I am not discouraging pople but aasking them to stand up. Only trying to gauge the leveel att which companies are affected.
I don't think DOL is very efficient in updating their list. Here is what I found through a google search http://www.usdoj.gov/eoir/vll/intdec/vol24/3580.pdf
http://www.usdoj.gov/usao/txs/releases/February%202007/070214-Huang.htm
http://bibdaily.com/pdfs/Pegasus%203-31-08.pdf
I think out of these three only one is mentioned in the list.
Edit: Another one not in the list http://www.oalj.dol.gov/PUBLIC/INA/DECISIONS/ALJ_DECISIONS/LCA/03LCA14A.HTM

Macaca, you are so right in asking those blunt questions but is that going to make a difference? I dont think so, your audience here is very thick skinned and will come up with all the BS in the world to not contribute.
I think we should not allow Leechers to start new threads. Conservation of resources should also be on the priority list when raising the money is such a difficult task.
Well said, logic life too.

from the July bulletin
Region All DV Chargeability Areas Except Those Listed Separately
AFRICA 35,500
ASIA 7,750
EUROPE 23,000
NORTH AMERICA (BAHAMAS) 12
OCEANIA 1,800
SOUTH AMERICA, and the CARIBBEAN 2,500
Unless they reject/disqualify 30k Africans and close to 20k Europeans I don't see the diversity here. Notice Asia, the most populous continent has a measly 7k. But thats a different argument for another thread.
I think increasing the total amount of visas per year is what we need.
The numbers above are for DV visa and not EB..The reason Africa/Europe has a higher number because these places are not "principal sources of current immigration". Cap for DV visa is 55,000 per year

The only way to counter this is to get our story out in the media. i joined the forum today and went through a lot of mails on the forum. i saw pappu making appeals to members to help him write to reporters. I saw state chapter threads and only few members have actually signed up for work. see only a handful responded. others simply come on forums and rant. but only few actually do the work. I also observed members critical of Iv or telling IV to do this or that, instead of doing something themselves. My other observation is that members do not contribute money and come to this forum for free advice. Nothing in this country is free but IV is providing this forum and also free advice from lawyers. But members are simply taking advantage of IV and not paying back what they are getting from it. This has been my personal observation. Members we have seen how visa bulletins affect us and demoraliize us. why dont we all do something instead!
You are hitting the right buttons here! You can say it is either laziness or fright/jitters or the comfort of current H1B approval/stamp that is making the large populace to sit tight.
Guess what, once some of the battles are won (we can never win all - they will always be ongoing), we should either knight pappu or induct him to "IV Hall of Fame".

In any case, why should someone be SO disturbed if some lawyer says "I will try to prove your degree equivalency for trying to get into EB2"?
Going by folks' behavior here, I am inclined to think, some simply hate such a lawyer for nothing more than personal interests

As I thought about this further, I figured out the data is even worse than I thought earlier, as this may not have any 2007 numbers. People who filed their labors in 2007 were still waiting in july of 2007. So this data is only upto late 2006. Now the figures could be.

All,
AILA has a template of a letter/email to Congress members that can be used to express support for visa recapture and immigration reform.
Please check out
AILA - Web Resources (http://capwiz.com/aila2/issues/alert/?alertid=13300836&type=CO)
You may like to modify the message to suit your life situation and preferences. For example, instead of undocumented aliens, I used the opportunity to stress the difficulties of employment-based applicants. While I have nothing against them, it is my belief that I need to stress my own problem and seek a resolution.
And, I have also forwarded the link and my mail to all my friends who are waiting for green cards. More importantly, I have asked my relatives and friends, who are citizens or who have green cards, to pitch in and write for our sake.
My suggestion, should you agree with the above, is not only to write to your Congress members but also ask your relatives and friends to do likewise.
Best wishes
We advice not to use this template and form. The message and the organization sending it for their advocacy agenda is very important. Even if you change the wording, people will hardly read the letter. They will look at the organization that sent it and its agenda.
It is better to call or email your senators and congressmen with a personal message. When there is a need for a fax campaign, IV will activate its fax campaign system here http://immigrationvoice.org/index.php?option=com_iv_webfax&task=getContactDetails&Itemid=46
If you email or call your Congressmen or Senator, do tell them that you are a member of ImmigrationVoice so that their office can make the connection to your calls, meetings and emails in our advocacy meetings. Another point to note that in person meetings have much more effect than emails. You may get a standard reply to your emails. Sometimes the response may talk about a general immigration position of the senator rather than a specific reply to your question.
BTW do not quote any bill # yet. If you want to talk about Recapture, just say recapture of unused visas for Employment based category.

Don't worry about what feedback people gave you. People are jealous of you. Understandbly so, because of dates going back all the time. You deserve what you got and you got what you deserve (I mean the citizenship and not the lousy feedback no one should care abt). You have pretty good educational background too.
Now, that you had your sense of fulfillment and wallowed in it, can you share some info with us? :) I asked you a couple of questions, which I would love to get answers to.
Sir, I take offence for your comment.
How did you conclude that others are 'jealous' of desi####
How is that getting a citizenship is an achievement? Just because we are way behind in PD, it will take time for us. Does that mean we are 'jealous'? And if we apply for citizenship in due course, even we will get it.
Personally, I am not jealous. That doesnt mean I cannot have a different opinion from him.
Could you care to expand this statement of yours?
"You have pretty good educational background too."
Are you saying that others dont have and that is why they are jealous? Think before you comment please. Thank you.

With my very best wishes to those of you waiting for your GC, this thread is created for the lucky among us who received it recently. I am putting together a list of things to do, and not do, to maintain our freshly minted PR status, which should also help during future citizenship application. The list is mostly about little things that others have learned from experience (and I am learning from their experience, by reading in immigration-related forums such as IV). The more obvious things that can be found for example in USCIS handbook (http://www.uscis.gov/files/nativedocuments/M-618.pdf) are not included here. Below is a snapshot of what I have gleaned from Internet so far, and please add your own input(s):
LIST of DO's :
1. Carry the original PR card on your person at all times (e.g. in your wallet), keep photocopies in different places, and also store A# on your computers. Note: This is a contentious issue (do a google on "carry green card" and see for yourself), despite being required by law (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=fe17e6b0eb13d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=4f719c7755cb9010VgnVCM10000045f3d6a1 RCRD). Some people are naturally worried about losing wallet and the eventual hassle of replacing the lost card (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=b3f7ab0a43b5d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD), whereas others, including me, prefer to follow the law, in case I am suddenly asked to produce evidence of my legal status (e.g. in some border states, or unforeseen events, such as being involved in an out-of-state car accident where showing my DL might just not be enough). Failure to comply may result in, at best a fine, and at worst detention for breaking a law. (See comments by InTheMoment below for additional perspectives.)
2. Retain all original copies of USCIS documents related to your legal status during the entire period of stay in USA, and shred all photocopies (except when you have a photocopy but not its original).
3. Retain all employment-related documents, particularly original copies of appointment letters.
4. Retain copies of all tax return forms from the year of your first entry, or (at least) previous 10 years (you can request IRS (http://www.irs.gov/pub/irs-pdf/f4506.pdf), or your professional tax preparer, for any missing copy).
5. Maintain a detailed log of USA exit/entry, including dates, POE and countries traveled, beginning with the day of first entry.
6. Maintain a detailed list of all legal troubles, including minor traffic infractions such as speeding violations (ignore parking violations, because they do not constitute legal "detention"), going as far back as possible. Keep copies of all relevant court papers, traffic tickets, proof of any payment (e.g. scanned copies of personal checks used, credit card statements), and so on.
7. Update your social security card (http://www.ssa.gov/online/ss-5.html) to remove any restrictive clause about work authorization printed on it. Here is another thread (http://immigrationvoice.org/forum/showthread.php?t=20610) that discusses this point further. Note: AFAIK, the procedure changes nothing as far as your privileges go, and some of you may not even have such a clause on your SS card (I don't have it either).
8. Return your I-94 cards to POE on your next trip outside USA, to "close the open files" on your past travels. AFAIK, this may be more relevant to those who applied for GC via special registration (NSEER) (http://www.ice.gov/pi/specialregistration/), and probably does not matter to others.
9. Renew DL to get rid of the annoying "Temporary" word (in case you are in one of those states that do this).
10. Update your status with your employer by filing new I-9 form (thanks to InTheMoment for this point).
11. Continue to notify USCIS (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c1a94154d7b3d010VgnVCM10000048f3d6a1RCR D) about change of address within 10 days of moving, as before (thanks to seahawks for this point).
12. Keep a list of current and past residential addresses, including dates of stay. Retain all leases/ownership documents.
13. Remember the basics: Initiate your GC/passport renewal process at least 6 months before expiry/Intl travel (Thanks to pappu for this point.)
14. And yes, move the family first commitment at the top of your must-do list, now that you have less worry about re-entry, and make that long-delayed trip home to see your old folks one more time. (I am visiting my 83-yr old Dad, who still has more hair than I do, and less gray too, in June.)
LIST of DONOT's :
1. Do not sign up for voter registration card. In particular, never vote in national/state/local elections that are open only to citizens, because this is also a law (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=fe17e6b0eb13d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=4f719c7755cb9010VgnVCM10000045f3d6a1 RCRD). Even an accidental mistake (e.g. voting out of ignorance) is a serious offense, which would not only derail your future citizenship plan, but may even result in deportation.
2. Do not develop a pattern of frequent and/or long absences from USA, unless you have taken prior permission for valid reasons (e.g., studying abroad, medical emergencies etc). Otherwise you may face trouble at POE on your next re-entry attempt, because DHS has become stricter in recent times about possible misuse of PR status, and POE folks are now trained to spot such patterns.
3. Do not switch job soon after getting GC. This is one of the most discussed, but least understood, issues because no one seems to agree on "how soon is soon". The rule of thumb appears to be "6 months", and a safer bet is "1 year" (here is a thread (http://forums.immigration.com/showthread.php?t=154533) on another forum). This again relates to USCIS being increasingly sensitive to possible misuse of PR status, and this question will come up during your citizenship application process. (Invoking AC21 while GC was pending makes the issue somewhat different (http://www.murthy.com/485faq.html#13).)
4. Those of us who self-sponsored our GC via NIW or EB1A route are not bound by such employer-employee commitment, but you should continue working in "similar areas of expertise" that you claimed in your NIW/EB1A petition, and preferably on a longer time scale.
[This is an evolving list thanks to valuable inputs from folks here and elsewhere, so keep checking back.]
Cheers,
Stuck(no more)InTheMuck
5. When you file taxes Never claim your self as Non Immigrant .

This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.
Few points:
1) having gc is a privilege not a right.
2) US has every right to choose whom they want to have in their country.
3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.
4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)
5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.
Wake up friends, you have options. Don't let your life depend on you application status.

USCIS has a format which needs to be followed to get a GC. We all know that how much they follow the format/procedure and how much they screw people from India/China (mostly Indians)
There is no set goal to be just in a WESTERN Country but there is an option to be in US (or for argument UK AUS etc) but that is an option. No one forces us to be here or to be anywhere.........Arn't we here by choice?
I am now sick of hearing about the fraud on h1b. If 20 people out of 100 are like bad apples does that gives USCIS the right to screw people from that country for GC. What is the relationship here? Why all Indians have to suffer due to some pathetic people? Why do we GENERALISE such things?
Not defending any of those people but if someone KNOWS S/W testing and that person is skilled in it why cant that person work? Just the damn degree does not gives anything, one needs real work knowledge.
Could write more but I guess I m done with this post....

Read the article on today's washington post. I had to email the writer to get the website (email) information. He/She was nice enough to email me the website link. It would've been better if the website link was provided on the article itself, I think that would've directed few more folks to this site. This is a great effort indeed and I am glad I got to be part of it.
Just send in my $100. Hope it helps.
