I believe we have rights. If the million of illegals think that they have the right to stay, why can't we? Obviously, everyone has their own experiences in the US. Some of you might not have hit the "boiling point" yet and so you might not have felt the heat!!! There are people who carry the entire family here and they depend on the GC to make a difference in life. You are you and you are entitled to your own interpretation as to whether or not this is RIGHT or Privilege. I believe what LogicLife said is very true as Immigration is a movement in life. If you don't believe, you probably don't deserve it when someone said you don't. I've been here for 12 whole years, got married and bought a house. People finishing residencies and fellowships on j1 visa go through some unscroplous lawyers and agencies and manage to get a waiver job by spending at least 20 to 25K.

It is completely unpredictable. Actually when you file I485 USCIS does not process FIFO(They are supposed to). For example there are 10k gc are left for the year. First they will process the applications which are cleared FP based on PD and receipt date. Always risk is there when filing without marriage. You are safe till USCIS starts process your application. When they take your application for processing then you cannot add your spouse. Also if CIR decides to process backlogs faster then also you will be in problem. Best option is if your marriage is already fixed do it within 3 months and file GC before PD is backdated. You need not file July first. You can wait till Jul15 to see next VB and decide.

Employee-Employeer can be in agreement to use "Unauthorized work protection - 245(k) - six months", continue to work and immediately apply MTR.
This is complex area and I don't understand fully. Please don't give red dots for these tough questions. I already reduced giving answers from 5-6 per day to one in 5-6 day.

As IV is willing to help those having issues with employers by providing a platform and interfacing with DOS, USCIS, DOL, Media, lawyers and support in any form - nothing stops people from standing up for themselves and report an abusive employer.

I have a valid H1 approval till 2011 and used AP for my previous india visit. Right now i am transfering my H1 to a new company.
I asked my lawyer if i was on H1 status or not? She replied, Unitl you use EAD, i will be on H1B Status.
and also we can transfer our H1 to new company also. thats what i am doing now.

Did it say anything on your online account about RFE when you received the email, or you just got the email i.e. when you click on the receipt number it shows status of the case which usually shows a generic message that the case was received and is pending, so did that message change?
If not, then did anybody else who got the RFE had that message changed?

Lets ask Core not to just go with the temporary fix of July visa bulliten.
We might apply for EAD and AP but what if they throw our papers some where and repeat the same thing.
This time they will be very careful in issuing visa bulliten
In future very slow progression in visa dates...adjudicating cases very slowly always stating that due to july visa bulliten we have lots of cases ...we will not be able to do anything until we sort ou...blah blah...

We should be firm with our goals...
Lets come up with some ideas....

Everyone ( or most of us ) realises this is just a battle won. But it is a big one and the first one with tangible benefits as far I can remember.

There is also a 7 percent cap for each country. The sum of family and employment visas for china and india cannot exceed 25,000 approx as long as ROW is oversubscribed.
IF excess visa from EB2 ROW overflows to to EB2 china/india, this would clearly violate the 7 percent limit as the sum total consumption of visas by these countries would be well over the 7 percent of employment visas. Unless the overall demand for employment visas is less than what is available, the 7 percent would clearly apply.
The only thing that I feel might happen would be any unused EB1 china/india visas flowing down to EB2 china/india.

Read the term "Not to exceed 28.6 percent". So EB3 can't exceed 28.6 percent which means unused visas from EB2 cant all go to EB3. Since EB2 ROW is current, the unused EB2 visas should be coming to EB2 India & china as per AC21 law.. no?

With 'privillege' you have to follow existing rules religiously then if it was a 'right'.
Well if we were to carry your reasoning a little bit further ...being a citizen of a country, any country, is only a privilege and not a right as you have to follow the rules and laws of the country.
The actual difference is in the definition as has been pointed out earlier.....

"privilege" - is something you are not entitled to or deserve but nevertheless get because someone condescended to give it to you.
