I recently got an RFE to prove that my Master's degree is a three year course (and not a two year program) because the degree and the combined three year transcript don�t specifically state that it was a three year program.
I have three year of Bachelor�s (BSc) and three year of Master�s (MCA) education, which was used to qualify for EB-2. I also have more than 10 years of experience in a related field.
Unfortunately, I only have a combined three year transcript with a list of all the courses completed as part of program (Year 01, 02 and 03) and not three separate transcripts for each year of the program.
I also have an education evaluation to prove that it is equivalent to MS in USA, which was submitted with the original application.

Here's a suggestion - instead of whining about the "unjust" treatment being meted out to you, go get yourself a PhD, publish some research papers, get a couple of patents under your belt, then go qualify for EB1.

I and many folks in this forum have seen very few approvals for this category. How come USCIS says that this category is over subscribing the visa quota. Why they are moving un used visas to EB2 (no offense) why not for EB3?

It's simple.. Find some one in your friend circle who wants to send money to india and tell him that you will transfer rupees to his bank account in india and ask him to transfer dollars to ur account here.

Is there any Specific date, I mean when AILF is filing the case...USCIS is announced they are gonna reject the applications..but did they rejected any single application?? We will come to know after 4 or 5 weeks abt our applications (As per USCIS rep)....I think there must be some time limit to file a case...and we dont have a base to file a case until they reject it.

The place where I work, people eat burgers in the meetings and we have a very small kitchen in our floor and there is no Cafetaria as such. If I had to put up with the burger smell, I expect my co-worker to put up with my Indian food smell too...

everyone loves their money....but think if nothing will change how much of your loved money you will spend every year to renew EAD and AP...just do the calculations and you will think that it is worth to part some of our loved money..
No offense Nik..but dude my company actually pays for it..so no loss..in renewing EAD..but unfortunatly my EAD is not yet approved..so I am not yet there.....SAD

Well, I like you because you are just a straight shooter. If you are such a straight shooter then let me do some straight talk, so just catch this.
Your American mid-size company or Desi small size or super size company will get $180/hr but you will not get even $50/hr from the same client even when you go direct. So no matter how "highly-skilled" you think you are, your non-compete argument is not good enough for you not to be able directly market yourself, because there are gazillion other companies using BI, Cognos, BO, Informatica, Datastage and every similar crap. You can impress a few people by naming some technologies that maybe hot but they don't mean a &hit if you market them yourself. Here is why. A lot of people blame the lack of GC as a reason to be exploited. That is part of the problem. The other part of the problem is that most hiring managers in large companies get commission from these small, mid-size or large American, Desi or European consulting companies. That's why in most cases they always hire through one of these companies. They will not hire directly because the manager thinks you to be a stingy desi, and if he hires you directly the hiring manager will not see a dime, so why will he hire you directly? This is a big cycle of corruption and everybody is part of it including lawmakers who get contributions from lobbyist/representatives of these small, mid and large size companies. You think lawmakers don't know what is going on? You think client doesn't know that you make 85K when the middle company get $180/hr? You think the big-bosses at the company/client doesn't know that the hiring managers are getting favors from middle companies? You think lawmakers doesn't know that immigrant worker waiting for long delayed GC is bonded to an employer that buys employee retention insurance policy for the employer? They all know it. But you see every player in this movie, you, your hiring boss at the client site, the middle company, the lobbyist, the lawmaker and many more, they are all being paid from that $180/hr which you think that you are entitled for because you know Oracle BI and Congnos. Do you realize how easy this ETL, Informatica bull &hit is but somehow you seem to think that its worth $180/hr. If you are so smart answer this, how will you avoid using two bitmap index on two columns in two tables when used in the same query? And why would you want to avoid using both the bitmap indexes? Try to move up in the ladder
Keep updating your tech skill
Diversify to more ( but related ) skill.
Add niche like PMP / Six Sigma.
Top of all , little bit of Luck , to be right place at the right time .

I am talking about a person (like 485mbe - the one who has posted next to yr post) who has a PD of 2001 ..I am not saying that they should give Eb2's quota to EB3 ..but they should try to pull the category that is worst affected..or atleast give EB3 something ..
my question to you is ..say in the year 2010, would u support a situation where all categories are current or at 1 year difference ...while a particular category (eb3 I in this case) is at 2001 ??.. even if you do ..my feeling is that USCIS will try to pull EB3 - I (if something like above happens)..but then they are just a govt agency ..and in the end they are similar to govt agency in India ..only difference is that maybe little better

I spent some time analyzing the draft and I conclude that status-quo is better as the Law-makers will continue to feel the pressure for a "true reform". The bill in current form does more harm than good and this is also evident from press reports. It is also evident that there aren't any known amendments that would change the face of this bill and it appears that the process we are currently seeing on the senate floor is a staged drama. One must remember, if any bill is passed, then there wont be any more reforms for years to come. Just my opinion.

One thing to remember is that reporters take snippets from hours of interviews, and then their editors edit the article down further.

Does your job requires you to have a Master's degree (or B.S. with some experience)? If it does not.....then you dont qualify for EB2. There is more to it. This is just a simple illustration. Even if you are a PhD if you take a job that requires only B.S. then you only qualify for EB3. This is my understanding.

Agreed...it is personal decision...but for Indians...it is a difficult decision. The way India is growing....People who have lived here for more than 10years...are migrating back....i know a person who left...has warned me...just to earn and get out.....not good for kids future etc....

I keep hearing that "STEM will be exempt from the quota". What EXACTLY does that mean? Does it mean that:
1) STEM's can apply for 485 straight away if labor is approved regardless of PD?
2) STEM's still Cannot apply until PD is current, but after that no more waiting for the country quota

Looks like we are in minority :), I guess people need to be educated about legalities of the immigration system, just because one applies for a green card , or one gets a Green card, he/she does not become part of the country.
Please remember this folks, till you become citizens you are still representing your home country :), and BharatPremi mentioned US of A only expects that you don't indulge in any activities that the government lists as against the US of A, after all we are all here only because the country allowed us in because they perceive there is a need for high skilled labor, letting us contribute and at the same time benefit from this huge economy,we are at their discretion legally, and they can show us the door just as the way it was opened to let us in, just because you are here does not mean you can demand rights :) and call this your home country, that is what the illegals do. I am sorry for sounding so depressing, I witnessed a mass layoff at my company and a lot of my friends (Americans) who are very senior folks were let go, I was spared, somehow that is hurting my conscience, and I am not in a position either to voluntarily give up my job.I want everybody to be happy, and prosper, layoffs reflect the ugly side of capitalism, the weak and old are exploited.

Can you please provide us any link or legal constitutional document from any legal organization in India and USA which states that Patriotic Indian ( For the sake of argument Indian) should not apply for US Green Card ( Permanent residency)? Or for that matter can you legally proove that not applying for US GC is the barometer of patriotism towards India for an Indian?

Looks like we are in minority :), I guess people need to be educated about legalities of the immigration system, just because one applies for a green card , or one gets a Green card, he/she does not become part of the country.
Please remember this folks, till you become citizens you are still representing your home country :), and BharatPremi mentioned US of A only expects that you don't indulge in any activities that the government lists as against the US of A, after all we are all here only because the country allowed us in because they perceive there is a need for high skilled labor, letting us contribute and at the same time benefit from this huge economy,we are at their discretion legally, and they can show us the door just as the way it was opened to let us in, just because you are here does not mean you can demand rights :) and call this your home country, that is what the illegals do. I am sorry for sounding so depressing, I witnessed a mass layoff at my company and a lot of my friends (Americans) who are very senior folks were let go, I was spared, somehow that is hurting my conscience, and I am not in a position either to voluntarily give up my job.I want everybody to be happy, and prosper, layoffs reflect the ugly side of capitalism, the weak and old are exploited.

Can you please provide us any link or legal constitutional document from any legal organization in India and USA which states that Patriotic Indian ( For the sake of argument Indian) should not apply for US Green Card ( Permanent residency)? Or for that matter can you legally proove that not applying for US GC is the barometer of patriotism towards India for an Indian?
