Looks like this idea has come out of mere frustration. Do you know how many people want to immigrate to the USA? Do you know how many people are waiting in line? Do you think it is correct that only EB-immigrants should be given preference? Why because USA needs all of them? While I have used "you" in the previous sentences, I don't mean just you....rather "we".
If you have time-bound path to immigration, then right now, the whole Federal Govt. and all employees will have to work only on getting the immigration files cleared. Under current circumstances, I think the current system will get you a GC faster than if they switched to "time bound" today. Do you realize, how many people will suddenly be suing the Govt. for delays? There is no country which guarantees time-bound path to PR.
While I forcefully oppose the DREAM ACT and CIR, these did not give time bound GCs but only allowed illegals to convert to legals and in time APPLY for GC if they become eligible.

Here are a few facts:
1. Most of the advanced countries in the world - UK, Australia, NZ, Switzerland, Singapore and some Scandinavian countries offer a time based path to residency and citizenship for the educated class of people who come through the proper channel to work
2. In Canada, Australia, NZ (there could be other countries, but I am not sure) people can apply for a PR based on their OWN education and experience. They are not held hostage by their employers and harassed for ages. It is happening here because the lobbies are very powerful and are supported financially by the corporations to serve their interests. The system has been craftily designed to ensure long term indentured labour
3. In the entire scheme of things the real beneficiaries are the employers and the law firms
4. The system would be streamlined and the work of the government would become much simpler and faster. This is the way governments works in several western countries who offer a time bound programme
5. Every month our EB friends need not stare at the bulletin with great expectations and waste their time
6.Everyone can plan their future better. (I do not think I need to explain this)

You have a life to live, right? So, don't spend time explaning or convincing someone who don't want to believe you, it is a waste of your valuable time. I really appreciate you taking your time to let us know the facts(I hope not). Thanks.I sent it to Nebraska and it reache on July 3rd 2007 and it was trnasferred to Texas. I am not sure what's there in my profile, I just entered the dates when it didn't let me login to the site. It did not let login even if I didn't enter an RFE date and I had to enter some date. My I-140 was approved from Texas. One more thing, when I e-Filed for EAD and AP this year, it went to Texas, though IO gave a Midwest address which falls under Nebraska, I don't know why and I was surprised and happy too as Texas was approving the applications very fast, but mine is not yet approved (Applied on 29th June).
It is already 6:15 PM and I have to go home, if I don't answer any more don't think I am hiding. I have a life to live and don't be so negative buddies. Every body will ge their Greencard and it is just time.

One employer had applied in 2004 and was in PBEC and did not get approved untill 2007 July, meanwhile I had applied another in EB2 through another employer and got Labor approved in Septmeber 2006 (less than a month) and I-140 approved (Premium) in November. After that I got three years H1 through new employer and moved to this company on 11th June 2007 Luckily everything was made current on July 13th and mailed my I-485 application on July 2nd (Just before they officially announced that visas were unavailable) and it reached on July 3rd. Again don't ask me how could I apply in EB2, when I did not do Masters in US. I have Masters from India and also had Five years of experience even before 2004, by then I was in US for more than 5 years. Also, when my employer applied Labor in 2004, I was just Five days away from my 5th year ending on L1/H1.
One more thing I bought a home in 2005 when my labor was pending some where, may be in Local Labor Department or PBEC or somewhere inbetween, and have been living happily. I am also worried about the GC but not paranoid about it.
Many guys here worry too much, just relax and live a peaqceful life. Jus think this, we are highly educated and would defintely be able to make a living anywhere in the world, not just US. Don't worry tooo much and think others have no work and want to fool you guys.

I am going to file my h1 application tomorrow under the master's qouta. I know its nearly impossible that my petition would be approved but I have no other choice. I just have one question:
1. Should I go for a premium processing?

Well if you OPT expires on the 15th of May you'll be out of Status till the H1 is active. And i believe the H1 visa would be active only by the first week of October. Hey, you just put the entire GC process in a nutshell. I understand a lot of folks are in the same situation, but I think IV is looking for stories that will help us push our case forward. The picture you paint is very morose and depressing (and I sympathizes with you, so please do not get me wrong) and we hope that this whole situation that all of us are in turns out to be a bad nightmare and we wake up to see some hope again.

I think you can find a lot of people on the IIT forums that float around the web. I am sure we can find really successful(well almost) with sorry stories and restrained in career advancement due to EB retrogression.

First and foremost, a Big THANK YOU to all the IV core team who along side their full time jobs were working behind the scenes in getting this done and having to go through the hecklers and naysayers.
A big thank you to Congresswoman Zoe Lofgren in helping pass all the pain and outrage of legal immigrants to the people incharge and making them listen.
Also last but not the least, every active member of IV who participated in the flower campaign, in San Jose rally and in actively informing media on IV projects to showcase legal immigration issues. And for keeping saner heads in the insane times.

Hi,
My wife is in F-1 status, but I�m afraid to change to F-2 right now and loose the opportunity of transfer the H1 to a new employer... unluckily finding a job has not been an easy task, since I am in Puerto Rico and here the situation is not good.
My last paystub is June 14th, and I was wondering to apply on July 2nd, but because on delays with the medicals I got trapped in the Visa Bulletin fiasco mess.
I've talked with several local lawyers and none of them has given me hopes beyond the F-2 status.
Some friends recommended to file I485, but I don't want to risk for an RFE :(
I'm trying to be strong for my family specially for my kids, the older one cries everytime he hears us talking about leaving PR.

1. Why do we put up with the inefficiencies of the American Govt?
2. Why do we sit down and accept what is given to us instead of asking for what we want/ desire?
3. Why do I hear - "I am not interested in protesting" or "I don't have the time" from folks that are paying a high price due to retrogression?
We are LEGAL, tax paying, resident aliens that are contributing to the economic growth and not siphoning off government funds. Don't we deserve better?
Why were there 100's of thousands of faxes sent by NumbersUSA (aka Sherman and gang) while all we could muster was a meager 20000? Where are the rest of the 1.2 million EB applicants?????
Its time we stood up and showed them our strength. We have the numbers- we just need the strenght and courage to stand up for our convictions.

I know someone who got theirs on Tuesday, and got their case approved today. This was Fy2008 Masters, Premium processing
I also applied for Masters Quota, but didnt do premium processing and haven't received the Receipt notice

That is the way green card processing works if they follow rules. The perm process is to test any candidates are available for the position. If they find a qualified person then that position will not be available. But still the company can process GC for another position if they are willing. Most companies used try to reject all the candidates to get a green card for a H1b person. But recession made the things worse. To change the situation either economy need to improve or Change the green card process. One of the option is change to point system with increase of Annual cap. That will take away the control from employers and chance of explotation is less. But point system got a negative response from Lawyers and employers.

My american employer rejected to file PERM after ads are posted. They were supposed to befiling in EB3 and they said they found candidates so they are not going to file green card...I am totally depressed..This is the true picture in almost all american companies. BEWARE of green card.
