Filing the complaint is the easiest thing that I have done in a long time. As I had lots of written evidence so it took me close to 30 minutes to prepare the everything but normally it should take no more than 10 minutes. The DOL, Wage and Hour division, takes care of all the such complaints and the identity of the filer is kept confidential to the fullest extent provided by law.

I spoke with an investigator (who was very professional and courteous) who told me that even though FedEx shows the package was delivered they cannot locate it. The investigator asked me to resubmit the package which I did the next day. I received a letter from the DOL after 2 weeks saying my complaint has been received; they even assigned me a complaint number which I can use to track the progress of the complaint by calling their office. The DOL combined mine and my coworker's complaint together and assigned both of us the same complaint number; my coworker filed his complaint few days after I had filed mine.
What exactly happens to them?
Are they under a watch list?
Many employers will open up a new company and operate?
Maybe employers are ready to deal with this ????

Please do update us if any of you or your respective attorneys have received the notice from USCIS. I am in touch with the attorney of my previous company and hope to have something next week. Will keep you posted but looks like USCIS has started this exercise only recently as we have not seen this kind of posts in the past or as SmartBoy mentioned, many of us might not have created a portfolio to check the status of all the approvals we received so far on our immigration journey.

long time back I had posted something on ability to pay. look into the archives. Are you currently employed with this company?what is your current wage? what is the size of the company? how long has the company been in business? what has been the income in the past few years? how much cash do they have in bank? Do they have any external funding? how well do you know the owner? How many people have filed for GC in your company?
Ability to pay is a complicated issue to be answered without knowing all the details. Remember all the data needs to be fully legal (your small time employer should not be saving taxes by using tactics that help him financially but are not right thing to do) and correct and your employer should be willing to help you with all the information. This issue is not difficult to solve. With the help of a good lawyer who knows about the intricacies of ability to pay and takes active interest in your case and a good experienced CPA you can easily overcome it.

Quite honestly I think the best value from an MBA is derived from the timing, i.e. where one is in his / her career. I had a B Com (Accounting) from University of Sydney, an American CPA, combined with 10 years of work experience whilst enrolling for the MBA. I knew ahead, the curriculum wasn't going to bring added technical knowledge, however, it did bring some new ways of approaching the business community. Having the opportunity to sit in a class room and share / hear experiences from some of the successful executives does broaden the thought process. The program also helps build / expand the network. Again, I didn't feel I learnt something groundbreaking on the technical aspects of accounting / financial analysis, or the everyday business etc, but I wouldn't say it was completely useless. Plus for some reason, the "tag" does help.
BTW, I'm not sure the background of those who provided you feedback. My sentiments are shared at least by 3 good friends. One is a Wharton Alum and the other two, from University of Toronto. All of whom had at least 14 years of work experience, and were Canadian Chartered Accountants at the time of enrollment. The feedback could vary depending on the backgrounds.

Does this amendment strictly apply to new H1B filings or will it also impact people with H1B and an approved I-140 but need to extend it due to retrogression?

Last year facing long period of uncertainity I and my wife had made a decision to go back to India after meeting breaking even on our house.
I think most of us wanted to be in US in the first place because we thought that legal systems work here and justice is upheld. If we have to fight with the system anyway, why do it in a foreign land? Better to go home and make that place better .. probably good enough for them to envy.
As of now this country seems to be exactly opposite of what they claim to be.

Free economy & globalization - Only if it benefits us
Compassion & Humanitarianism - Only if you are American citizens. We don't care if farmers are comitting suicides in India or starving in Mexico due to our policies & subsidies.

It seems like any change in the immigration system is only going to land us in a worst position than we are in....
And looking at what is happening, I think it is naive to think we can influence the system to make it better for us.
Any noise we make seems to be making our opponents solidify and press us even harder.
I know this is not an upbeat comment that every IV member seem to expect, but this has been a depressing week, in an already depressing decade. :(

IV's goal is to fight retrogression. So whoever wants to fight retrogression should stay on board.
However, it is the privilege of a few affected people to discuss their problems on these threads. You are not obligated to follow these discussions if they are not to your taste. It is a legitimate question. Clearly USCIS is using one interpretation of the law while there is another possible one.
The discussion here doesn't mean that IV will flip tomorrow and say they will fight for only India/China EB2s.
Anytime such discussions come up, invariably a few people jump on board threatening to quit IV. Who are you threatening? Are you helping yourself by quitting the fight to solve your problem?

What I am trying to tell you my friend, like I have tried to tell others like you before, is this. If IV hurts my interest, I would have to be an absolute moron to support it.

I think the memo everyne is refering to is Cronin memo. Here is the link. https://www.shusterman.com/cronin51600.html. I-94 date after using AP is one year from entry date, at least in my case.
Can you please provide a link to this memo ? My attorney said, if I want to continue on H1 after reentry, I must get H1 stamped and enter in H status. If I use AP for reentry, I should change to EAD at work. This memo will help.

Now after seeing the efforts of the member in the flower campaign and sanjose rally, I am getting my confidence back and started my subscription again for $50 per month.
Will do additional contributions.
No single person needs to spend $64000/- for the community, which are supposed to have a decent earning and educated.
Everyone legal immigrant now has some debt to pay to Aman and IV.
Please help yourself by making a little contributions, if we 15,000 active members and everyone is contributing $10 per month, it will be 150,000 dollors, which is a good amount for lobbying. I am sure everyone can afford this amount monthly.
Start contributing, and let us make our dream realized.

I would like to share my experience and it may help some people here.
My H1 was sponsored by company A when I was working with them on OPT. I paid $3000 for H1 filing and attorney fees and company A gave me the H1 approval notice only after I signed an agreement that I would work for atleast one year with them.
Afetr 1 month of my H1 approval, I got a better job offer from company B and I got the H1 transferred. I notified my client and company A who threatened to revoke my H1, take me to court etc etc. They also withheld 4 weeks of my pay.
After joining company B, I filed a complaint against company A with DOL that they withheld my salary and also they demanded H1 fees from me. After 2 weeks of that complaint, my salary was deposited into my account and DOL was looking into my complaint about H1 fees. This case finally got resolved last week after about 18 months, when DOL finally persuaded company A to pay $3000 back to me.
I would request everyone who is a victim of these blood sucking employers to
take every possible action against them. There's a very little chance that they would go to court because they are themselves involved in gross irregularities.

I too have received an update from CRIS about reopening my old H1B from my previous employer which is a large multi-national organization. I have changed the company since then and I have already received my EAD with the new company. I am a bit worried about the outcome of this review. If in the event of revoking the H1b of my previous employer, will my current H1B will also be revoked or am I safe irrespective of the outcome. Would really appreciate if someone can provide any feedback.

-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..
