Isn't Elfreda out of status since May '07 when the L1 ended, as I guess the company she was working for would have reported it? H1 doesn't start until oct '07 and H4 is pending, so what is the status now??

If you get an attached I-94 along with your approved H1 petition then I am guessing that you are going to be in H1 status otherwise it would be L1, since you have that stamped in your visa (however, you are out of status). This is a gray area and you should really consult a lawyer.

I don't think you have waited for 6 years after your PD to be able to file for EAD/AOS Benefits... the whole thing is messed up... There are people who filed during July Bulletin Fiasco and there are who could not even though their PDs are before yours. So do you ask them to SHUT UP ?
Everybody waited for a fair time before they got there EAD's. None of us got the EAD on day one. So don't try to mix all the issues into one.

Immigration Voice should take up this issue with USCIS. Those who came to US after 2007 should get PD of the date they applied for transfer of Labor OR applied for 140. Other wise it is abuse of law.
I am reviving this old thread because it was created by me, and it is highly relevant now. I predicted last month that EB2-I will become "U" soon, and it has happened (almost).
The quick way out of this mess is to ask CIS to move subst labor folks back in the queue. That will ensure that both EB3-I and EB2-I will move forward to July 07. Most of the labor substitution took place in that month itself.
This is an admin fix and does not require any new legislature. This is an idea whose time has come.

my uncle is the citizen of US and he applied for the green card for my mother so my father an me also can follow her and our case has been approved and we are waiting for interview appointment. the problem is that my surname in my passport has written different from my father, i mean his surname is ABCDEF and mine is ABC DEF,there is one space between my surname but in my birth certificate it is correct. i want to know will it make any problem for us then?

Thanks for the detailed answer. I think I will get this done after filing for 485. I have to get the passport renewed next year any way. May be they can do both at the same time.

Another friend of mine got the same thing done via the mail-in service. It took him 2 weeks to get the passport back.

I was one of the guys from MI that redds777 hosted. I must say I can't thank enough for the hospitality he and his family had shown us.
Also I know a couple of other DC members who hosted outside folks. Thanks to them also.

Actually funds that are raised for an event should happen much before any such event because we need to lay the ground work for the event in DC . I dont know when our next event would be. IV core can comment on that after watching the legislative events in DC in next few months .
What i was conveying was, to donate to the pool of resources and be ready when the bills start moving in the congress . IV would need to hit the road again at that time to continue the momentum from the lobby event and have our provisions included in the base bill. Regarding the dollar number, i dont know how much would be needed.
On the day of the events you can get involved by actually hosting some members in your homes if u live in DC area . actually i hosted 3 guys from MI thsi time . that way it makes easier for the members on their pockets as they would have spent on air tickets etc.. there are many ways to be actively invloved in IV for our cause. you can motivate your collegues and friends do teh same for our cause. Rest assured that IV will use the money sensibly as i have seen in this event.

Not everybody is afraid of sending flowers. I think you might end up getting a 2 min coverage from one channel nothing more. I find this whole thing pointless. You can yell and scream but you asked for my opinion.
Guys, any reason why we have a whopping 70% of the members not interested in contributing to this idea??
There is nothing illegal or offensive in a humble protest, so why the lack of interest?? Are you worried that you'll be pulled up for a humble protest?
It's not even that expensive to send a bunch of flowers. We have to come together and do something here to implore the USCIS to reform the immigration process. Just lurking around , and not doing anything about this is not going to bring about any reforms to this dysfunctional system.

I fail to understand what good is the video going to do - its another matter to post the nanny's pics and probably on Sulekha or other sites - I'm still not able to convince myself if that will be required now that law authorities are involved - but the idea to post the actual video - what the hell is this - dont know what folks were thinking when they asked you to do so.

I have been with the same employer since Jan 2004, and have every pay stub since then. However during some time in 2006, the company was in deep trouble, management takeover etc. and we were only paid for time spent on a major project (which was the cash cow). Because i was not directly involved in it, I was paid at about 50%, but every week, which lead my final W2 for 2006 to be around 76% of the total on the LCA. I looked at my paystubs and the total weeks at less than 100% is 5 months.
For 2004, 2005 and 2007 (on course) I am on course for my full salary. Also I got a bonus and stock options as the project took off and we are all in a better shape and my 2007 W2 should be higher.
Before 2004, I was a student on a F1 (MS degree) with one h1 in the bad days of 2002. However, my change of status was on the dot.. i.e. i got laid off on a friday and i filed my change of status to f1 the same day. My h1 visa was stamped in 2004 in India. My H1 was extended in early 2007
I am filing a self-sponsored I140. So, my question is:
1) Should I wait for 2008/whenever to file my i485 and hopefully show one year w2 and try to see if that goes through?
2) Try to convince my employer to pay me the back wages for 2006 (they may agree) in lieu of some future pay cut or paid out vacation or trade my stock options. File an amended return with a new 2006 W2 (what are the risks of an audit??)

Please see one of the replies I have above in response to another post. You employer could not pay you, but it is not your fault. If a RFE comes up, you can file affidavits to that effect. You have to consult a good lawyer.
If you are not going to be leaving the US, you shouldn't have to worry about the H1 stamp because you should be getting a new I-94 with your H1 extension approval notice.

2. When IO reviewed your case, did they look at your physical I-485 file? Did the service center transfer your case to the USCIS office you went for the interview?

I don't see big deal in this, just bit of information which has no consequences. Visa numbers do/will exhaust at some point in time.
so for real, how does it affect anyone?
