Those of you who are now thinking that being able to file 485 will give you freedom - just read through the list to see how many 485 filers (mainly Indians and Chinese) are stuck in the name check russian roullette.

This is one of the biggest bottleneck to 485 and naturalization processing. Most would think it would catch moslems - in reality it catches anyone in "hi-tech" and more often than not Indians, Chinese and Russians. And ofcourse Koreans too. One of the person's stuck in name check commented on the above link - if the FBI knew that a fifth of the nation shares the last name Kim! I guess the same would go for Wu, Yu, Zhou, Singh, Kumar etc.

also, as new members are logging to this group, they should be gently reminded that free lunch often upsets the stomach, so even a small/any contribution would help them feel better ;)

out of all useful land , I guess africa has lots of uninhabited land!, so someone would not mind selling! Its not to offend anyone. I have great respect for africans, being aware that we come from them!
Me being an indian upper class guy, and this OBC thing going on back home, I dont think I belong to that country that much, where me/my children will be discreminated against!!!

GC is for better working conditions while being here in US. If US says that you can not work here anymore, then clearly , only option is to go back to your home country.Lot of people want GC so that they have freedom of changing jobs,starting their own business,spouse work etc. Desire to serve home country or not has nothing to do with it.

msgs like this help establish the notion that this is an indian website dedicated to indian immigration issues. I didnt see any post wishing happy Eid/ Eid Mubarak nor did I notice last year that anyone wished a Merry Christmas/ Happy Holidays, nor do we wish our Chinese friends a Happy Chinese New Year.
As Diwali is national holiday in india... same is true for Eid and Christmas.
Would greeting on Eid or Christmas will also set the notion for Indian website ?

As I see, most of you are missing the point. Instead of trying to understand, you showing the maturity of mind. The whole purpose of EB immigration is to meet the Demand(Job opportunities) vs the supply(immediately available candidates).
When there are a lot of opportunities exists for EB3 level(skilled profession) and less opportunities exists for EB1(Ph.D/Executive Director), USCIS should give more no. of Visas to EB3, then EB1.
A country cannot be built with only the kings, and not even a home can be built with only Ph.Ds(Nobody do the dishes).

To best of my knowledge, at least one parent must have US citizenship to get OCI ( the rules were different earlier - may be 3-4 years back ).

My kid was in India for more than 6 months. We took him to the comissioner's office and registered him. You need to take a couple of passport photos, the PIO card, and the foreign passport. We were told that if the child stays beyond the date of the validity date in the letter, then to come and get a new letter. The whole process took about two hours. BTW, this was in Hyderabad.

Are you sure that you would get back what ever you paid for the policy?. LIC in India is different story than western insurance companies.No Ins. company gives back what you paid on whole life, Please make sure how much you get back when policy matures.

My first PERM (through company A) was denied, as I told before, just because the PERM software automatically denies application with requirements that exceed "normal" SVP level. (Moreover, it accuses you in claiming that the requirements are normal, even if you didn't claim that!) I am not preparing a second appeal. I am preparing a second PERM filing through another company.
I couldn't really find any information about the appeal process on the LC once it is denied. the ironic thing is that my first LC was approved then after I got promoted to a senior position and applied for a second LC, the 2nd LC was denied because they think there is no difference between the 1st and 2nd position. does the DOL have an automatic system that processes the LC and that why it coudn't see the difference between the 2 positions??
where can i find more info about the appeal process?? any links to go to??

FYI for you'll. I e-filed mine and wife's on June 6 at NSC lockbox in Phoenix. Opened a SR for both on Sept 7. Got approval emails for both of them Friday Sept 24. Also gotten soft LUD's on both applications a couple of days before the approval emails. If anybody needs more information, please let me know.

Well - from what I understand is that - these are the low hanging fruits - just like how you optimize time and resources, they pick candidates that are approvable and and utilize the time to process.
It is actually meaningless unless they make it public - say - send a letter saying that your case is preadjudicated and all we are doing here is waiting for the number.
If it is something internal - then well as long as your file is lying on the shelf waiting for visa availability internal policies may change anytime.
The entire preadjudication thing was started at the peak of economic turmoil - some say it was planned to weed out as many bad apples as possible from the GC queue by issuing denials, noids and rfes - if this is the case - then this will continue to happen as long as economy does not improve and job market is still bad.

Then yes forever until we get our GC, for each EAD application we will have to pay 340.
