I am talking about a person (like 485mbe - the one who has posted next to yr post) who has a PD of 2001 ..I am not saying that they should give Eb2's quota to EB3 ..but they should try to pull the category that is worst affected..or atleast give EB3 something ..
my question to you is ..say in the year 2010, would u support a situation where all categories are current or at 1 year difference ...while a particular category (eb3 I in this case) is at 2001 ??.. even if you do ..my feeling is that USCIS will try to pull EB3 - I (if something like above happens)..but then they are just a govt agency ..and in the end they are similar to govt agency in India ..only difference is that maybe little better

See, again, you are looking at it from the immigrant's point of view. Look at it from America's point of view. Immigration isn't like charity. America isn't in the business of helping immigrants, it is in the business of helping itself. The fact is that it is a matter of irrelevance to the US whether it is EB2 or EB3 that is retrogressed. It is only interested in retaining the best labor force in the world. The moment the US gets more self sufficient in so-called "high skilled professionals", it will make the green card opening narrower, perhaps even get rid of the EB3 category altogether. And would that be fair or just? Yes. Why? Because America is looking out for its own interests, not that of the immigrants. It's what every government does and should do.

People with grown up kids, I guess would prefer Canada over India. There are many problems starting with the education system, reservations etc. For kids who had been studying here from KG through grade 8-9 it's difficult to get dragged in the rat race in India, especially for normal kids who don't belong to any reservation category.
Yes in Canada we know that finding a job is going to be difficult and we should brain-storm about how to tackle this problem?
What skillsets are in demand? Anybody has idea?
I also have a wild idea like US companies may look at Canada as a outsourcing destination if given very competitive package. One of the biggest advantage will be proximity to the US, so better control over quality etc. That may not turn into a big boom but is a possibility.
My company has offices in both canada(toronto and vancouver) and US .. i have worked for extended periods of time in canada. I agree that career development oppourtunities are limited due to economic reasons, but I there is no way toronto or vancouver can be considered "racist". And talking of high skilled workers, who said there is absolutely no discrimination in the US ? Isnt that what programmers guild and other labor unions are all about ? how come so many people support the blue collar illegal aliens (mostly meat-packers and lettuce pickers), but nobody cares about us, tax-paying, law-abiding highly skilled people ?
The difference is at least the canadian immigration policy doesnt institutionalize the discrimination by making us wait in limbo forever, unlike the US laws. Other than the trust that the core members are doing the right thing, I have no information/idea about the issues that IV core is focusing currently.
I think FOIA was a great success because the members knew exactly what IV was upto and everybody wanted to be a part of it. I believe that if IV could define several small goals like FOIA, post regular updates about the progress on the goals, a lot of people would be willing to support it.

My I485 is still pending (> 180 days filed on July27th '07). I have my renewed EAD valid for the next 2 years. I have been out of project for 4 months and my employer , who filed my GC, terminated my health coverage too. Iam using my COBRA option.
Recently, i have applied for a perm position using EAD . I explained to the client about by current status of GC. They wanted to know what they are supposed to do for it. I told them i need to 'invoke' a law called AC21.(pardon my ignorance if iam wrong) inorder to transfer my pending application.
Now the big question is, how do i initiate this whole process?
I really apreaciate all your suggestions.

Thanks just4gc for giving me the coveted vdlrao post. I must say the ages spent analysing Visa bulletins statistics and congressional testimonials of Charles Oppenhiem have finally borne fruit ;).
I guess Illusions beat me to the prediction. I must confess I havent spent a lot of time looking at Eb3 ROW. But even then I was surprised when it stayed at May 05 for as long as it did. The Backlog Reduction Centre stuck labor, the horizontal spillover, the Eb2 India backlog are few factors for why I was surprised.
I would say dont lose hope on Eb3 ROW, but until Eb2 India backlog stays it will be slow movement except as illusions pointed out in july 09. Last VB mentioned 60% of the demand recieved is before jan 2004. Thats pointing to the older BRC cases which are now seeing the end of the tunnel. fingers crossed.

Even my papers were filed on 2nd july before revision of VB. My questions:
Since VB is revised, my application would be rejected and sent back to Attorney's office. But when? How much time does it take USICS to send these application back?
What if it goes beyond October bulletin? If by chance (which I doubt), my dates become current then how would I be able to file my papers again, since medical reports are still with USICS, they had not returned it yet?
Any ideas?

YogKc, how did you get the temp license? which state? am I eligible for temp licese at PA if I did not get the license before the current one expires..
green_world, it's in Los Angeles, CA. They will provide you the Temp DL. They will tell you that they need check with the Immigration office.
I think the best bet will be to renew the license thru web if possible.

That is correct! The bills in the house and senate coming up for discussion does not mention visa re-capture. However, Please look at the titles-don't they sound the same. The contents are different. The content of S.424 is to give permanent residents the same STATUS as US citizens so that they can sponsor their wives, parents, brothers, sisters and doggies...So an amendment is necessary. That's why I have written in the original post-
'The second bill Uniting American Families Act is in the US House. Though the intent of this bill is not the same as the senate bill S.1085 noted above; an amendment can be made to make it the same. Currently, they are scheduling a House hearing on 3rd. June, 2009 for that bill.'
Friends, please use these two bills to gather momentum for congress. That is our ONLY hope for Summer 2009!

my labor has to be pending 365 days or have an 140 approved to extend. so if pp goes away for 140 then my only option to stay in status is EAD. Also I am not in IT so patni,tcs etc...is out of question.
