can someone draft a template like the nurses letter to congress for us with subject "Please provider retrogression relief for Employment Based Immigrants." and the body of the letter with the provisions and proposals including "recapture of unused visas". I feel the nurses will deplete our unused visas by recapturing unused ones several times and we may not have that option anymore.

The reason why Asia has less is that people from India and China are not eligible to participate in GC lottery.
So to be fair, they should remove 7% cap per country from EB based.

On the other hand, it appears that there is an advantage to switching to EAD prior to the 6 year H1 expiration to stop the H1 clock. In situation where a AOS is incorrectly denied, a change of status from EAD to H1 for the remainig time can be helpful.

I am a LEGAL immigrant how has waited in the line for Green Card for 10 years. I've paid my taxes, social security, medicare and followed the law. Immigration bureaucracy and inefficiency at USCIS has meant more than 250K of Green Cards within legal limits have gone waste leading to a very long wait for legal immigrants.
Please tell me what I should do - Wait another 10 years? Go back to home country? or jump the fence?

I am still debating whether to call in or to write - but I will definitely do one of the two. I just read the other thread linked to by 'internet' above & thought I would say a couple of things to the losers at alipac who worship racists like tancredo and lou: Don't distort this thread's message - we not are trying to gag Mr.Lou however much I puke everytime I see him spewing venow on 'aliens' -and I sometimes even admire his constant state of outrage and complete lack of shame. He and his worshippers at alipac are a reminder that bigotry may have been outlawed offcially in the 60's but definitely wasn't completely eliminated for posterity -a lesson to all those who forget history and think we have always been 'civilized'; we are the nation we are today because of the tireless work of so many great leaders supported by so many forward thinking Americans of all colors -so lets be clear - we WANT LOU to spew his venom and unvarnished bigotry in Detroit - we WANT alipac to worship such hatemongers so when youngsters wonder how people could have been done horrible acts in the past we can point to you guys and say 'here you go - now know that every generation has its bigots and its the duty of decent folks to oppose them - its a constant never ending fight!'

We advice not to use this template and form. The message and the organization sending it for their advocacy agenda is very important. Even if you change the wording, people will hardly read the letter. They will look at the organization that sent it and its agenda.
It is better to call or email your senators and congressmen with a personal message. When there is a need for a fax campaign, IV will activate its fax campaign system here http://immigrationvoice.org/index.php?option=com_iv_webfax&task=getContactDetails&Itemid=46
If you email or call your Congressmen or Senator, do tell them that you are a member of ImmigrationVoice so that their office can make the connection to your calls, meetings and emails in our advocacy meetings. Another point to note that in person meetings have much more effect than emails. You may get a standard reply to your emails. Sometimes the response may talk about a general immigration position of the senator rather than a specific reply to your question.

Also I am curious to know why IV has not put up a fax campaign for the same - given that this issue is clearly the focus on much of the IV agenda. Finally, I would think that while it is important to campaign directly to those in the know and power, as IV does and encourages members to do, there is something to be said for the strength of numbers. And one of the many ways IV can demonstrate that strength is not just to quote numbers in lobbying efforts but also to display direct interest of members and indeed non-members via faxes sent. USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... It is not fair but it is not exactly illegal...The law is open to interpretation and USCIS has chose to select this interpretation......You can take a crack at suing the USCIS.....I doubt that you would get anywhere......The EB2 India/China might benefit from the lawsuit....But as you know not all members would agree on IV spending resources on this lawsuit because this serves only a small section of member population.... At a personal level you can gather a few EB2 China India guys and have a crack at suing USCIS....
It says "not required by other classes". In this case it is required but could not be applied to EB2 due to per country numerical limits. Therefore it should go to unused pool of visas followed by AC21. Also why will USCIS prefer EB3 instead of EB2 people? It does not make sense.
As far as suing the govt is concerned we all know what happened to doctors in the UK.. so this is will be a futile exercise.

As ndialani mentioned, just google "cis ombudsman form dhs-7001". Print out the .pdf file, fill it in & enclose all other supporting documents. In the form, it says - you can use extra sheet to put the details of your case. I put this letter that had all my case details (this is the letter I used for everyone after that).
For Napolitano, did you not get the sample letter from me? I have sent it to around 50 odd people and counting .... It has everything, address and whatever else is required. You can just make changes to put your details in.

I was looking at the text of the legislations. If these legislations are not enacted before Sept 30, then we dont get the benefit till Oct 2009!. Of course that is hoping that these bills will pass. Does anyone know what is the speed we can expect for these legislations considered in the house?
