The best way to respond this kind of people is to ignore them....
If you are successful, certain people will complain and make up stories how you became successful.
If you fail, the same people will makeup stories how dumb you are etc...
The best way, in my opinion, is to ignore these fools.
Those who are writing negative about IV and their leaders, do not have slightest idea on how much sacrifices they have made (family time, financially, physically, mentally etc) so that most of us could be benefited out of it. If these people think they are not benefited or does not like the idea, please don't read those post or just ignore them and move on, go to the posts that you would be benefited from and logout, I personally would like these people to share their experience and answer questions by others with their best of their knowledge, but if you can’t do that, please don't demoralize others.
And yes, I don't care about RED dots, so bring them on.

1 week after getting approved, I got the card in mail today.
All the work that I put in the last 2 month to get my file picked finally comes to an end here. It's good to see that people are proactively calling USCIS and following up on their cases.
Good luck to all EB2 folks who are current and waiting and to all the EB3 folks, hope you guys become current soon.

you are asking for EB2 guys in 2004,2005,2006,2007 to wait for EB-3 guys in 2001,2002,2003,2004. Point is well taken. Its a humane way of handling things.
Perhaps they should not make EB1 current, let them wait a year or two while 2004 EB2 and 2001 EB3 get their green cards.
Ask this question to yourself. If you were an EB2 person with 2004 priority with a spouse and kid, Would you be willing to wait few more years to get your green cards so that a 2001 EB-3 shall get his faster and may not care /appreciate your sacrifice?
Your position helps yourself and nobody else. I dont have any problems 2001 EB3s getting approved before 2004 EB2's. Thats the way it should be, but not at the expense of EB2's. Feeling of entitlement is not adequate justification. USCIS has established a way to convert to EB2 status, if you have sufficient experience. You can certainly try that option.
I just spoke my mind, dont care if i get red dots or not. Apperantly people here are way too sensitive to an opposite point of view.

If there are 20,000 numbers that DOS thinks will not be used in the current FY; then let it distribute equally to all categories. Say if EB2 and EB3 (I) or China gets 5000 each, then obviosuly, because of a shorter queue EB2 dates would move forward beyond EB3 does. I think this is fair.

There is No sense is passing a rule/memo like this where the consultant/Employee is affected badly.USCIS changes their views and rules on a need to need basis which should be struck down by the court of law.We as immigriants to US and we have every right to fight this rule and also need to support the need to revoke this rule.
Even a criminal gets a chance to plea in the court as not guilty,but we dont get a chance beyond the immigration counters.We continue to contribute so much tax dollars and all of that shouldnt go in Vain.People have lives and Families and they can never build or continue the future invested here in US.

Company tax returns can only show the NET INCOME . You need an Audited Financial Statement prepared by a CPA to show NET ASSETS
Box F in 1065 form has TOTAL ASSETS field. Form 1065 is for the Partnership firm. Why not other companies tax return will not have this field?. I just got an RFE on my I-140 requesting 2006 tax return.

This is what my attorney told me:
4 Year Bachelors in India + 5 years of Exp (excluding sponsoring emp)
3 Year Bachelors in India + 2 Yrs(Msc) /3 Years(MCA) + 5 years of Exp (excluding sponsoring emp)
4 Year Bachelors in India + US Masters + 2 years of Exp (excluding sponsoring emp)
All these qualify for EB2. Just make sure you Job Description requires eb2.
Also, consult with a leading attorney and show you employer, that this is doable.

A lot was said above but some basic things still need clarification.
I do believe that I HAVE THE RIGHT to get my LCA adjudicated in 2-3 months time (OK, make it 6 months, having in mind you are dealing with an inefficient administration).
I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.
These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege...
No I want the RIGHT to get my GC as soon as I land here on a H1B. They should give me the GC at the airport itself. I'm not waiting one day even. ;)

Filing the complaint is the easiest thing that I have done in a long time. As I had lots of written evidence so it took me close to 30 minutes to prepare the everything but normally it should take no more than 10 minutes. The DOL, Wage and Hour division, takes care of all the such complaints and the identity of the filer is kept confidential to the fullest extent provided by law.

I spoke with an investigator (who was very professional and courteous) who told me that even though FedEx shows the package was delivered they cannot locate it. I received a letter from the DOL after 2 weeks saying my complaint has been received; they even assigned me a complaint number which I can use to track the progress of the complaint by calling their office. The DOL combined mine and my coworker's complaint together and assigned both of us the same complaint number; my coworker filed his complaint few days after I had filed mine.
What exactly happens to them?
Are they under a watch list?
Many employers will open up a new company and operate?
Maybe employers are ready to deal with this ????

We should update the question in the poll and make it specific only for people who live in and around of bay area, else the 'no I cannot attend' will be from all IV members who have no way to attend since they dont live in the bay area.

Actually, not all he said was wrong.
We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.
My own employer was trying to get as many H1s as possible without having ANY work for them. They sent us all a few emails asking us if we had any family or friends back home who want to come to US on H1. These guys make the H1 applicants pay for the application expenses, then just keep them there or get them here and keep them on bench and almost everybody here is familiar with what happens next.
Think from an American's point of view.. It is THEIR country, THEY make the laws that benefit their society and economy.. they have all the right to stand up against these practices by foreign based companies..
I like his statement "H1B is supposed to be used when there IS a job but no American to do it" What these Consulting companies have turned it into is "There is a person on H1B avaliable If and when there is a job to do" OR worse "There is an H1B holder available, on bench, but no job to do"
I totally support reform in the H1 process with a target to reduce fraud. That will ultimately benefit people like us who will come here on H1B in future.
Please don't fire me for taking his side, I'm not. I'm in favour of market deciding what it needs, but I'm 100% against fraud, and all of know these so called consulting companies ARE indulging in fraud..

In my view, targeting these folks and barring them from sponsorship of H1B's is necessary, and requires meaningful changes to the system, not just increase in fees for H1B sponsorship.

I opened an account with them few years back and had to experience the same crappy service. The funny thing is that they had two phone numbers one for new customers calling to ask them about their services and the other one from existing customers.
The phone number for the new customers was answered within minutes and the quality of customer service reps was good BUT if you would call the other number if you were an existing customer then you would have to wait for someone to answer the call for hours and the quality of their reps was pathetic. The best part was that if you call the phone number for new cust and tell them you are an existing cust and have an issue then they would tell you too call the other phone number as they do not have access to the info.
I guess right after my first transaction, I canceled the account. The only way we can teach these people a lesson is by not giving our business to them in the first place.

Actually I know a guy who lost his job and joined a restaurant as a cook or something and applied GC, then after 1 yr or so got job again and used the EAD to change to the Tech Field again and at a different location.....I hear he is indeed facing some problems now.

USCIS cannot keep the filing fees if they return your application. They can only keep it if they do accept it and then deny/reject your application.
