The motive behind the killing is not known but Murthy, an official of the state-owned Bharast Sanchar Nigam Limited (BSNL), quoted Vishal's friends as saying that some African Americans shot him after an altercation.
It appears that it might have been a robbery. And I feel the hospital did not do much to save his life. Since he was shot in the leg (the bullet might have hit the main artery) its still possible to stop the bleeding. I personally feel he could have been saved, unless we know the full story.
I feel so sorry for the poor guy and their family. After all the hard work in life, he didn't deserve to die like this.
Folks, please be extra cautious when you get into in your car.
1) Always check the rear seat before getting in your car. A crook might be hiding there.
2) When you get inside a car that is parked in a building ( with insufficient lighting or no people around), immediately lock the door. Thats the first thing you have to do, and then arrange the shopping bag or item that are in your hand.
3) If some stranger is approaching you, be cautious, no matter how 'friendly' he looks. Think fast and look for exit signs and plan an exit run, should the need arise.
4) I read long time ago, if in the worst case, say a carjacker who gained access inside your car and hiding in the back seat. And if you have not noticed anything and you just started the vehicle and are about to go, he puts a knife of gun and asks directs you to drive his way, then, JUST SPEED UP STRAIGHT AND HIT THE WALL OR PILAR AS FAST AS YOU CAN. The air bag would protect you after the collision, but the passenger(carjacker) would be thrown out or would have sever body injuries. You would have enough time to escape with minor injuries.
5) Take precautions and don't loiter in areas that you not familiar with.

By "those people" I mean the people that come to the forums only to either track which mail room boy signed for a package, or argue about who bad the inactivity of movement on a Priority Date movement would be.
"Those people" are not here to contribute, they aren't here to help anyway. They aren't interested in meeting their lawmakers, or attending a rally.

Folks I wish your suggestions would be helpful, but I have taken 3 infopass appointments, and to my badluck, everytime I visit I meet the same old-fat-lady who now happens to remember me, and says, "Didnt I tell you last time that blah blah blah ", believe me, she was not willing to even accept request to send interim ead , she gave some reason that NSC outsourced callcenter work to contractors who dont know what they are saying and send us to local office to request interim EAD. She says my FP for ead was done only in Nov(my 2nd infopass resulted in 2nd FP) so it will take 4-6 weeks after that to get EAD. Anyways I will take your advice for a 4th infopass next week.

Do not leave until they give it to you in writing. If they refuse, ask for their names and write them down. Ask them for a written notice that they refuse to follow the procedures from the memo. I have purchased 4 firearms during my nonimmigrant status, including a handgun. Nonimmigrants can generally not own firearms in the US. Though, there is an exception to the law if you possess a valid hunting license and have resided in the US for more than 90 days. I took a hunting class, which was a prerequisite for the hunting license and also had very good firearm safety information.
For long-guns, you will need some paperwork before you go to the gunshop (utility bills from at least last 90 days, hunting license, Driver's license, your I-94 number). The background check will probably be delayed a day or two while FBI checks your immigration status. Your gun seller will call you when they get the ok.
For handguns, there may be additional paperwork. I had to apply for handgun permits with the local sheriff's office. The person you first deal with will probably be unaware of the exception for individuals with hunting licenses. What are you talking about? There are a limited number of green cards each year. The US wants the best of the best to get these green cards. Therefore, more preference is given to those with a higher degree or more experience. What's unjust or unfair about that? The trick is to look at things from the American perspective and not from the immigrant perspective.
And for the record, I am an EB3. well ..the problem is by the time EB3 - person gets his chance --he may become more qualified than a EB2 candidate ..esp in IT. for eg -- tell me who is more qualified.

the problem is there are (some have been rectified) lot of loopholes, problems, inefficiencies (and I care rat's a__ attitude at USCIS) ..how else can you justify the wastage of visas every year ..when the US needs immigrants just as immigrants need US.

Thank you very much for all the response. I waited for responses from different places so I could determnine if it is a Nationwide policy as what the Colorado was saying.
I am from Colorado and I think Colorado is one of the strickest states in the US whatever.
It looks like from responses that only Colorado has so far adhered to this new policy.
I have 4 friends who currently cannot drive because their licenses have expired and they are waiting for MVI's (Motor Vehicle Investigative Unit) letter. Until such letter is issued, you cannot renew your license (in Colorado). According to MVI Here, it will take to 5-7 days, but if there is a problem, it will take up to 9 weeks.
Really rediculous procedure and I agree with everyone.
Just in case anyone there is in the same predicament, please share your story and the resolution.
What we are seeing here is the uneven implementation of the REAL ID act passed by Congress last year. The act gives upto December 2006 or March 2008 (I am not sure which) for all states to have an uniform process in issuing DLs. Essentially, what it means that once the act is fully in place, no one, be it an American citizen or a immigrant can get a DL on the spot. They will take your SS no and other documents (i am not sure about what they actually require) and run it against the USCIS database to confirm your legality. It might take upto a week or a month to get your permit in the mail. The act also puts a limit on the maximum validity of a DL which cannot be more than the date on your visa. In the meantime, I guess they will be issuing you with a paper permit allowing you to drive. It all sounds nice and hunky dory to read but the problems are numerous. First off, the entire onus of funding this federal mandate is put on the States. Many states have already lodged their protests against this requirement as it will mean them having to increase the fees significantly. Secondly, the act assumes that the SS database and the USCIS database is up to date and has no flaws. Thirdly, it assumes that the chcks against the databases will have a fairly quick turnaround time. We all know how laughable these assumptions are (FBI FP check victims will appreciate this).
The REAL ID act is another of those great ideas that have been rammed down the throats of the American public without suffficient debate similar to the HR 6061 that was passed by the house leading to the whole CIR fiasco.
Hopefully, as time goes by saner minds will prevail and the act will either be repelled or modified to make it easier for genuine people to get the DL quickly. In the meantime, get prepared to face another bureaucratic and government created retrogression :(

Most people has very misconception about "parole". It is not a free/flexible travel document like visa. As a AOS applicant, one should not leave US till it is approved/denied. One MUST present in US during AOS. The parole is only for any emergency purpose; which is similar to prisioners. As USCIS is flexible, in approving the AP, the people don't realize the travel limitation of AP. They are travelling on AP for vatation/fun etc.. As per law, the AP is not intended for it. The CBP officer was right in asking the legitimacy of the travel. The AP document clearly says it is based on "humanitation" admission to retrun after an emergency travel.
That's correct, but what is one suppose to do when it takes years to get a green card. As someone mentioned earlier, the reality does not match the intent for the law.

it is the job profile that dictates whether the case is eb2 or eb3 - the applicant should meet the criteria for the job. not the other way around.
Sure. h-1b is now; labor is what you are going to do when greencard gets approved.
try telling a consultant who is qualified for eb2 that the job dictates it is eb3 and they won't sleep or eat -:).
Reality of the process and how it works is quite different. If you really wanted to pick on things; DOL assessment of education and experience dictate that all of the IT positions should not require more then bachelors and four years of experience (ever IT labor filed with eb2 requirements it to be answered that the job requirements are NOTnormal for the positoin.
If companies don't want to file eb2 then employee will not stay (they cannot fathom waiting 10 years for greencard).
Maybe people don't want to hear this but that is reality of the situation.

We could not even pool $10K for FOIA. For lobbying, one needs lots and lots of money in the range of 100K -200K. What can IV do? Can you explain what you mean by "something'? if all of us EB3's can pool 100K, then we can request IV to do "SOMETHING". Hope every one understands this.
How is anybody sure that by spending 5K or 10K, you will get what you are looking for? Just because somebody quoted 5K fee for such an information (which may be their standard response to such custom information extraction requests), it does not mean it can be readily found. If it were that easy, USCIS/DOS would be using it. The fact remains that PD related information does not exist other than in physical paper applications/files related with LC, I-140 and I-485. There is nothing on the system based on PD's. Don't we see it in guesswork used for advancing and retrogressing PD's. Note that for most immigration applcations PD's do not play any role. Only when at adjudication time, birth country is noted to be India/China, the officer has to check PD with respect to current cutoff dates. Systems are not designed for handling any processings based on PD's, so quick access to such information is not available - with a fee or without a fee

Thank you all for all your suggestions and support. Past 3 days was very stressed and exhausted. Your suggestions and support made me relieved and courageous. Yesterday I slept peacefully without any tensions. IV is a great forum which is helping immigrants in difficult times by providing support and useful information. I am very thankful to you all. I will keep posting the updates; I will definitely fight and overcome this situation. Now, my first priority is my baby and health.
After seeing the support in IV, it proves that still there are so many good people out there to help people in difficult times. I won't forget this in my life.

What is your PD ?
My personal preference is for AOS as it gives me much more flexibility. ( EAD and AC21 )
