I saw this link Murthy's email too. The total pre-adjudicated cases in the chart is matching with the total in the document. Well now there are more un-answered questions:
1. Does all other pending 485 include employment based ? If yes what % are employment based ? Obviously we do not have any country specific data on these.
2. Is there any way to know whether individual case is pre-adjudicated or not ?
USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.
Thanks a lot for staying on top of this and posting your analysis.
I dont get this - the PDF clearly mentions that the table is for ALL PENDING EMPLOYMENT-BASED 485s. So that means: -
1. It does not include any Family-based 485s.
2. This is not a count of just pre-adjudicated cases - this is a count of ALL PENDING CASES.
3. And since this is a count of ALL PENDING CASES, it also means that ALL DEPENDENT CASES are also included in this count - all DEPENDENTS HAVE TO FILE THEIR OWN 485s!
Sometimes I just wonder, if most people here on this board have an illness or over-analyzing everything. It is so simple if you just read what is stated and take it at the face!

Hi All,
My friend whose PD is Dec 30 2004 - EB2 - Texas got his approval email. But he is already in india and travelling back this Oct 12th.
He already has valid Advanced Parole with him.
He wants to if there are any issues for him to enter at port of entry?
Any documents or print out of approval etc to be carried with him?
Does he needs to tell the office that his GC got approved?
Please help.

hmmm.. i had noticed that for couple of persons whose approval was done early got their passport immediately but in you case it is not true!! so I guess it is difficult to decide any pattern.. (i am not sure whether it is related to H1 approval of any specific center.. if we decide some template and ask everyone to post all such details that might help but i am not sure whether everyone will follow that template...) was there anything complex in your case which you think might have caused this problem?
my H1 approval was done in April 2007 and I have my appointment in Feb 1 st week. I will post my details as soon as my interview is done.. Good luck to you..
Thanks and good luck to u too !
I called DOS and they r just saying that they have't gotten to verifying my data yet in PIMS coz it's not yet available.. it's been a month 13 days and counting since my visa appearance..

Let me add my 2cents here.
This came up when I was discussing this topic with my lawyer friend -
Person can still file for GC when he/she is at school in eb3 and after finishing school, he/she can file another one for EB2 and can port the date to earlier PD, just like eb3 person who started work instead of going to school. Remember, GC is for the future job and person can not claim that he/she needs to be employed in order for GC to be filed.
Law does provide equal opportunity to both for PD recapture (aka PD porting).
SunnySurya -
I suggest, you should seriously consider discussing above legal point with your lawyer. I hope you agree with me that in legal court, rationality wins whereas emotions lose.
Good Luck!
Disclaimer: I am green card holder for 6 years and personally this issue does not affect me.

Even though I'm EB2 and still waiting for GC, I oppose this. This is not fair.

I have sent the letters today to WH and IV.
I have also sent group emails to my batchmates from my engg college asking them to join IV. I think everyone should do that - this will help IV to Increase its Memberships.
I had one more suggestion too - (this has recd less support in the past).
we need to put in a statement that many legals are not buying a house because of the uncertainity in the GC process. even the congressmen will be more patient with our cause when we mention housing.
I doubt if this is true. There was a poll created a while back that asked this question to everyone, and fully 50% or more had already bought a house even though they had not even reached the 485 stage. I personally would not wait for GC to buy the house. If the status quo remains, it will probably be 5-6 years before they even take up my case for consideration. The housing market would certainly have recovered by then. Barring local minima and maxima, the overall trend in the housing market is always of a somewhat steady and gradual incline.
Just my 2 cents.

You are right! It seems USCIS has an "acceptance" probem...
Can't accept
1. Legitimately filed I-485s
2. Affectionately sent flowers
3. To top it all, its own "ineeficiency"

Actually, I'd say (especially for Stewart and Colbert) that they'd be poking fun at the right people
Seriously guys you would be taking a chance as to who they make fun of and even if they do choose Emilio Gonzalez it wont be sending the right message. I'm South African so I have no experience, but surely this isn't what the Gandhigiri message was all about anyway.

>> I disagree. By not reporting the fraud at workplace, it puts rest of workforce not at level playing field.
Hmmm.. Level playing field. You mean the field where you set the rules? UAW did that in GM - you know?
If there is someone who can do my job cheaper or better or more efficiently - by all means it should go to him. I need to then find something where I am good at. Thats what competition is! Of course - this "efficiency" can not come by illegal behavior. Illegal behavior (like the L1 fraud) has other hidden problems.
So on your question about "l1 fraud": by all means I am for reporting it. However, there is another overriding concern for ALL OF US - how will the economy behave? I dont want to worsen things by "reporting fraud" at a mass scale right now and create trouble for companies that are already suffering. I will do that when that will be beneficial for the US Economy (translation - "all of us - even citizens").
I am not for tolerating or condoning illegal behavior - however, I am all for moderating my responses and prioritizing the fights. I am also for not behaving like the UAW members.
>> You are right. If you are not impacted by fraud, one will be least interested in reporting the fraud. Only when you get impacted, the fraud appears real and serious.
You are reading between the lines too literally - so much so that you misinterpret everything like the bible-thumpers. Impact "me" = Impact "us" = Impact "everybody in the US - including the US Citizens".
>> Taking your example further, due to budget constraints, the manager will be more inclined to replace workers to L1 workers to save cost. Do you want this? This will impact people in short term.
Same answer as the first question.
It's a pretty nuanced position. I hope I have been able to explain it properly.

Quote from the Bollywood article, thanks sertasheep! Should put a smile to the face.
In response to this event, Academy Award Nominee Vidhu Vinod Chopra, who produced the run-away successes "Munna Bhai MBBS", and "Lage Raho Munna Bhai" stated, "Mahatma Gandhi has influenced several personalities, including American Civil Rights Leader Martin Luther King, Jr. These young, law-abiding professionals have set out to strive for reform the right way- the Gandhigiri way."

I've been current since July, 2010 and got RFE on Sept 10, 2010. I don't have letter with me as yet to know about RFE.
Before REF, I waited for few weeks then tried followings:
1) Took infopass : Officer sent email to expedite.
2) Wrote to Senator: got reply they would get reply in 60-90 days
3) Sent an email via attorney to TSC: got automated response.
Then I got RFE after about 2-3 weeks of these attempts.

JUAN GONZALEZ: Now, Lou, youve been well known for years now, especially dealing with the issue of American corporations exporting jobs and criticizing that whole process of exporting American jobs overseas.
LOU DOBBS: Sure.
JUAN GONZALEZ: And yourbut also the criticism of it, that as Ive seen it as, oftentimes does not deal with the impact so much of what this globalization on those countries themselves. In other words, you criticize NAFTA for sending so many jobs overseas, but not with the impact so much that its having on Mexico and on these other countries that are the other end of this free trade.
LOU DOBBS: Juan, that may be because Im a television journalist, limited in my intellect, as well as my time.
JUAN GONZALEZ: Well, on this show, we dont have commercials, so we have a lot of time to get into the issues.
LOU DOBBS: The reality is that, of course, NAFTA is, in my judgment, at least deleterious to the interests of the Mexican people and to the state of Mexico. One only has to look at the empty villages in particularly southern Mexico to examine the impact of the agricultural policies within NAFTA. One only has to look at the maquiladoras across northern Mexico to see the impact on a society that is already 50% impoverished, education levels still where they were thirty years ago in Mexico.
But my perspective is an American one. And I wont presume to speak for Mexico, as Felipe Calderon does presume to speak to the United States for Americans on American policy. The reality is that NAFTA doesnt work for this country. It doesnt work for Mexico.
But I am not one of those peopleas Amy was talking about, my detractors. The suggestion Im anti-immigrant, for example, is absurd. I would support an increase in lawful immigration and have said so repeatedly and have no problem whatsoever with current levels of immigration, which, by the way, are the highest levels of immigration in the worldin fact, more than the rest of the world combined. We bring in more than two million people. But the issue is one that the United States does not have a foreign policy toward Mexico. Were paternalistic and condescending toward Mexico in our dealings with Mexico, both corporately and politically. And its time for that to change.
