoff date ? ( I mean their demand with in range of supply ) .. isn't that illegal ?

    Most recently, the cutoff dates for EB3-India was set on Jan 05 bulletin and for EB2-India on October 05. Not sure about the other categories, but it seems to me that they either do it at the start of a quarter or at the beginning of a fiscal year. Based on their comments, it does seem like demand is starting to exceed supply for those EB1 categories.

    I feel like EB1 India and China will have cutoff dates beginning October 09.

    You are suggesting how to avoid it rather then try to acknowledge that there is a problem in the wording of AP. By problem, I meant the whole dynamics has changes over the years, so, its time they change to reflect today's reality.

    There may not be everyone who would continue to be on H1 while their AOS is pending.

    In light of the AC21 provision, this is pretty common - people change jobs using EAD and are then on AOS. Looks like the wording on AP was ignored when AC21 was being made into law. This is now biting some of the travelers.

    Could the AP wording be changed using an administrative fix by USCIS/DOS rather than a legislative update?

    first of all congrats. but i have a question.

    you said you are EB3 ROW (Bangladesh) but you applied your I-485 on June 29, 2007 with a Priority Date of Feb 06.

    But on June 2007 (just before the VB fiasco) the Visa Bulletin for EB3 ROW was caught up to June 05 (http://travel.state.gov/visa/frvi/bulletin/bulletin_3236.html). But your EB3 ROW PD is Feb 06. So how is that possible?

    Only EB2 ROW is current. Are you sure you are not EB2? You can confirm this by looking at your 140 notice. Otherwise you must have sent out your application June 29 (Fri) in the hope of reaching USCIS by July 1 or 2 (Sun or Mon). That's the only way I could make sense of this.

    Either way man, your stars must all lined up or something man. You are indeed very lucky.

    the reason I am pestering you is becoz I too am EB3 ROW with PD of Mar 06 and I filed on Aug with an approved 140. I am now kicking myself for not mailing out June 29 Fri.

    Technically, you are right. But on the other hand, it was at a time when one had to wait at the most 6 months for AOS.
    But, for people from India, on EB categories, the wait is not months, its in YEARS. So, its irrational to go by whats written there.

    On the other hand: I think we must request USCIS to recognize this underlying problem with EB folks that are primarily from India. They must print an exception on the AP for India and exclude the wording "for emergency purpose only". I don't know if USCIS has the discretionary power to amend minor changes.

    If AOS takes many years, then keep the non-immigrant visa, so that no need to worry about AP.

    Solution is give away GCs to all pending labours/140s/485s. Then nobody works for lesser wage and so we can equally compete with US citizens. They created this mess and so their fellow citizens are facing the problems.

    Also, all anti-immigrants are publishig the wages mentioned in H1B LCA's when comparing the salaries with US Citizens. But thats the wrong approach. Employers always mention the minimum wage that can be given in LCA while applying for H1. But the actual salary is always more than that 90% of times. So, these anti-immigrants don't know that actual salaries paid to H1B employess are far better or equal to salaries given to them. So, thats what they are crying. Also, they are crying because of they are not able to copeup with the technology changes and compete with us. Employers put the minimum allowed wage because of avioding high-pay when the employee is not productive or not on project. So that they can pay the minimum wage as per rules.

    If there is a free flow of immigrants, why the wages will go down? These are all because of corruption at govt side. So, do not blame H1Bs. They came here all the way crossing thousands of miles, leaving their parents and in-laws for the sake of getting better life. This happens everywhere and everytime.

    Also, when we say immigration system is broken, it doesn't mean that it is completely broken and replace with a new system. Just increase the EB and FB caps and per-country limits. thats it. It solves the problem. Do not revamp whole system. Existing system is fine and only thing is not enough visas available as per demand. So, solve problem by correcting it. We need to convey this to senators.

    Finally, there will be flaws in any system. With that some people has to suffer. But if majority of them doing better and contributing to the economy, that will be good. Do not care for those few people, and destroy the lifes of majority of people.

    What do you mean by upgrade to premium? I dont think you can change the option by simply upgrading. You need to file I-864 to change to consular processing.

    There are a few options:

    1. If you have chosen consular processing, ( I am guessing you have not), you can file I-485 and amended I-140 at any time PD becomes current.

    2. If you chose AOS on I-140 and the I-140 is approved, some consulates accept attorney certified I-140 provided you pay the fees usually payable to NVC. Expect 3 months of delay in getting an appointment though.

    Pros & Cons:

    Consular:
    You get your GC as against EADs endless loop.
    You have to be with the same employer for atleast 180 days since the time you get your GC and you enter US using your GC.

    AOS:
    You and your spouse both get EAD. NO need to travel to foreign country.
    You need to wait 180 days from filing 485 to change jobs (assuming 140 is approved, if not the case is more complicated).
    More time consuming and longer duration.

    The lawyers here will vouch for I-485 as it means more revenue for them. If you have a stable job where you are doing good and you are counting to get a promotion, etc go for consular processing instead of getting stuck with 485 process.


    Can someone please advice pros and cons, keeping in mind the forward movement of priority dates could be just for the month of June!

    My 140 is still pending in NSC I have the option to quicky upgrade that to premium and then go for CP, what would be the course of action?

    Also what are the wait times for CP in Mumbai India?

    There are people from India with PD 2005 whose I-485's have been approved lately.

    It wont happen again. after encashing I485 checks USICS will start I140 PP again to keep cashing money. once I140 backlog will be done then they will earn from EAD renewals.

    In trying to play the "devil's advocate", you still did not answer my question. i.e. "Let me ask you a simple question. What CAN be the "perceived benefit" from a rally like this that would make you think that it would be worth attending? Is it something like a guarantee for a GC in 2 months or a bill that passes next month that does everything we legals want? What is it?"


    i already have my GC but i share the pain and frustration of folks who do not..if a 7 month wait process for me was frustrating - i can understand what a 7 year process would be to others like me...

    My first reaction. You're kidding, right! Ever worked in marketing/sales?? When you go to sell your product or service, you try to sell it from the point of view of the customer. In this case, what the benefit can be from the point of view of the US govt and US economy. Yes, our primary aim is to get our GC's in a reasonable time frame. The slogans and messages are in support of these ( By the way both happen to be true).

    Incidentally, even the spark in Gandhi was ignited when he personally was insulted and thrown from a train. My point being that it is only when we personally are affected by an issue that we react to it. The reaction ofcourse differs based on our own individual character, personality and other traits.

    pl think about what i wrote objectively......and dont jump on me just because i am playing devil's advocate
