Here is what you should do:
1. Print this memorandum

2. Take it and go for infopass.
3. Insist that they follow the procedures outlined in the memo. Do not leave until they do what they have to do according to the memo. They have to provide you a receipt that they followed the procedures.
4. Get your EAD within a week or so after infopass.

To put out a fire and to prevent it from happening again you need two things:
(1) Take the fuel away
(2) Take the Oxygen away
(3) Make sure you don't have any sparks flying around.
Immigration reform, whether for legals or illegals, needs massive support from the American people. Most of the people are in no mood to support a "reform" unless the president can stem the flow at the border.
To able to get any kind of immigration relief legislaton through, the president needs to work hard and quick at sealing the border shut. Time and again "the other side" has laid this as a pre-requisite to any immigration related dialogue.
I don't know why this is so hard to do. The border is there for a reason and it is the Federal government's responsibility to maintian its integrity, whatever it takes, National Guard, drones, US Army..whatever.
That being said, don't read too much into this "Thursday speech by the president". It is lip service, or as go_guy pointed out...political posturing.

AFAIK, Once you have a receipt number for 485, your 485 application will either be denied/approved. If approved, you will get your GC as a visa number has bee set aside. I 140 premium processing doesnt help you to get the GC by the end of the month.
talk to your lawyer to get the correct info about what happens with your 485 application with the retrogression of Schdeule A.

I was not optimistic about EB3 situation a while ago but the situation has changed, i think we are fast approaching the end of this dark tunnel and we will soon see light :)

My wife is apply for AP renewal. She has her AParole until oct, 2,2008. She is travelling to india this week for three weeks. Can she apply for renewal and travel to india. Is it legal or does it have any replications.
According to my lawyer, the person (in this case your wife) must be in USA until your wife's AP application is accepted. Basically your wife should not try to apply AP when the she is not physically in USA.
After the application acceptance, your wife can travel.

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.

EB1 is more qualified than other categories and is seen as someone who is in a better position to contribute to the national welfare of the country. EB3 is the least qualified of the three and is also the most likely candidate to displace an American.
And you think America should throttle the flow on qualified EB1 and be more generous with EB3?
EB2 is different however. Most EB2 are people who were EB3 earlier (like myself). For such people, there is a provision to upgrade to EB2 through interfiling - as option that is being heavily used even as we speak. So where is the problem? I am talking about a person (like 485mbe - the one who has posted next to yr post) who has a PD of 2001 ..I am not saying that they should give Eb2's quota to EB3 ..but they should try to pull the category that is worst affected..or atleast give EB3 something ..
my question to you is ..say in the year 2010, would u support a situation where all categories are current or at 1 year difference ...while a particular category (eb3 I in this case) is at 2001 ??.. even if you do ..my feeling is that USCIS will try to pull EB3 - I (if something like above happens)..but then they are just a govt agency ..and in the end they are similar to govt agency in India ..only difference is that maybe little better

I know for sure that local office send an e-mail to processing center, it is not in Nebraska or Texas, it is at National Benefits Center (MSC). Mine and my husband's status of EAD was "no decision" . The e-mail sent to MSC with request to finalize the decision. I did not take any evidence, I did not know at that moment that I could. But it worked and I had my EAD after 7 days to be exact.
