4) Be positive in your attitude, improve your communication skills and dont act servile.
5) Most desis are hard working and responsible people - nothing should hold them back - not certainly the need for an image makeover.
All fellow desis take care and enjoy your life here - life is too short to be depressed about the green card everyday. Most important thing is you stay happy everyday - here or in India.

I think once the application is pre-adjudicated...that's it!! I don't believe USCIS will spend anymore time and resources to these applications again...until a visa number is available from DOS and they apply the number to the pre-adjudicated application....my 2 cents! I agree with what you say BUT they may open the file again (to verify certain things and not just assign it a visa) once the visa number is available (I guess that is what you are trying to say) ..is that right ?
BTW - I have not read the memo in detail ...it is a waste of time
I guess the 64,000 dollar question is - how to find out if your case is pre-adjudicated ?
in summary - it is a big big muddy and dirty mess ..no wonder the right word is that the system is broken and very less immediate hope for EB-India / China

Hmm, that sounds cool - consolidating the qualifications into a huge stack to make an impact. I second that.
This was discussed before and I cannot find it now..but here is an extension of the degrees idea.
1. Get everyone involved in the GC process to make a copy of their degrees/ qualifications/ certifications/ patents/ papers/ publications/ etc
2. Format it into standard size (perhaps A4)
3. Get a stamp on each of those sheets that says 'TRASH' or something else - maybe 'REVERSE BRAIN DRAIN' or 'KEEP TALENT IN THE US' - we can work that out.
4. Get each State Chapter to create a binder/ maybe more if we can get enough participation.
5. We can submit a copy of that to local congressman and senators. We can also put all states together and send that to the White House, perhaps.
This will take a lot of coordination from all state chapter...but it is doable.
Any thoughts???

if your PD remains current for at least three months in a row and everything else is clear, there is good chance you are out of the pipeline.
My PD is current for almost a year and Name check is cleared in July 2008.

He was always wanting to go back to India but because of the conditions of Indians, he was urged to stay back and help them, he actually went back in between and again came back to SA for a more organized effort.
The situation now is different. The Durbin Grassely bill lobbyists are basically doing what has been happening in UK where local population do not want Asian immigrants taking high paying challenging jobs in their own soil. They don't seem to care if these jobs go away because the effect will be long term and as such it is a known fact that in these days, we seldom see the immigrant community having a good cooperation, every immigrant feels that one less immigrant, it is good for him.
This has been happening in every country where highly skilled migrants take job positions in countries like Aus, NZ, UK, Germany etc..
The US system is harder to crack for anti immigrants than these countries. So they follow this slow bleed approach. On the long run their objectives will be met though it would force out high skilled jobs abroad.
One good thing is that developing nations must capitulate on this and make their labor laws good and also copyright laws and patent laws so that innovation and products are developed in developing nations and so called developed nations will bleed technology and innovation.

This is a bunch of baloney.
Whether this is a recession, a depression or a hyperinflationary cycle and economic wipeout, America will remain the pre-eminent world power in the next quarter century.
The US has the most trusted currency int he world(sometimes I wonder why, but the fact is it remains such or else its value should rationally be a lot lower right now).
It has the best universities and research centers, and remains a magnet to the worlds most motivated people.
It has the strongest military in direct face to face combat.
It has the largest, most well integrated, and diverse economy in the world.
Cultural differences while they exist are far less than many other democracies, mainly since this is a newer country built on diversity and tolerance. They have just elected Obama as president, if that does not represent the best of secular ideals, I am not sure what does. The US has a lot of cultural bonds in entertainment, sports, social programs like Medicare/Social Securities, Large corporations and brands etc that are remarkable cohesive forces.
This is a pure wish list from a bitter former KGB man, who is given a megaphone by an even more bitter Putin, who is still smarting from the disintegration of the USSR and wants the same for America.

What makes people think that USCIS has preadjudicated cases in the order of priority date. If they have preadjudicated cases from 2005,2006 and left the cases from 2003 -2004 then it is the same mess an d i can bet that knowing USCIS chance of this are very very high so even if your date gets current it is still luck whether you get GC ornot.

I would be as cautious in NYC as I would be in Mumbai, since my adopted town now, and my hometown in India are both not NYC or Mumbai! If I venture out into DC, I would be more cautious than I would be if I went out to buy milk in the 'burbs of NOVA where I live!

What if it is 3 + 3 ( 3 year Bsc Physics + 3 Year MCA) 10 + 2+3+3 = 18? I am wondering if USCIS would consider this equivalent to US masters? Came across a memo used by Nebraska Service center that says USCIS would consider 3+3 equivalent to US masters, but that memo was from 2006.

The way USCIS functions, I would rather see the movement of the dates back rather than forward...why?
This is the time when USCIS actually TRIES to follow FIFO: meaning tries to work on old cases. Last quarter is usually a mess and approval pattern goes to TB to BB (top of the box to bottom of the box).
So, It is a actually a good thing, if PD stays there or moves back; that will make USCIS work on approving older cases at this time.
It is also a good sign that DOS mentioned that "they are waiting from USCIS for pending numbers": that means, they actually asked for those!!!!!! AND USCIS is working on it (or atleast told them so). This has been the crux of all the visa number movements including random approvals. If this is sorted out somehow, it will be a great deal of improvement in implementing FIFO system to some extent. If USCIS gives that info to DOS, there will be someone (DOS) to ask USCIS: WHY DO YOU NEED TO MOVE PD FORWARD TO 2008 WHILE YOU HAVE SO MANY THOUSANDS OF CASES FROM 2000-2005 PENDING??

My wife did not say the real reason for embarassment, and also she did not think that serious that time. For me, I did not know the real reason until I was bailed out by my wife :(
DA knows that for them to win the case, they need your wife's statement on their side. And for you to win the case your wife will have to testify under oath. The attorneys are prepared on both sides to argue this case and examine and cross examine the case. Make sure you have a really really good attorney.
I hope you are telling the truth. If not why she didnt tell the police or you didnt tell police the real reason. Now the onus is on your wife to contact the police and DA and let them know the truth.
